股东直索责任性质的博弈解析

我国《公司法》第20条与第64条对股东直索责任采“连带责任”提法，但对究竞为何种连带责任却语焉不详，由此形成学界争议。直索责任的性质问题在本质上是共同连带责任与主从连带责任的制度抉择，是法律对于选择权的不同配置。在由两种责任方式所构建的不同博弈模型中，可观测到债权人与股东各自如何作出不同的行动决策并进而导致何种结果，从而得出共同连带责任的制度安排更为切合制度目标的结论。     

浅析我国公民政治参与动因的变迁发展

建国初期我国公民政治参与动因经历了一个利益动因和信念动因由强到弱，直至利益动因基本消失，信念动因受误导，而服从动因和强制动因逐渐占据主导地位的变化过程。改革开放以来，我国公民政治参与的利益动因逐渐占据主导地位，强制动因基本消失，服从动因仍然存在，信念动因缺乏，公民责任动因不足。而理想的政治参与无疑是利益动因和公民责任动因相结合作用下的政治参与。

农民工市民化问题是我国城市化战略的重要一环,就现在而言,农民工面临着收入低、就业难、治病贵等一系列问题,因而政府作为城市治理主导者,应该在解决农民工问题上负起相应的责任,发挥该有的作用,积极深化制度改革,转变管理模式,更好地促进农民工市民化进程。     

落实《老年法》之政策支持探究简

新的《老年人权益保障法》是一部关系数以亿计的社会老年成员在保证晚年阶段生活质量的重要法律，但如果没有各级政府制定和完善的政策支持，该法律的相关条款则势必难以落到实处。因此，“精神赡养”、“就近居住”等条款，需要政府配套劳动、就业政策的支持；建立“长期护理保障”制度，政府需拿出符合中国国情的方案；构建新的养老服务体系，重点应完善养老机构的布局与建设；老年人宜居环境应不止于公共设施，还包括住宅设计、社区服务环境建设等；鼓励老年人“参与社会发展”，需要改革退休政策、防止就业歧视。     

Security Identities and ‘No More,No Less’ Operations: On Making NATO's Involvement in Darfur Possible

This article explores NATO's support mission to the African Union's peacekeeping operation in Darfur, Sudan between 2005 and 2007. NATO policies are commonly presented as functional responses to events, but how did a conflict on the African continent become the Atlantic Alliance's business? In this essay, a poststructuralist practice-oriented approach is used to understand the way in which discursive practices progressively establish a policy option as ‘natural' in a given situation. It is argued that the normalization of NATO's support mission to the African Union in Darfur and the integration of this operation in NATO's security identity were the result of complex and conflict-ridden social interactions between different discursive practices supported by different actors.     

Production goes global,compliance stays local: Private regulation in the global electronics industry

Poor working conditions in global supply chains have led to private initiatives that seek to regulate labor practices in developing countries. But how effective are these regulatory programs? We investigate the effects of transnational private regulation by studying Hewlett‐Packard's (HP) supplier responsibility program. Using analysis of factory audits, interviews with buyer and supplier management, and field research at production facilities across seven countries, we find that national context – not repeated audits, capability building, or supply chain power – is the key predictor of workplace compliance. Quantitative analysis shows that factories in China are markedly less compliant than those in countries with stronger civil society and regulatory institutions. Comparative field research then illustrates how these local institutions complement transnational private regulation. Although these findings imply limits to private regulation in institutionally poor settings, they also highlight opportunities for productive linkages between transnational actors and local state and society.     

Personality disorders and criminal responsibility in the Spanish supreme court

The aim of this study is to determine how personality disorders (PDs) are viewed in relation to criminal responsibility (CR) within the jurisprudence of the Spanish Supreme Court. All sentences with PD from 2000 to 2006 were included. The most frequently occurring PDs are cluster B and nonspecific disorders, alongside another Axis I disorder. The Spanish Supreme Court admitted appeals on 50%, and sentencing criteria were changed in 25% of the cases. The most frequent outcome was in the first instance a minor reduction in CR and second full CR being upheld. The borderline PD and the comorbidity between a PD and an Axis I disorder are the variables associated with the decrease in CR. The assessment of CR in PD should be undertaken using the diagnosis as a base taking into account other elements, such as the type of PD, its seriousness, comorbidity, and relationship with the criminal behavior on trial.

Forensic psychiatry in China

This article reviews the legal basis for the development of forensic psychiatry in China, the organization of clinical assessments, and training of forensic psychiatrists. Regulations for the management of patients in Ankang hospitals and the role of forensic psychiatrists within the Criminal Justice system are described. The primary role of forensic psychiatrists is to provide expert opinions on competence to stand trial and criminal responsibility in criminal cases. They are increasingly involved in civil court proceedings and tribunals at the request of a range of official agencies. The clinical cases assessed by Chinese forensic psychiatrists are very similar to those of their counterparts in Western countries, but the organizational and legal framework for these assessments reflects a very different system that has evolved independently.
