公民健康权利与义务立法研究——兼评《基本医疗卫生与健康促进法(草案)》第2章

综观世界各国的立法实践,公民健康权利与义务大致呈现出单独式、专章或专节式、分散式三种立法模式。在立法内容上各国更为侧重确立和保护公民健康权利,对公民健康义务的规定则相对粗疏简略,除医疗服务获得权、知情同意权、隐私权与尊重医务人员及他人的义务、支付医疗费用的义务等部分权利、义务类型没有较大争议之外,各国均保有较大的差异性。我国应当系统整理现有医疗卫生立法及其他相关法律文件,将公民健康权利与义务协调规定在未来的民法典和"基本医疗卫生与健康促进法"之中,同时借鉴国外的先进经验,增设投诉权、病历查阅权和复制权以及爱惜健康、支付医疗费用、遵守医疗机构规章制度等权利与义务,并对儿童等特殊群体提供特别保护。     

特殊动产物权变动的公示方法

关于船舶、航空器和机动车等特殊动产的物权变动,可以采取登记或者交付的公示方法。此类特殊动产的物权变动采登记对抗主义,并非意味着交付的效力优先于登记。相反,交付后如未经登记,不得对抗善意的登记权利人。在特殊动产的物权变动中,尤其是在特殊动产一物数卖的情况下,登记应当优先于交付。     

公立高校与教师的法律关系——以特别权力关系为视角

特别权力关系是行政法的一个重要理论,对此我国理论界已有广泛、深入的研究,但公立高校与教师之间法律关系的性质如何确定在理论上还存在一定的分歧,有观点认为二者是民事合同关系。本文试图从特别权力关系的角度来审视我国公立高校与教师之间的法律关系。     

Dynamic Attenuation: Terrorism,Transnational Crime and the Role of the US Army Special Forces

This article analyses the ability of the US Army Special Forces to combat illicit networks (criminal and terrorist) through ‘dynamic attenuation’. It is argued that a process of dynamic attenuation, where network ties and not the actors in the network are targeted, should replace the current US strategy of ‘killing or capturing’ criminal agents threatening US interests. By dynamically attenuating (not destroying) the ties between and among criminal actors and criminal organisations, the US can effectively reduce the capability of criminal organisations to operate and achieve their missions (profit and/or terror). This argument is substantiated by assessing the environments where criminal networks thrive, the characteristics of criminal networks, the utility of targeting networks instead of individual actors, and through a comparison of criminal organisations' and US Army Special Forces' strengths and weaknesses. This article concludes with implications and recommendations for US policy in the fight against criminal organisations.     

人格与权利能力的平等性辨析

大陆法系民法经历了一个由人格到权利能力再到人格和权利能力并存互用的发展过程。人格和权利能力也经历了一个由不平等到逐步趋于平等的发展过程。学术界有学者将权利能力区分为一般权利能力和特别权利能力,并据此认为权利能力具有不平等性。该观点没有看到权利能力与人格的历史继承性,也没有看到权利能力与人格在功能以及本质属性上具有同质性,更没有注意到权利能力的抽象性与权利的具体性的差别。在现代市民社会,我们应力倡:世界人民人权平等,人格平等,权利能力一律平等。     

The Burglar Alarm That Just Keeps Ringing: A Response to Zaller

American journalists filter the world of politics through a set of presuppositions about what politics is and should be. Listing seven presuppositions that undergird political reporting, this article illustrates the “Progressive Era” framework through which U.S. journalists understand politics. The article concludes by identifying several alternative visions of politics and suggests that in practice journalism is sometimes broader in its understanding of politics than a Progressive Era vision would anticipate.

刑事和解对刑罚功能发挥的影响一直是引人关注的话题,新（《刑事诉讼法》对于刑事和解程序的相关规定一定程度上缓解了两者之间的紧张关系,但是在剥夺犯罪人再犯能力、完善个别威慑实际效果、降低改造难度、提高一般鉴别等刑罚具体功能的发挥上,刑事和解的消极影响仍然存在,努力将这些消极影响控制在合理范围之内将是刑事和解实践中的重点工作。

撷取民建中央副主席辜胜阻到武汉做＂城中村＂改造工作的专题考察调研及协商座谈这一典型个案,基于中国特定的政治场境,按照协商民主（Consultative democracy）的内涵及外延,＂解剖麻雀＂,从下列五个维度及路向作出自己的解读：一是这次协商的主体,即谁来协商,谁主导、谁组织、谁参与了这场协商;二是这次协商的平台和场域,即是在哪里开展协商的;三是这次协商的内容,即协商的主题是什么,协商了哪些＂重大问题＂或＂实际问题＂;四是这次协商的程序性规范,即是怎样有序展开协商活动的;五是这次协商的目的,即协商的质量和成效如何,有什么特别值得称道的收获。

Abstract

The concept ‘connectivity’ is most widely used in communication technology, referring to the linkage between electronics, computers, computer systems and the people who use them, but it is also a heuristic concept with great utility in the broader discipline of Communication and beyond. This article traces the concept from its theoretical origins in information science to the core position that it holds in all traditions of the Communication discipline. It assesses the physiological, psychological and sociological dimensions of connectivity and considers the application of the concept as an instrument for understanding and resolving the problems, issues and opportunities of the world around us. The article ends with some insights into the practical utility of the concept in the spheres of social and institutional development, productivity, performance and the generation of competitive advantage.
