合同解除有无溯及力之争有待休矣——以意大利法为视角的再思考

国内理论对合同解除的法律效果侧重于论证解除有无溯及力。但实际上，意大利等传统坚持溯及力原则的国家也正出现渐渐淡化溯及力概念本义的趋势。主导解除法律效果的根本不在于溯及力概念本身，而是通过明确具体的返还制度，保护合同双方的利益平衡。     

合同解除效力形态的事实判断研究

合同解除溯及力问题首先并非价值判断问题 ,而是事实判断问题 ,即合同解除会使合同处于什么样的效力形态。在特定物交易时代 ,合同解除只能使合同要么溯及既往地消灭 ,要么只向将来消灭 ;在种类物交易的情况下 ,合同解除会使合同能够发生多种效力形态。针对上述多种效力形态 ,用“合同解除”一个概念表述更具科学性 ,也更加符合我国法律用语习惯和国际立法趋势     

论心理咨询中的价值中立和价值干预

西方的“价值中立”理论为我国的心理咨询提供了更为丰富的思维创新空间,但如何科学认识和吸纳这些舶来的思想精髓,是国内学术界一直讨论的重点话题。该项研究将从心理咨询宏观的运行规律,到心理咨询的本土化、适用性角度,认真探讨“价值中立”与中国本土心理咨询实践的相悖性、冲突性,并以此入手认真解析心理咨询中进行价值干预的必要性和具体运行原则。     

Acts of collusion: myth,media, and the populist imagination in the 2016 United States presidential election

ABSTRACT

This article considers the hypothesis that the 2016 nomination of Hillary Clinton appeared rigged because the Democratic Party persuaded itself that the next step in guaranteeing Obama’s legacy and advancing democratic progress would be the election of the first woman president. Democracy finds logical steps in politics suspicious (even dangerous); consequently, the constructed stability and order begin to falter or appear compromised. In this context, populist figures like Trump may gain political legitimacy by claiming to be outsiders speaking with the voice of the people. Populism, founded on a mythical notion of sovereignty, promises direct access to the democratic experience through four interconnected mythologies (unity, conspiracy, the golden age, and the savior), as evident in the 2016 election. The democratic struggle accordingly extended to Trump’s attacks on the media (as “fake news”) and to the Mueller investigation of collusion between the Trump campaign and foreign actors representing the Russian government.     

外语教学中的跨文化策略

在外语教学中科学运用跨文化策略对克服文化干扰、顺利实现外语教学的目标、培养具有跨文化交际能力的人才是非常重要的。跨文化策略可通过培养学生的跨文化意识和提高学生的跨文化交际能力来实现。     

从原则到例外：《民法典》时间效力规则的体系化展开

《民法典》施行前发生的法律事实引起的民事纠纷案件,涉及《民法典》可否溯及适用的问题。原则上,《民法典》不溯及既往。对于一时性法律事实,应当适用当时的法律、司法解释的规定,不适用《民法典》的规定;对于持续性法律事实,在一般情形下即行适用《民法典》的规定,涉及合同履行争议时分段适用《民法典》的规定。有利追溯、空白追溯作为《民法典》溯及既往的例外,在适用范围上互为补充,在构成要件上互相牵制,在法律效果上层次分明。不过,即使在有利追溯、空白追溯的例外情形下,《民法典》的溯及力也是有限度的,要受到既判力的约束。     

Telecommunications regulation: Creating order & opportunity in UK digital terrestrial television Whitespace

This paper considers how the UK Regulator, in collaboration with stakeholders, is attempting to create a new market opportunity for advanced networked services using interleaved Digital Terrestrial Television (DTTV) Whitespace, that is, valuable spectrum released and reorganised post the digital switchover. It discusses inter alia a key issue, which is how the Regulator will balance the technical requirements needed to create a commercially viable network, against his competing obligation under the Communications Act 2003 to maintain order and avoid interference to DTTV and Programme Making & Special Event (PMSE) users. Particular consideration is given to the outcome of field trials and areas of forward risk for the Regulator.     

Comparison of the analytical capabilities of the BAC Datamaster and Datamaster DMT forensic breath testing devices

The State of Michigan uses the Datamaster as an evidential breath testing device. The newest version, the DMT, will replace current instruments in the field as they are retired from service. The Michigan State Police conducted comparison studies to test the analytical properties of the new instrument and to evaluate its response to conditions commonly cited in court defenses. The effects of mouth alcohol, objects in the mouth, and radiofrequency interference on paired samples from drinking subjects were assessed on the DMT. The effects of sample duration and chemical interferents were assessed on both instruments, using drinking subjects and wet-bath simulators, respectively. Our testing shows that Datamaster and DMT results are essentially identical; the DMT gave accurate readings as compared with measurements made using simulators containing standard ethanol solutions and that the DMT did not give falsely elevated breath alcohol results from any of the influences tested.
