评《罗马法原论》的学术特色

《罗马法原论》是周教授的心血力作,也是目前国内最为权威的罗马法专著。《原论》以传播罗马法为宗旨,专为中国人而作。其学术特色具体表现在三个方面。其一,经过细致的考订和分析,《原论》所译解之名词术语准确传神,并为学界普遍接受。其二,《原论》博观约取,在对材料的选择考订上,取材愈广,辨析愈精;在对罗马法原理的阐述上,则力求透彻明了,深入浅出。其三,《原论》秉承了周教授一贯坚持的求真务实的学风,勇于并且坚持学术批评,为罗马法的研究树立了典范。     

公民社会的兴起对政策制定的影响

改革开放以来,随着国家与社会关系的调整和社会主义市场经济体制的建立,中国公民社会开始兴起。公民越来越多地借助于各种民间组织进入公共政策制定过程,影响政府的政策导向。公民社会的兴起提升了公民的参与意识,扩大了公民参与政策的范围,促进了政府政策制定模式转换和多元互动政策主体的出现。同时,公民社会的兴起也加剧了政策制定过程中的利益博弈,给政府的政策合意带来困难。     

Religion,Conversion, and Rehabilitation

Rehabilitation and conversion within the penal context are deeply ambiguous concepts. This ambiguity stems in part from the fact that little consensus has been reached among scholars as to the meaning of the terms beyond their ability to foster adjustment to institutional rules and obedience to law. This paper argues that each concept receives greater clarity and practical significance when understood in terms of moral transformation. The article will utilize the methodological framework of social scientific studies to underscore a contention, most commonly found in theological literature that conversion, and a fortiori rehabilitation, signal a shift from a divided to a unified consciousness based upon the experience of unconditional acceptance and, ultimately, its bestowal upon others and upon all forms of life.     

作为“中介”的“复合平等”——沃尔泽对罗尔斯分配正义理论的批判及其限度

沃尔泽认为,罗尔斯通过＂原初状态设置＂所演绎出的＂正义二原则＂只是一种实现通常之＂简单平等＂的分配正义原则,无法解决由诸多领域所构成之社会的分配正义问题。因而基于对西方世界分配现状的观察及其人性观,沃尔泽提出了＂复合平等＂的分配正义理论。事实上,只有罗尔斯的＂正义二原则＂才能有效实现社会的分配正义。因此,沃尔泽的分配正义理论实际上只是深刻理解罗尔斯＂正义二原则＂的＂过渡理论＂或＂中介＂,而不是对后者的根本性超越。     

Gender and cultural citizenship among non-Jewish immigrants from the former Soviet Union in Israel

About 330,000 of partial Jews and gentiles have moved to Israel after 1990 under the Law of Return. The article is based on interviews with middle-aged gentile spouses of Jewish immigrants, aiming to capture their perspective on integration and citizenship in the new homeland where they are ethnic minority. Slavic wives of Jewish men manifested greater malleability and adopted new lifestyles more readily than did Slavic husbands of Jewish women, particularly in relation to Israeli holidays and domestic customs. Most women considered formal conversion as a way to symbolically join the Jewish people, while no men pondered over this path to full Israeli citizenship. Women's perceptions of the IDF and military service of their children were idealistic and patriotic, while men's perceptions were more critical and pragmatic. We conclude that women have a higher stake at joining the mainstream due to their family commitments and matrilineal transmission of Jewishness to children. Men's hegemony in the family and in the social hierarchy of citizenship attenuates their drive for cultural adaptation and enables rather critical stance toward Israeli society. Cultural politics of belonging, therefore, reflect the gendered norms of inclusion in the nation-state.     

简易程序中行政处罚决定的告知与送达

公安部《道路交通安全违法行为处理程序规定》规定：交通警察一人可以当场作出处罚决定,在当事人拒绝签字、拒绝签收的情况下,应当在处罚决定书上注明。这种＂注明＂是否等于告知、能否代替送达是一个未明确的问题,它在实践中会影响到执法和当事人的权利,以及公平正义的实现。     

Exploiting expressed sequence tag databases for the development and characterization of gene-derived simple sequence repeat markers in the opium poppy (Papaver somniferum L.) for forensic applications

Simple sequence repeat (SSR) markers in the opium poppy (Papaver somniferum L.) were identified from an expressed sequence tag (EST) database comprised of 20,340 sequences. In total, 2780 SSR-containing sequences were identified. The most frequent microsatellite had an AT/TA motif (37%). Twenty-two opium poppy EST-SSR markers were presently developed and polymorphisms of six markers (psom 2, 4, 12, 13, 17, and 22) were utilized in 135 individuals under narcotic control investigation. An average of three alleles per locus (range: 2-5 alleles) with a mean heterozygosity of 0.167 was detected. Six loci identified 29 unique profiles in 135 individuals. The EST-SSR markers exhibited small degrees of genetic differentiation (fixation index = 0.727, p < 0.001). Other variable markers will be needed to facilitate the forensic identification of the opium poppy for future cases. To determine the potential for cross-species amplification, six markers were tested in five Papaver genera species and two Eschscholzia genera. The psom 4 and psom 17 primer pair was transferable. This is the first study to report SSR markers of the opium poppy.     

电针胃俞募穴对单纯性肥胖大鼠下丘脑和血清神经肽Y的影响

目的 观察电针胃俞募穴对单纯性肥胖大鼠脂代谢及神经肽Y（neuropeptide Y,NPY）水平的影响。方法 选用清洁级SD雄性大鼠80只,随机选10只为空白组,采取普通饲料喂养,其余大鼠采用高脂饲料饲养。6周后,筛选40只单纯性肥胖大鼠,将其随机分为模型组、中脘组（电针中脘）、胃俞组（电针胃俞）、胃俞募穴组（电针中脘配胃俞）,持续电针3周。计算Lee指数,采用全自动生化分析仪检测血清三酰甘油（triglyceride,TG）、总胆固醇（total cholesterol,TC）和低密度脂蛋白胆固醇（low-density lipoprotein- cholesterol,LDL-C）水平,采用放射免疫法检测下丘脑和血清NPY含量。结果 模型组大鼠Lee指数,血清TG、TC、LDL-C水平,以及下丘脑和血清NPY含量均较空白组显著升高（P<0.01）。两因素析因设计的方差分析结果显示,针刺中脘和针刺胃俞对降低Lee指数,血清TG、TC、LDL-C水平,及下丘脑和血清NPY含量的主效应均具有统计学意义（P<0.01）;针刺中脘和针刺胃俞对降低Lee指数、血清TG及下丘脑和血清NPY的交互作用均具有统计学意义（P<0.05,或P<0.01）。结论 单独电针中脘和胃俞均具有显著的减肥降脂作用,其机制与降低下丘脑和血清NPY有关,俞募配穴对减肥及降低血清TG和下丘脑、血清NPY具有显著的协同作用。     

印俄高度军备依赖关系生成机制探究

依赖关系可以出现从轻微依赖、中度依赖到高度依赖等不同程度的情景，是否存在供求关系、是否涉及关键资源、能否承担转换成本是判断国家间依赖程度高低的三个标准。印度和俄罗斯之间的军备合作达到了一种高度依赖的关系，这种关系并不是自然产生的，而是伴随着俄罗斯作为资源供应国采取的主动锁定策略生成并得到强化。通过“展示—供应—刺激—捆绑”这一系列主动锁定策略，俄罗斯逐步强化了印度对其军备供应的高度依赖，也使其国防发展模式和作战理念深深烙上了俄罗斯的印记。在军备依赖的强化过程中，印俄关系得到积极巩固和深入发展，但印度的战略灵活性也同时受到了损害，使印度处于机会主义风险中。当前印俄军备贸易过程中的摩擦、国际军备出口市场竞争的加剧、美印军事关系的发展等因素都不同程度地影响着印俄锁定依赖的稳定性。
