法理的视角：性别对自然人的影响

性别是区分自然人的重要依据,不同的自然人由于性别的不同,在社会关系中的地位有所不同。自然人的性别影响着自然人的家庭生活、社会生活,尤其是自然人的活动空间、国籍、住所、职业等。性别也是一些犯罪的特定的构成要件。     

语言实施的性别围困——权力话语下的"第三性"

"第三性"是当今社会对女博士的代称。它是对追求独立,实现自我价值的高学历女性的一种排斥和异化现象在语言上的反映。女人往往被称作"第二性"或"他者,"女博士从女人这个群体中被排挤了出来,成为"他者中的他者"。这个二度他者化的过程体现了社会心理和文化通过大众话语来掌控社会的事实。福柯关于话语和权力的关系理论表明话语(语言)是众多的大众维护、重组社会秩序的有效机制,权力通过话语发挥作用,话语的流通又进一步加强了权力。"第三性"一词的出现和流传是男性强权统治受到挑战时的话语应对机制运作的结果。此外,语言本体论的观点表明语言不但反映世界,而且语言就是社会现实。所以,"第三性"这一语言形式直指女博士困窘的现状,它表明我们有赖于语言维护、打破、重建社会秩序,人类和语言共存。     

Generational Substance Abuse among Male Sexual Offenders and Paraphilics

This study examines three hypotheses: (1) there is an association of parental and offspring substance abuse for sex offenders and paraphilics; (2) there is a higher occurrence of substance abuse among the parents of sex offenders and paraphilics than seen in the general population; (3) substance abuse among the parents will be associated with a higher frequency of birth and developmental abnormalities, learning disabilities (LD), mental retardation, attertion deficit hyperactivity disorder (ADHD), and school learning problems (school dropouts, grade failures, and placement in special education) common in sex offenders and paraphilics. A sample of 1,012 male sex offenders and paraphilics were asked about substance abuse among their parents and about their own birth and developmental abnormalities and school learning problems. Three in five families had a parent who was a substance abuser and there was a significant concordance of parental and offspring substance abuse. Substance abusing parents more often than nonabusing parents had sons with developmental and learning problems on every measure examined. Results suggest that parental substance abuse appears to play a role in the neurodevelopment, associated learning problems, and substance abuse reported in studies of sex offenders and paraphilics and it should be explored as a possible factor in the genesis of sexual disorders.     

Gender Differences in Initiation of Negotiation: Does the Gender of the Negotiation Counterpart Matter?

In this study, we investigated if and how gender differences in the propensity to initiate a negotiation are affected by the gender of the counterpart in the negotiation. We enlisted 204 Swedish students to take part in an experiment in which they had to decide whether to initiate a negotiation for higher compensation. In line with previous research, we found that men were more likely than women to initiate a negotiation: 42 percent of the male and 28 percent of the female participants initiated a negotiation. The gender difference, however, was only large and statistically significant when the negotiation counterpart was a woman. With a female negotiation counterpart, women were less likely than men to initiate a negotiation by 24 percentage points, while with a male negotiation counterpart, the gender difference was only 5 percentage points and not statistically significant. This result suggests that the gender of the negotiation counterpart should be taken into consideration when analyzing gender differences in initiation of negotiation.

关于性别医疗变更行为的法律思考

随着社会经济和医疗技术的飞速发展,性别变更医疗行为一方面给予了个人选择自己性别的权利的可能,另一方面也给社会带来了诸如性别证明、婚姻、亲属关系、就业、社会福利等一系列法律问题。目前,我国法律对变性手术实施的对象、法律条件、法律程序等缺乏明确的法律规定,如何让“变性”、法律、社会三者相互协调,既保证公民选择自己性别的权利,又保障整个社会的协调发展以达到个人与社会的双赢,是一个值得研究的问题。我国可以借鉴在考察外国相关立法,从性别变更医疗行为的范围、条件和程序诸方面进行规范。     

Residential Concentrations of Rural Registered Sex Offenders

This research employs social disorganization theory to examine the residential locations of registered sex offenders in rural areas. Data was gathered on 728 non-incarcerated registered sex offenders (RSOs) in the Appalachia region of Eastern Kentucky (41 counties total). Census tract data was used to assess the degree of social disorganization of residential locations of RSOs and to compare census tracts with high concentrations of registered sex offenders to the counties in which RSOs reside, the nation as a whole, and census tracts with low concentrations of RSOs. Results show that although there are significant social disorganization indicators present, there are few relationships between RSO residence and increased levels of social disorganization.
