重特大交通事故网络舆情的应对

在网络时代背景下,交通管理部门在处理重特大交通事故时,由于未来得及在思想、政策以及方式上做出相应改变,藉由网络的力量,使得一些重特大交通事故演变成全国,甚至国际关注的事件。重特大交通事故网络舆情的产生与发展有其制度性原因和工具性原因,因而应有相对应的临时处理措施和工具性处理措施。临时性处理措施的本质是坚持"以人为本",实现个案正义;而工具性处理措施的核心是在了解其演变逻辑的基础上,注重网络舆情的搜集与调查,完善政府网络发言人制度以及政府新闻发言人制度。     

网络服务提供者“知道”认定新诠——兼驳网络服务提供者“应知”论

我国目前立法规定和司法实践全面承认了"应知"可用于认定网络服务提供者主观知道,但学界在这一问题上却分歧很大。这一现象的产生源于对网络服务提供者提出的应知要求与其不负审查义务的共识相冲突。主张网络服务提供者应知既难以在理论上得以证成,也是对相关规定的误读。通过借助诉讼法中的推定规则,可有效证成网络服务提供者主观知道,从而实现了从起点客观事实不明到终点网络服务提供者承担侵权责任间逻辑脉络的贯通。依循这一逻辑路径,我国目前的相关立法、司法和未来学界的研究重点等都需作出相应的调整。     

Knowing the past to understand the present - issues in the contracting for cloud based services

This article builds on our previous introductory article to cloud computing ([2009] 25 CLSR 270-274) and seeks to explain how cloud computing has evolved. We then discuss how this evolution impacts on key contractual and legal considerations and how the treatment of these considerations might differ from their treatment in traditional IT supply agreements.

Keeping the rascals in: Anti‐political‐establishment parties and their cost of governing in established democracies

Coalition governments in established democracies incur, on average, an electoral ‘cost of governing’. This cost varies across coalition partners, and is higher for anti‐political‐establishment parties. This is because, if such a party participates in a coalition, it loses the purity of its message by being seen to cooperate with the political establishment. In order to demonstrate that anti‐political‐establishment parties suffer an additional cost of governing, this article builds on the work by Van der Brug et al. and refines the standard cost of governing theory by ‘bringing the party back in’. The results of the analyses, based on 594 observations concerning 51 parties in seven Western European countries, cast doubt on the conventional concept of a cost of governing that pertains to all parties equally. The findings call for a major revision of the standard cost of governing literature, while adding a significant contribution to the debate on strategies against parties that may constitute a danger to democracy.     

顾客理念的理性吸纳促进服务型政府建构的文献综述

服务型政府是一种新型的政府管理模式，西方新公共管理运动所提出的先进理论为服务型政府的构建提供不少借鉴。其中被新公共管理运动视为改革指南的顾客理念就被众多学者力捧于指导服务型政府的构建，在指导服务型政府构建起积极作用的同时也存在众多不足，且其对服务型政府构建带来的消极影响没有引起足够重视。所以，通过研读关亍顾客理念的相关文献，总结归纳出顾客理念的积极作用和消积影响因素，并做出相应文献综述和评价，对促进服务型政府构建需理性吸纳顾客理念的研究具有一定价值意义。     

政府和市场在构建公民社会中的作用

市场经济以来的事实表明,经济社会的发展必须建立在社会稳定的基础上,稳定的社会秩序、和谐社会的建立则离不开每个域在法律分清权界基础上的自觉建构和相互合作,这种相互赋权和合作的国家与社会的关系模式必将推进我国全面建设小康社会和社会主义现代化建设的实现,为中国特色社会主义的＂和谐社会＂发展模式注入新的内涵。     

思维方式的演进与生态型政府的构建

人类历史上每一次科技革命或社会制度的变革,从某种意义上说,都与思维方式的更新密切相关。政府作为社会公共事务的管理者,其行政理念、思维方式直接影响着政府模式的选择和行政管理的效果。人类的思维方式从古代的整体性思维到近代的主客二元对立思维直至现代生态思维的嬗变,政府模式也相应经历了从古代朴素、低级的生态型政府到近代的反生态型政府直至现代的生态型政府模式的转变,这中间经历了一个否定之否定的历史发展进程。     

试述医疗合同立法的完善

医疗合同关系是一种不同于一般合同的特殊的民事法律关系,文章以民法的基本理论为依据,结合我国现实情况,力求通过对医疗合同的主体、成立、内容等问题进行研究,阐明其特殊性,为解决医患纠纷寻求理论依据,以服务于建设社会主义法治国家的需要。     

Internships and the State Government Human Resources Crisis

State governments face massive retirements over the next few years. Since internships have been a significant source of bright new blood, we examine what all fifty states are doing with internships. Some exemplary programs were found, but the typical state intern program serves only a few unpaid students, supervisors receive no special training, and no tracking is done to see whether interns stay in state service or what their contributions are. While many states blame stringencies, the budgets involved are comparatively modest and potential benefits significant. We propose an action agenda for state governments and the public administration community.
