从菲律宾外国投资法看我国外资法律制度的完善

文章通过对菲律宾外国投资法的介绍,分析了中国目前外资法律制度中存在的缺陷,并在借鉴菲律宾外国外资立法经验的基础上,提出我国完善外资立法的建议。

社区矫正突出了社区在刑罚领域的地位和矫正工作的实际,仅将罪犯作为矫正对象的概念是狭义的;我国目前的矫正措施基本上是合理的;我国必须设立专门的矫正机构;将人格作为矫正的客体意味着对个人与社会关系的辩证认识。     

Robust Shoeprint Retrieval Method Based on Local‐to‐Global Feature Matching for Real Crime Scenes

In this study, an automatic and robust crime scene shoeprint retrieval method is proposed. As most shoeprints left at crime scenes are randomly partial and noisy, crime scene shoeprint retrieval is a challenging task. To handle partial, noisy shoeprint images, we employ denoising deep belief network (DBN) to extract local features and use spatial pyramid matching (SPM) to obtain a local‐to‐global matching score. In this study, 536 query shoeprint images from crime scenes and a large scale database containing 34,768 shoeprint images are used to evaluate the retrieval performance. Experimental results show that the proposed method outperforms other state‐of‐the‐art methods in terms of retrieval accuracy, feature dimension, and retrieval speed. The proposed method achieves a cumulative match score (CMS) of 65.67% at top 10 which is 5.60% higher than the second best performing method.     

Preparation of Tool Mark Standards with Jewelry Modeling Waxes

Abstract:  This paper presents how jewelry modeling waxes are used in the preparation of tool mark standards from exemplar tools. We have previously found that jewelry modeling waxes are ideal for preparing test tool marks from exemplar tools. In this study, simple methods and techniques are offered for the replication of accurate, highly detailed tool mark standards with jewelry modeling waxes. The techniques described here demonstrate the conditioning and proper use of jewelry modeling wax in the production of tool mark standards. The application of each test tool's working surface to a piece of the appropriate wax in a manner consistent with the tool's design is clearly illustrated. The resulting tool mark standards are exact, highly detailed, 1:1, negative impressions of the exemplar tool's working surface. These wax models have a long shelf life and are suitable for use in microscopic examination comparison of questioned and known tool marks.     

Fatal Accident Cause and Conclusion

Abstract:  The Toolmarks Laboratory prepared a report concerning a traffic accident involving the death of a road workman. The driver of the vehicle that hit the workman claimed that the wheels had failed to respond when turning left at a roundabout. A traffic investigator photographed the rack and pinion assembly of the steering system, which was subsequently removed and brought to the Toolmarks Laboratory. The rack and pinion assembly of the steering system was rebuilt, and examination showed that the system functioned properly. Specifically, the front wheels responded correctly to the steering input. Laboratory photographs of the steering system were taken in two different positions, from the same angles as the investigator's photographs at the scene of the accident. It was clear that the steering system had not been assembled properly in the garage.

环境问题已经成为全人类共同关心和关注的问题,环境问题的本质是人类本身的生存问题。保护环境的目的在于保证人类自身的生存和人类社会的可持续发展,为此,世界各国刑法均规定了环境犯罪,以回应人类保护环境的价值诉求。由于受传统刑法理论的影响,我国现行的环境犯罪立法,包括立法价值、立法模式、立法技术等等,还不能彰显我国刑法在保护环境方面的功能。文章以比较的方法探讨了我国环境犯罪立法模式的功能不足,以及我国环境犯罪立法模式的应然选择。
