试论我国经济犯罪中资格刑的配置与制度设计

随着社会主义市场经济体制的逐步建立与完善,目前我国的经济犯罪有多发趋势。经济犯罪一般具有变化性、复杂性、图利性的特征,而在市场经济条件下,经济犯罪除了具有上述特征以外,还体现出身份性、隐蔽性和严重的社会危害性等特征。由于经济犯罪具有上述特征,有针对性的增设新型资格刑,即禁止经济犯罪人从事一定的职业、行业或者商贸活动的资格,以遏制经济犯罪的多发趋势是必要的。

欧盟保险法的统一进程

在欧盟,以宪法性法律文件为基础,通过三代保险指令,也包括正在形成的第四代保险指令,欧盟的单一保险市场正在逐步形成.但相对于欧盟的保险监管制度来说,保险合同方面的调和则严重滞后.在这一领域,目前法律的发展仅局限于对保险合同冲突法的调整.这种状况导致了保险服务自由的目标难以实现.为了改变这种局面,欧盟的相关机构进行了有益的探索.其中的关键问题在于,欧盟应为各成员国提供统一的保单持有者的保护标准.顺应这一要求,最好的办法是颁布有关欧盟保险合同的实体法.我国作为世贸组织的一员和保险法尚不完善的国家,对于其中的动态应给予足够的关注.     

The policy response to COVID-19 pandemic and its impact on the equity market sentiment: The Indian experience

We examine the dynamics of the impact of the evolving policy response during the COVID-19 pandemic on the equity market sentiment in India. We operationalise our study by examining the India VIX, the fear gauge of the Indian equity market as an indicator for the market sentiment, and the country level Government Response Index of the Blavatnik School of Government, Oxford University as an indicator for the policy response. The relation is examined through the Markov-switching model using high-frequency daily data from January 30, 2020, to May 31, 2021. The evidence suggests that the policy response has a positive impact on the market sentiment when the market is fearful. Further, the evidence suggests that both the high-fear state and the low-fear state of the market sentiment given by the model are short-lived indicating heightened volatility and possible speculation during the ongoing pandemic in the Indian equity market.     

Policy Failure in the Triangle of Growth: Labour Market,Human Capital,and Innovation in Spain and Italy

This article focuses on the Italian and Spanish models of growth and analyses labour market, human capital and innovation policy reforms since the mid 1990s. The comparison with France and Germany shows the constraints that have hindered the rise of institutional complementarities and the competitiveness of the two Mediterranean countries already before the introd uction of the euro and the outbreak of the 2008 crisis. The analysis highlights both similarities and structural differences between Italy and Spain and demonstrates the long-term institutional conditions that explain why the economic breakdown has had such a deep impact on the two countries.     

欧共体法律一体化探析

欧共体法律一体化是对区域经济一体化的回应,是形成统一大市场的客观要求和必然结果,体现为成员国法律的协调和统一,其核心是共同法律意识(法律精神)的培植。文章分别从共同大市场的运作(尤其是商品、资本、人力和服务的跨国自由流通)和共同体制度建设两个方面论证了实现法律一体化的必要性及其意义。     

Networks and labor market entry – a historical perspective

This paper discusses how recruitment practices have changed over time. Networks and contacts are more important today for labor market entry than was the case in the latter half of the twentieth century. There may be two explanations for this: the short-run explanation and the long-run explanation. The short-run explanation derives from fluctuations in unemployment. When unemployment is high, competition for every vacancy is tougher and networks become more important for the job seeker. This has been the case in Sweden since 1991, when unemployment increased to new levels not experienced since the 1930s. In the long run, there has been a change in recruitment practices due to institutional change. A clear pattern is that the importance of social networks has increased, while the significance of public institutions (i.e. the Public Employment Service) has decreased.

国际市场准入的开放对于电子商务所带来的利益的实现至关重要,几乎各国政府都需要处理这一问题.WTO框架下电子商务的市场准入开放程度,部分取决于WTO成员对WTO规则遵守与否,部分取决于他们就具体的市场准入条件做出怎样的承诺.     

构建适应市场经济的招商引资运行机制

传统的招商引资运行机制是以政府为主导由政府部门一把抓的机制,在历史上发挥过积极作用,但在市场经济条件下,这一机制存在明显缺陷。适应市场经济要求,又具有中国特色的招商引资运行机制,从总体上讲就是“政策引导,企业招商,企业开发,部门服务”。其具体形式包括:市场化招商机制,完善的服务机制,便捷的信息传递机制和公正、高效的仲裁机制。
