甲醛固定及石蜡包埋组织的DNA分型及其应用

目的：建立甲醛固定及石蜡包埋组织ＤＮＡ的基因分型方法并使之应用于实际检案。方法：用Ｃｈｅｌｅｘ和有机溶剂提取法提取ＤＮＡ,以ＰＣＲ与反向探针杂交技术作ＰＭ和ＨＬＡ－ＤＱＡ１位点分型。结果：２６份包埋组织块有２４份能得到理想的分型结果。结论：本法可用于法医学个人识别和亲子鉴定     

“翻讼”分解及对策

翻讼,是近年来多发于司法实务中的现象,不仅造成诉讼程序的反复启动,浪费司法资源,而且对司法公信力带来负面影响。翻讼具体表现为翻供、翻证和翻案三种情况,使案件在诉讼程序中出现反复无常、捉摸不定、似是而非的边缘化状况,不仅是困扰司法机关的一大难题,也是消耗诉讼资源的一大固疾。理性地看待翻讼并积极地“排除”翻讼所带来的“损害”,通过顺向思维、逆向思维、转向思维,达到铁证如山、防患于未然的效果。     

对改变道德成本逆向走势倾向的探讨

改革开放以来,我国公民道德建设取得了巨大的成绩,但也存在着不少问题。其中最根本的原因就在于道德生活领域存在着道德成本逆向走势的倾向,导致人们对践履道德心存疑虑,甚至敬而远之。必须采取有力的措施改变道德成本逆向走势的倾向,公民才会自觉践履道德行为,公民道德建设才能真正取得实效。     

反向子公司并购中的法律问题研究——从美中两国公司并购形态的角度

美国法上的反向子公司并购作为反向B型重组,不同于我国反向子公司并购形态,在并购目的、环境、对价等方面两国各有其特点,反向子公司并购最重要的一点是（并购公司）母公司利用（并购公司的）子公司对目标公司进行并购,从而实现对并购公司的并购目的。至于具体的并购行为则可以灵活多样。反向子公司并购有着其鲜明的可行性特点,比如避开少数股东阻挠、子公司债务隔离屏效应以及税法上的优遇,这些都使得反向子公司并购有着强烈的促进和规范意义．值得仔细分析。     

试论商标侵权中的反向混淆

反向混淆是近年来我国商标侵权案件中遭到的新问题,而我国现行的商标法中没有就“反向混淆”问题做出具体的规定。从商标法律制度的发展完善角度来看,我国应加强对反向混淆案件的关注与研究,并针对反向混淆的具体特点进行适当立法,构建规制反向混淆的法律制度,为反向混淆问题的处理提供明确而充足的法律依据。     

Examining the judgments of pedophiles in relation to a non-sexual offense

ABSTRACT

Even though pedophilia is not synonymous with child sexual abuse, it remains a highly stigmatized phenomenon. As such, non-offending pedophilic individuals are judged as being dangerous, abnormal, amoral, and in need of punishment. It is unknown, however, whether a pedophilic individual would be judged more harshly than a heterosexual individual and a homosexual individual in relation to a nonsexual, nonviolent offense. This was the aim of the present study. A final sample of 309 participants were recruited online and allocated to one of three sexual orientation conditions. Participants read the same hypothetical crime report (breaking and entering) followed by a suspect profile that was identical across conditions except for sexual orientation. They then provided sentencing and moral character judgements of the suspect. Participants also completed a punitive attitudes scale pertaining to pedophilia. Results showed that the pedophilic individual received harsher judgments relative to the heterosexual individual, but only at higher levels of pre-existing punitive attitudes. These findings suggest that anti-pedophilia stigma can bias judgments about offenses that are not sexual. We argue that this is due to a ‘reverse halo effect’. However, we consider an alternative explanation based on the idea of interpreting information in a schema-consistent manner. Limitations and suggestions for future research are discussed.     

Determination of Vehicle Speed from Recorded Video Using Reverse Projection Photogrammetry and File Metadata

The prevalence of security and in‐car video has increased the number of motor vehicle accidents captured on digital video. However, inconsistencies in how to accurately determine time and distance for vehicle speed has led to examinations with varying results. A potential solution for calculating time intervals is to use frame timing contained within many digital video file's metadata, recorded with 0.000001 sec precision. This paper examines a fatal motor vehicle accident where frame timing information was used with distance measurements from reverse projection photogrammetry to calculate vehicle speed. A margin of error was then calculated based on the accuracy in performing reverse projection photogrammetry distance measurements. The resulting speed calculation was then compared to event data recorder data and found to be within an average of ±1.43538 MPH. Using specific time intervals may lead investigators to more accurate speed calculations, specifically those involving variable frame rate video.     

论刑事诉讼中的程序回逆

刑事诉讼本应从立案侦查,向起诉、一审、二审不断推进,直至执行而终止,然而在我国刑事诉讼中出现了不少程序回逆的现象。有些程序回逆是必要且合理的,但大多数程序回逆或者背离了刑事诉讼法设立的目的,或者与刑事诉讼法的基本原则相抵触,或者违背了刑事诉讼的基本理念。有必要对有关法律和司法解释进行修改,保留有必要且合理的程序回逆的规定,废除无必要且不合理的程序回逆的规定,限制有必要但欠科学的程序回逆的规定,以完善相关诉讼程序和制度。     

Use Your Illusion: Televised Discourse on Journalistic Ethics in the United States, 1992-1998

Journalistic ethics are predominantly created and maintained through authoritative discourse, not codification. 'The line' between mainstream and tabloid news media is a ubiquitous discursive formation that is reified and circulated through mass media and vernacular usage. This paper investigates the validity of the 'boundary' that separates the trustworthy from the questionable, through an analysis of the discourse by journalists on television programs in which transgressions are discussed. Results of the analysis show that little evidence exists for rational belief in the impermeability of the boundary, nor any support for the mainstream media claim that tabloid practices are 'contaminating' media practices generally. It is concluded that such arbitrary distinctions legitimize the dominance of mainstream media by creating a veneer of credibility, while continuing to engage in tabloid-style practices.     

西方债务危机背景下公共福利制度困境的探索与反思

在美欧债务危机背景下,公共福利制度遭遇阻滞社会发展的瓶颈,这种困境凸显在各国政府面前,引起社会各界的探索与反思。从学术角度来看,既要挖掘公共福利制度困境的理论诠释与缺陷,又要探索公共福利制度发展的理论框架与分析路径。从实践角度来分析,既要剖析妥善解决公共福利制度困境的主要影响因素,又要反思公共福利制度困境带来的逆向公正问题。归根结底,公共福利制度的改革势不可挡,公共组织、企业与社会组织都应该成为社会福利的责任主体,建立政府、市场与社会合作共担社会福利责任的机制迫在眉睫。
