Religious Affiliation and Individual International-Policy Preferences in the United States

Empirical examination of individual-level survey data on national identity, in general, reveals a significant relationship between religious affiliation and an individual's international-policy preferences and that this relationship varies across Protestant denominations. Specifically, we test attitudes toward import and immigration policies, the role of international institutions, and unilateral policy actions. The empirical results indicate that individuals affiliated with conservative Protestant denominations are more likely to support positions on international issues that can be regarded as consistent with the anti-globalist right. We also find evidence of a reinforcing regional effect among conservatives in the south, and differences in the preferences of Baptist and non-Baptist African Americans.

我国未成年犯社区矫正进程中的几个问题

现阶段我国未成年犯社区矫正工作尚处于探索阶段,实践中存在许多不足之处。大多数学者比较注重未成年犯社区矫正的立法、矫正项目、矫正队伍等问题,忽略了农村地区、流动在城市的外来未成年犯的社区矫正工作。探索并解决好这些问题,对我国未成年犯社区矫正的健康发展有所裨益。     

刑事被害人境遇之实证分析

通过对某区法院2004年-2007年上半年间审理的故意伤害等七类严重侵犯人身权利犯罪中被害人境遇的调研,系统分析了刑事被害人的艰难处境.发现有以下特点:暴力性犯罪多发,人身损害案件逐年攀升;民事司法救济不足,"空调白判"现象普遍;被告人赔偿能力弱,以罚代赔倾向明显;被害人负担能力差,亟待经济赔偿或补偿;相关救助制度缺位,利益诉求渠道不畅.

刑事和解后续工作对于完善刑事和解机制、促进冲突彻底解决和社会和谐具有非常重要的意义。我国对刑事和解后续工作的探讨还需深化。刑事和解后续工作可从刑事和解协议的效力确认，加害人的犯罪预防和社会化，被害人的保障和保护三个方面具体展开。     

构建中国刑事被害人国家补偿制度之思考

The theory of recovering social justice, public remedy to rights, balance of interests and value of benefits are the basis for the establishment of state compensation system for victim of crimes, which is necessary and feasible in China. In accordance with the principles of obtaining justice and fair treatment, relying mainly on the offender’s compensation, supplemented by state compensation, state compensation with certain conditions, state compensation in due process, and the degree of compensation proportionate to the extent of damage, the related criminal legislation should provide the scope of subjects eligible for compensation, the object and limit of compensation, the competent agency of compensation, the procedure of compensation and so on. Sun Qian, professor and tutor of doctorate candidates, is presently a deputy prosecutor-general of the Supreme Procuratorate with the title of Grand Prosecutor of China. He once held posts as director of former Prosecutor-General’s Secretariat, deputy director-general of the Criminal Prosecution Department, president of the National Prosecutors’ College, and chief prosecutor of Jiangxi Province. Prosecutor Sun, also vice president of China Law Society and vice president of China Society of Prosecutors, specializing in criminal system and criminal law, has released more than 100 theses in academic journals such as Journal of Law and China Legal Science and published more than 20 books as author or editor. In 2004, he was nominated as a member of the “First Group of National Talents Project in the 21^st Century” launched by seven central ministries of China. Moreover, Deputy Prosecutor-General Sun was once a representative of the 10^th National People’s Congress of China.     

China＇s Higher Education System＂ A Case for Cautious Optimism

Although China＇s unemployment rate for university graduates is quite high and overall satisfaction among students is lower than desired, there are some universities experiencing atypical results. The authors build on previous surveys conducted in 2008 and 2010 by conducting the third survey of students in a university in eastern China. The results are atypical. Student satisfaction is much higher in certain categories than anticipated. Follow-up surveys of faculty members find that they prioritized teaching more than research and this accounts for the difference between the results observed here and those found previously. In short, the faculty at this university disregarded the incentive system and prioritized teaching above what the system was designed for. In turn, students experienced higher levels of satisfaction than the norm for Chinese universities. Faculty acknowledged that they were rewarded for research but prioritized teaching. While it is possible that some might disregard economic incentives for other priorities, it is highly unlikely a majority would. A more compelling explanation is the well-thought-out and highly developed two-fold incentive system this university uses, which can be exported to other Chinese universities seeking similar results.

被害人参与量刑程序是量刑程序改革的重要组成部分,对于化解社会矛盾、促进社会和谐具有重要意义。从当前试行效果看,这一制度设计在实践中遇到一些困境。2012年修改后的刑事诉讼法为被害人参与量刑程序、发表量刑意见预留了足够空间。未来应区分＂被害人影响陈述＂与被害人的量刑意见,处理好被害人的量刑意见与检察机关的量刑建议的关系,进一步完善具体的制度设计。
