协议管辖制度的进步与局限

本次《民事诉讼法》关于协议管辖制度的修改,统一了国内与涉外民事诉讼的适用标准,拓宽了其在国内民事诉讼中的适用范围,并将应诉管辖引入国内民事诉讼,这些调整体现出我国在管辖制度方面的进步。但在制度的细节上,例如合理限定协议管辖的范围、应诉管辖的要件,以及现有规则的法解释等方面,都需要做出进一步的理论探索和经验总结,以适应现代纠纷解决的需要。

大学生自杀行为的发生是多种因素共同作用的结果。其中既有具体生活事件方面的原因,又有个人心理原因,但究其根源还是在于社会因素的作用。导致大学生自杀的社会因素主要有社会转型、家庭环境、社会隔离、模仿和社会文化等。     

Disconnected relationship values and marriage policies in England

The article examines relationship values which influence the government’s marriage-related policies. It constructs a framework of core values as the ‘conception of the desirable’ to highlight a central problem for the government: there are many conflicting values that can be identified as potentially relevant. Traditional morality and equality highlight marriage as the ultimate goal for heterosexual and same-sex couples by emphasising responsibility, commitment and stability to encourage and strengthen couple relationships. The articulation of these values associated with celebrating marriage is evident in policies such as transferable tax allowances for married couples and couple relationship education. However, marriage is a public and a private institution which encompasses disconnected values. The article analyses the different values that policy-makers confront by examining evidence from interviews with stakeholders which suggests that marriage-related policies do not necessarily resonate with various actors’ understanding of relationship values. They compete with values such as individual autonomy, the desire for financial security and diverse relationships.     

网络案件预警响应模型研究

随着互联网的普及与发展，网络案件的出现也日益增多。网络案件的响应不仅需要公安机关的响应，还需要其他行政机关的响应；同时，各个响应单位都应具备全局决定局部，局部服务全局的大局意识，以保证更好地对网络案件进行响应，在响应过程中，首先确定案件的立案标准、管辖权等问题，随后对案件的性质进行分类。     

信息化环境下领导干部危机应对方式探析

在信息化环境下，各级领导干部的危机应对能力，正面临反应更快、决策更准及更善于和媒体与社会沟通等一系列严峻考验。但由于理念、意识、机构、人才、法制等原因，部分领导干部还存在传统管控思维未完全转变、不时消极被动、防抗不力，不善于与媒体沟通等问题。为此，信息化环境下领导干部危机应对能力，必须通过确立公仆意识、保持积极主动心态、熟练掌握网络技术、锤炼心理稳定性、加大培训力度、优化法制环境等途径加以提升。     

Socially desirable responding and psychometric assessment of dynamic risk in sexual offenders against children

Does socially desirable responding (SDR) represent a threat to the validity of dynamic risk assessment in sex offenders’ self-reports? We studied a sample of men (N?=?218) who completed a psychometric assessment battery while enrolled at Kia Marama, a prison-based treatment program for sexual offenders against children. SDR, as measured by the Marlowe-Crowne scale, was elevated compared to non-offender samples, increased from pre- to post-treatment, and was negatively correlated with dynamic risk (rs?=??.30 to ?.40), consistent with previous research. Measures of dynamic risk factors derived from the psychometric battery were correlated with sexual recidivism, but correlations were little changed when variance associated with SDR was removed using a regression procedure [Mills, J. F., &; Kroner, D. G. (2006). Impression management and self-report among violent offenders. Journal of Interpersonal Violence, 21(2), 178–192.]. These results suggest that there is a substantial component of the variance in psychometric self-reports of sexual offenders that is associated with SDR (approximately 10%), but that it does not compromise the predictive or construct validity of dynamic risk measures derived from these reports.     

Participation Income and the Provision of Socially Valuable Activities

In this article, I argue that a participatory income (PI)—the proposal originally presented by Anthony Atkinson in 1996—can potentially perform better than an unconditional basic income (UBI) in terms of addressing unmet social needs. I explain why we should expect that unmet social needs can be better alleviated by the recipients of a PI rather than by the voluntary actions of UBI recipients. In particular, the argument presented here seeks to develop a particularly forgotten point in the PI debate—namely, the importance of using income transfer programmes as a policy tool to motivate people to engage in socially valuable activities.     

合意管辖与应诉管辖之再探讨

合意管辖具有实体法律行为和诉讼行为的双重性质,对其分析需要从两个视角同时考察。而将应诉管辖理解为默示合意管辖并不妥当。就合意管辖和应诉管辖的基本要件而言,现行立法规定尚存在诸多不合理或有待澄清之处。合意管辖的效力在司法适用中产生的争议应当区分不同情形予以审查认定。     

公德缺失和公德重建的社会心理分析——北京市民社会公德调查的思考

文章在对北京市民的公德状况进行调查的基础上,对市民公德缺失的社会心理原因和社会公德重建的社会心理基础进行了分析,提出目前社会公德缺失的主要原因,同时指出传统文化中对个人修养的强调和现代公共精神的日益成长等因素是现阶段社会公德建立的社会心理基础,并对社会公德建设提出了相关建议。
