Many modern books reflect society's involvement with drugs, sex, alcohol, and violence. Teenagers will read a great variety of stories and view different images of themselves and their times.

There are many paths that can be taken with the families we encounter in our work. It is this richness in options that can make the child and youth care approach so powerful. However, amongst each potential path there are a number of common guideposts that serve as markers for our interactions with families. These guiding principles are described through the use of examples from a family in a program for teens who are parenting.     

Residential tourism and depeasantisation in the Ecuadorian Andes

International residential tourism is a recent phenomenon in the Andean area. However, in places where it has been established, rapid changes in social and economic structures have occurred. The Municipality of Cotacachi (Northern Ecuador) is paradigmatic. Having become a destination for American retirees, residential tourism has generated a sharp increase in the price of rural land and has decelerated a land market that once allowed young farmers to continue agricultural activities. Residential tourism has promoted land exchange value while sacrificing use value, threatening peasant reproduction mechanisms.     

MI Implementation in Juvenile Justice: A Case Report

Motivational interviewing (MI) is a communication style focused on enhancing clients’ own motivation towards change. In the justice system MI has evidence to support that it enhances communication and change behaviors in youth. As most MI training is designed for healthcare settings training and implementation of MI must be adapted to fit the juvenile justice model. This includes both rehabilitation and restorative justice. Here we describe the details that allowed one county small county in Pennsylvania to roll out MI training and initial skills review in less than 6 months. The case reviews the details of planning, trainings, and timing of activities. We then discuss what elements of those details fit into a greater implementation plan that may be applied elsewhere. Four key elements were instrumental to implementation: 1) appreciation of JPO time constraints, 2) cost containment 3) using blending to enhance JPO flexibility with MI use, and 4) policies that normalize use of MI. This outline may assist other courts in their own implementation efforts.     

悖信援引时效抗辩权的法律规制

义务人实施一定言行导致权利人合理信赖诉讼时效不会成为其行使权利的障碍,其后义务人援引时效抗辩权的,构成悖信援引行为。我国现行法框架下对于悖信援引行为的法律规制,难以通过起算、中断等规则予以解决,而应当适用诚实信用原则或禁止权利滥用原则限制此类援引行为。司法实务中适用诚实信用原则或禁止权利滥用原则处理时效援引争议的典型案例包括:义务人恶意躲避权利人、双方存在长期合作关系使权利人产生合理信赖、时效期间届满后双方进行某种形式的磋商等。对于司法实务中某些误用此二原则的裁判意见,应当尽量予以纠正和避免。     

A Profile of Violent Offenders in Spanish Prisons

In Europe, it is relatively uncommon to find studies that investigate the criminal profiles of violent offenders, especially infrequent are those that pay special attention to offenders’ mental health/substance use disorders and histories of violence during childhood. The current research explores whether inmates who are incarcerated for violent offenses (n = 536) in Spain are different in terms of the aforementioned factors as compared to inmates incarcerated for non-violent offenses (n = 536). Multivariate logistic regression analysis revealed that violent offenders, as compared to their non-violent counterparts, were more likely to be younger, younger at the time of their first arrest, single, use alcohol, receive treatment in prison for anxiety or schizophrenia, and report physical abuse during childhood.

民事诉讼受理是纠纷进入司法程序的初始必经阶段,对于当事人诉讼权利保障意义重大.随着经济体制改革的深化和经济的快速发展,许多深层次的矛盾不断出现,民众的诉求越来越多,而我国的法律体系和社会保障机制还不够完善,人民法院作为解决矛盾纠纷的专门机构,应当担负起为构建和谐社会提供有力司法保障的历史任务,最大程度地吸纳化解矛盾纠纷.然而,现行民事诉讼受理制度所规定的起诉条件,既包括实体内容又包括程序要求,确定性有余而灵活性、包容性不足,虽然能够一定程度地起到过滤纠纷,节约司法资源的作用,但其对于新型权利诉求进入诉讼渠道的阻隔作用日益显现,甚至为个别地方限制当事人正当诉权的行使提供了借口.在改造方案的设计方面,应当理性审视现有司法资源和司法环境,更宜采渐进式而非跃进式的方案,避免由于准备不足而导致司法不堪重负,制约正常功能的发挥.

医疗卫生信息化法治建设研究

随着我国医疗卫生信息化的纵深发展,在临床管理信息系统和远程医疗的应用正逐渐成熟而趋于智能化进程的同时,网络安全隐患、信息外泄、违法谋利及违背医学伦理和医德等问题,不同程度地降低了患者满意度和信任度,有损于在广大就医者群体才树立起的我国现代高科技医疗信息化的整体形象。因此有必要加强卫生信息化的网络安全监控,重点研究和完善国家和地方相关的卫生信息化法治建设,依法有效防范远程会诊信息被非法读取的风险;依法遏制为本医药机构谋取不当利益而外泄的信息数据;依法取缔发布虚假、带有欺诈性的医疗电子网络信息、医学图像的广告等非法行为,从而使医疗卫生信息化系统工程的建设朝着更为完善、健康和高速的方向发展。
