文章运用比较的方法 ,从人身伤害、财产损害以及精神损害的赔偿范围入手来探析中德过错责任的立法及适用 ,指出了我国立法上的不足之处 ,提出了一些完善立法的建议 ,以图为我国立法和司法提供一些有益的参考

Contracts, Investment Incentives and Efficiency in the Restructured Electricity Market

The paper highlights and analyzes the tension between designing power sale agreements that reduce uncertainty for the private investors and running the power systems as more efficiently as possible in the restructured electricity market. The features of such agreements are preliminary in resolving this tension and, therefore, in orienting the development of electricity markets restructuring towards a competitive direction. We define a theoretical contractual model, highlighting the tension between the two opposite directions: reducing uncertainty and risk in order to attract private investment and operating the power system efficiently. We apply the theoretical model for analysing the formal structure of a selected sample of power purchase agreements, really operating in the restructured electricity markets all over the world. We show how competitive contracting can increase efficiency pressures and, at the same time, increase investment risk. We then discuss some policy implications for the design of power purchase contracts in the restructured electricity market.

The ethics of promulgating principles of research ethics: the problem of diversion effects

There is an important distinction between ethical standards for the conduct of research with human subjects and the ethics of promulgating principles of research ethics. Those who promulgate ethical standards for the conduct of research have an ethical responsibility to consider the consequences to which those promulgations give rise. In particular, they must consider whether their promulgations will give researchers incentives not to conduct research or not to conduct research in locales in which participants would benefit from participation. I first show how such ‘diversion effects’ are possible and then examine four principles of research ethics in that light. I then consider several objections to the argument that those who promulgate principles of research ethics should consider diversion effects.     

The Wasteland in the City: on Concrete Garden from the Angle of Ecology

The novel Cement Garden written by Ian McEwan shows a kind of feature as wasteland in ecological criticism. From the perspective of natural ecology, the natural environment in the novel is very bad, which is mainly reflected in the remoteness of geographical location, and the filth and corruption of the living environment. From the perspective of social ecology, the relationship between the characters has been seriously distorted, mainly reflected in the loss of the bond of love. From the perspective of spiritual ecology, the characters in the novel have different neurological personalities, which lead to their inner imbalance.
