新的历史条件下加强理想信念建设的几个问题

对马克思主义信仰,对社会主义和共产主义的坚定信念,是共产党员的政治灵魂.党员干部要做共产主义远大理想和中国特色社会主义共同理想的坚定信仰者和忠诚实践者.在新的历史条件下,广大党员干部的坚定的理想信念表现出新的特点,但也有少数人在理想信念上出现了严重问题.在深化改革开放过程中,在经济全球化的大背景下,要有针对性地做好党员干部的理想信念教育工作.     

刑事错案形成的心理原因

刑事错案的成因包括直接原因、环境原因和心理原因,其中心理原因(主要表现为包括"遂道视野"、"证实偏差"等在内的各种心理偏差)对错案的形成有更根本的影响。绝大多数直接原因,如刑讯逼供、隐瞒有利于犯罪嫌疑人、被告人的证据、忽视辩护律师的合理意见等等,都是各种心理偏差的外在表现。而绝大多数环境原因,如不合理的考核方式、司法经费不足等等,之所以会导致错案,主要是因为它们强化了这些心理偏差。根据这些心理偏差对错案形成的可能影响,可以在心理学层面总结出刑事错案的形成过程及规律,而我国近年来纠正的22起刑事错案可以为此提供验证。我国有必要完善当前的刑事司法体制,以减少这些心理偏差对办案人员的影响,进而更有效地防止错案的发生。     

Lifetime conviction risk—a synthetic cohort approach

How common are convictions? The stigma of a criminal record can have serious social and financial consequences for the individual. It is a fundamental question in relation to any policy how many people will be affected by it. For example, if it is desirable to make sentencing generally stricter, or restrict ex-offenders' employment opportunities, how many people will that apply to? Little is known about how many people acquire a criminal record over their life-course. In this paper, I apply life-table methods to a synthetic cohort to calculate the lifetime conviction risk. The findings show that a substantial proportion of the population will be convicted of a crime at some point. Not surprisingly, the figures for men are substantially higher than for women.     

Fatal Wounds Sustained from “Falling Bullets”: Maintaining a High Index of Suspicion in a Forensic Setting

Celebratory gunfire injuries from “falling bullets” occur when guns are fired into the air during celebrations without realizing that this can cause serious injuries or even fatalities. Fatal celebratory gunfire injury is an uncommonly reported event in the continental United States. Our electronic database was queried for homicides occurring within days of July 4th and December 31st over a 14‐year period. We describe two cases of fatal gunfire injury due to celebratory gunfire occurring during New Year's Eve in Southern Florida. The relevant literature is reviewed. These case reports illustrate that fatal gunfire injuries sustained from “falling bullets” may pose as an unexpected mimic to sudden natural deaths especially in patients with prior medical history. A high index of suspicion to recognize such injury is required particularly during holidays.     

Asymmetries in prior conviction reasoning: truth suppression effects in child protection contexts

Abstract

In three empirical studies we examined how people reason about prior convictions in child abuse cases. We tested whether the disclosure of similar prior convictions prompts a mental representation or an additive probative value (Criminal Justice Act, 2003). Asymmetrical use of similar priors were observed in three studies. A pilot study showed that disclosure of a second prior did not contribute a weight equivalent to that of the first disclosure. Study 1 showed jurors did not see left-handed evidence (i.e. matching victim bruising) as more indicative of guilt than right-handedness unless a prior conviction was present, and the presence of priors suppressed the generation of alternative possibilities indicative of innocence. Study 2 showed that disclosure did not decrease community ratings of re-offending propensity and dangerousness as much as a similar prior conviction increased them. We consider the results in the context of a new psychological theory of prior conviction bias and the consequences for the implementation of Section 100 of the Criminal Justice Act (2003).     

公安机关鉴定人员面临错鉴责任风险

错案时有发生,错案与错误的科学证据有着密切关系。在全面推进依法治国、建设社会主义法治国家的大背景下,公安部对《公安机关人民警察执法过错责任追究规定》做了修订,其中的内容涉及鉴定人员出具虚假、错误鉴定意见的法律责任。除了相关部门加大投入、提高鉴定人员的待遇之外,作者提出了5条建议:加强对鉴定人员的职业伦理教育;鉴定人员应当努力提升自身的业务水平;规范实验室管理,严格鉴定程序;做好送检的检材、样本等物证的交接与保管;增强鉴定文书书写制作意识,保存好鉴定档案。     

Extending the Study of Continuity and Change: Gender Differences in the Linkage Between Adolescent and Adult Offending

Recently, Paternoster etal. used data from the Cambridge Study in Delinquent Development, a longitudinal study of 411 South London boys mostly born in 1953, to investigate the linkage between adolescent and adult offending and found that variations in adult offending were consistent with a random process after conditioning on adolescent offending. In this paper, we test the robustness of this early study across data sources and genders. Here, we use data from the Dunedin New Zealand 1972 birth cohort study to replicate previous findings regarding stability and change in criminal offending between the adolescent and adult years. In particular, our interest centers on the stochastic properties of the adolescent and adult conviction distribution in the cohort and whether the structure of this distribution is similar for males and females. This replication and extension of prior work is especially important since criminologists have little understanding of the pattern of female adolescent offending or how the patterns are linked to adult offending for women. The analysis reveals that variation in adult offending after conditioning on adolescent offending is consistent with a random (Poisson) process. Furthermore, this pattern is evident for both the males and the females in the Dunedin New Zealand 1972 birth cohort.
