公民网络言论反腐功能研究

随着网络的逐步发展和积极应用,网络反腐在我国已渐成气候。公民通过网站互动、新闻跟帖、网络举报、论坛、博客、微博、民间反腐网站等各种言论平台在网络反腐中发挥着重要作用,但也存在网民言论非理性、网民言论代表性不足、网民意见权威性不够、网络管制法规不健全等问题。我们应该从加强网络立法、落实公民言论自由的宪法权利,加强网站行业自律、提高网民网络素养,加快制度建设、建立健全网络反腐言论处置机制,鼓励和支持民间反腐网站等方面协力促进网络反腐的发展,并把这一体制外反腐力量更好地纳入到整个反腐体系之中,使民间资源与官方资源形成良性互动,使公民网络言论反腐迈上制度化、规范化的轨道。     

Are Your Disputants Insecure and Does It Matter? Attachment and Disputants' Speech during Mediation

An exploratory qualitative study explored the effect of attachment styles on disputants' speech during real‐life mediations. Drawing on attachment theory, we classified disputants as secure or insecure individuals using a self‐report attachment‐style questionnaire. Subsequently, they entered their mediation sessions, where their entire speech was recorded. Qualitative analysis of their speech yielded consistent and sometimes striking differences that portrayed secure speech as remarkably more useful and enhancing toward resolution compared with insecure speech. The findings, presented with many examples, strongly indicate the relevance of attachment to the research of communication during mediation sessions. In this report, we also consider the practical implications of the association between attachment and disputants' behavior, emphasizing the role of mediators.     

POSTAL 2 plays in US court - Schwarzenegger v. Entertainment Merchants Association

In an unprecedented legal development, the case of violence in video games has now reached the highest American court. The US Supreme Court is set to decide whether states can restrict minors from buying violent video games in the case of Schwarzenegger v. Entertainment Merchants Association. The decision could have serious implications on the future of First Amendment rights and children’s ’welfare. To resolve Schwarzenegger, the Justices will need to decide how much First Amendment protection should be extended to violent video games and whether minors have a greater constitutional right to violence than they do to obscenity.

Delfi AS v Estonia: The Liability of Secondary Internet Publishers for Violation of Reputational Rights under the European Convention on Human Rights

In October 2013, the European Court of Human Rights in Delfi AS v Estonia upheld a decision of the Estonian Supreme Court to impose liability on the owners of an internet news portal for defamatory comments which had been posted on their website by anonymous third parties. This note suggests that the decision is important in the context of publications with a ‘public interest’ element to them, because it appears to afford more protection to the right to reputation (deriving from the Article 8 right to privacy) and less to freedom of expression than was formerly the case. It is further argued that the Court's emphasis on the positive obligation of states to protect this right to reputation may mean that the existing English law in this area, including, potentially section 5 of the Defamation Act 2013, is inconsistent with the ECHR jurisprudence.     

中国文化生态理念面向世界文化整合的话语权研究

文化已成为综合国力的重要组成部分和增强综合国力的重要力量,并日渐成为核心竞争力。中国的大国地位要求中国文化生态建设在世界文化体系建构过程中具有更多的话语权利。我们所主张的话语权应具有平等、共同发展的特点,才能找到适合自己情况的文化发展模式和具有自己特色的文化发展战略,从而探索出具有本民族特色的文化现代化建设道路来。     

基于语料库的“普通话”地域性言语识别技术

目的探究汉语＂普通话＂中的地域性差别,发现言语特征,找到从有限的以普通话发音的语音材料中提取出更多地域性特征的途径和方法,提高地域性言语识别技术水平,更有效地为案件分析定向服务。方法在建立较大规模的《面向案件言语识别应用的汉语＂普通话＂语料库》及查询检索系统的基础上,进行统计分析、归纳总结。结果人们说普通话时会在声母、韵母、声调、重音、儿化、轻声等语音方面和词汇、语法等方面不同程度地出现其母语方言的固有特点。我们可以采用＂以调值特征为中心,声韵特征相结合＂、＂利用各类特征的总和进行综合评断＂等方法进行识别。结论利用＂普通话＂语声进行言语人地域性识别是一种切实可行的技术方法。     

微博言论的自由与规制

微博是网络社会新兴的交际和信息集散的重要方式,一经出现,便得到广大网民的青睐。其价值在于它体现了公民言论自由的追求,成为公民自由表达的平台。作为一种新的言论载体,微博在言论自由的同时,又存在着危及隐私权的问题,有可能导致信息泛滥、谣言蜂起,有着负面的影响。在一个追求法治的国家里,言论自由必须依法实现,用法律来构筑言论自由的边界。因此,在保障微博言论自由的同时,又必须使其接受法律规制。     

案犯精心伪装,言语识别使凶手现形

在文件检验甚至各类刑事技术手段中,言语识别作为一门古老的技术手段,能够发现侦缉对象的行踪。该文就一个杀人案件的分析、研究,说明通过研究言语人的言语特点和规律,准确分析言语人的社会群体属性,可以为案件侦查准确提供侦查方向、范围,及早破案。     

论语言风格识别及其在刑事侦查中的应用

语言风格识别的对象是各种作为物证和书证的语言材料。它要求检材和样本须满足一定的数量要求,且反映出有价值的语言特征。语言风格识别对于刻画犯罪嫌疑人的特征,认定或否定犯罪嫌疑人以及并案侦查具有不可忽视的作用。
