美国对社会思潮冲击的应对模式及其启示

美国流派纷呈的社会思潮对其思想政治教育有着复杂的影响。美国在应对社会思潮冲击的过程中,形成了包括美国资本主义制度及其优越性的教育、责任公民的教育和美利坚民族精神教育等在内的较为完备的思想政治教育体系。美国还通过采用显性教育与隐性教育相结合的方式,走学校教育与社会教育相结合的路径,实现了数量众多的外来移民的"美国化"。美国的这些做法对我国具有重要启示。我们要坚持用社会主义核心价值体系引领社会思潮;加强应对社会思潮时的"无意识教育";增强应对社会思潮时的"教育合力"。     

STATEWIDE SPECIAL EDUCATION SURROGATE PARENT PROGRAMS: ENSURING QUALITY ADVOCACY TO ALL FOSTER CHILDREN WITH SPECIAL EDUCATION NEEDS

The Individuals with Disabilities Education Improvement Act (IDEIA) protects foster children's rights to have a special education decision maker. For foster children who do not have a natural or adoptive parent or a responsible adult in their life to take on this role, IDEIA requires that a special education surrogate parent be appointed by appropriate procedures. Under IDEIA, these procedures are delegated to the states. Each state must ensure that local education agencies (LEAs) delineate methods for recruiting and maintaining a pool of available special education surrogate parents. Due to differing state laws and LEA procedures, there are many discrepancies in the quality and availability of special education surrogate parents. To combat these problems, this Note proposes principles for administrative regulations establishing statewide special education surrogate parent programs by examining existing statewide programs. Administered through a state's Department of Education in collaboration with child welfare agencies, statewide special education surrogate parent programs guarantee well‐qualified decision makers who will advocate for all children eligible for special education services.     

Creative podcasting as a tool for legal knowledge and skills development

ABSTRACT

This article draws on the authors’ experience of introducing a student-led legal podcast in their law school in September 2017 to explore creative podcasting’s potential as a tool of legal knowledge and skills development. Drawing on the authors’ observations as the coordinators of the podcast, as well as a survey conducted amongst student participants, it considers the value of creative podcasting as a means of enhancing legal knowledge, aiding skills development, and fostering a feeling of collaboration and community. The article also reflects on the practical challenges associated with running a project of this type outside the school’s curriculum, focusing particularly on the challenge of encouraging student buy-in.     

The patterns and prevalence of mass murder in twentieth-century America

Even though previous research has not examined mass murder prior to 1965, scholars have asserted that the mid-1960s marked the onset of an unprecedented and ever-growing mass murder wave. Using news accounts and the FBI's Supplementary Homicide Reports (SHR) as sources of data, this study analyzes 909 mass killings that took place between 1900 and 1999. Although the mid-1960s marked the beginning of a mass murder wave, it was not unprecedented, because mass killings were nearly as common during the 1920s and 1930s. The results also show that familicides, the modal mass murder over the last several decades, were even more prevalent before the 1970s. Moreover, mass killers were older, more suicidal, and less likely to use guns in the first two-thirds of the 20th century. Although some have claimed that workplace massacres represent a new “strain” in mass murder, the findings suggest that the only new type of mass killing that emerged during the 20th century was the drug-related massacre.

提高干部教育培训组织管理的有效性,是干部教育培训改革的重要着力点。近年来,理论界和各级各类干部培训机构围绕这一问题进行了卓有成效的探讨,取得了许多可贵的成果。本文以CNKI中搜索到的相关成果为研究对象,运用文献计量学的方法,从文献来源数据库、发表年度和出版来源、作者单位及研究成果资助与主题观点的角度进行分析,通过分析综述目前研究的主要方面,发现研究中存在的问题,为深入研究此问题提供参考。     

我国高等教育管理法律规范体系的内容及完善

我国高等教育管理法律规范体系主要指《中华人民共和国教育法》、《中华人民共和国高等教育法》等法律法规中调整高校与学生之间关系所涉及的高校的法律地位、高校的主要权利和义务、学生的主要权利和义务、学生权利的救济等方面内容的法律规范的总和。本文通过解读并分析其主要内容,探讨了我国高等教育管理法律规范体系在内容和形式方面的立法缺陷,提出了相应的完善对策,以期有利于保障高校依法治校。     

行政复议前置:高等教育行政诉讼的制度选择

高校因行使法律、法规授予的行政职权引起的行政争议,应当适用行政法予以解决,行政诉讼介入高等教育是大势所趋。教育专业性对大学自治的诉求,以及法院对司法成本激增的顾虑,是阻碍司法介入高等教育的双重难题。行政复议前置制度可以在保证解决教育争议的专业性和降低司法成本之间寻求平衡,能够为当事人权益提供有效救济,给教育系统内部纠错提供最后一次机会,使司法介入高等教育具有更大可行性。     

加强大学生马克思主义信仰教育

在多元经济、政治、文化的影响下,我国当代大学生的信仰逐步呈现多元化的发展趋势,因此,加强大学生马克思主义信仰教育,已成为我国高校当前一项极其重要而迫切的任务。高校教师要从自身出发,做到思想和行为相统一,在教育内容的选择上做到科学和价值相统一,在教育方式的运用上做到原则和灵活相统一,在教育效果的考核上做到理论和实践相统一,从而使更多的大学生逐步树立马克思主义信仰。

女大学生是中国女性高层次人才的重要后备力量。伴随着越来越多的女性进入高等学校的大门,我们需要进一步关注高等教育过程中的性别差异问题。本文通过介绍西方女性主义学者对传统人的发展理论的批判,以及对高等教育过程中存在的性别差异及其影响因素的分析,以期对中国女性高层后备人才培养机制的发展有所启发。
