随着互联网民用化和商业化进程的不断发展,域名与商标权之间的冲突也愈演愈烈,目前国际上域名争议的解决途径主要有两种:一是通过民间专门争议解决机构司法外解决,一是司法解决。目前,我国对域名与商标权冲突的法律调整较之以前已有很大进步,但仍有需完善之处:对于域名与商标权产生冲突的源头,仍旧没有作出规定;调整域名纠纷中的法律效力的位阶较低;现有的法律法规对商标侵犯在先,域名权该如何处理没有提及。 相似文献

目的运用光学仪器研究内凹齿钥匙痕迹形态特征。方法制作内凹齿钥匙正常开锁和被钥匙机复制后的样本,用光学显微镜拍照固定痕迹特征。结果内凹齿钥匙开锁痕迹特征明显,且被钥匙机复制后能留下复制痕迹。结论通过检验内凹齿钥匙上的痕迹特征能确定钥匙是否被复制过。 相似文献

In child sexual exploitation offenses, the collected evidence images often show the skin of nonfacial body parts of the criminals and victims. For identification in this scenario, “relatively permanent pigmented or vascular skin marks,” abbreviated as RPPVSM, were recently introduced as the basis for a novel biometric trait. This pilot study evaluated the interexaminer variability of RPPVSM identification. Four dermatology physicians were recruited to examine RPPVSM from 75 skin images collected from a total of 51 Caucasian and Asian subjects. The images were separated into 50 reference (“suspect”) images and 25 evaluation (“evidence”) images. The examiners were asked to perform identification by annotating RPPVSM in each of the 25 evaluation images and matching them with the reference images. The rate of misidentification was 0% while the mean rate at which examiners failed to find a match was 6%, indicating the potential of dermatology physicians performing the role of RPPVSM examiners. 相似文献

目的探讨电流斑皮肤金属化的机理、检材提取处理和扫描电镜/能谱仪检验规范化方法,对检验结果进行分析和价值判断。方法用扫描电镜/能谱检验,采用低倍大窗口覆盖损伤区域采集平均元素能谱图,并在可能的金属元素富集区域寻找球形金属颗粒。结果扫描电镜下可观察到散在的孔穴、细胞碎屑、龟裂、裂隙等特征,有些电流斑可检出金属元素,其中部分电流斑可发现球形金属颗粒。结论采用规范化的检材提取、处理和检验方法可消除随意性方法造成错检的可能。电流斑皮肤上异常含量的金属附着可支持病理检验符合电流斑表现的结论,同时也为电击导体的推断和金属元素成分比对提供依据。球形金属颗粒的发现揭示存在电弧高温的可能性极大,可强力支持病理检验符合电流斑表现的结论。 相似文献

This study introduces a tool mark analysis approach based upon 3D scans of screwdriver tip and marked plate surfaces at the micrometer scale from an optical microscope. An open‐source 3D graphics software package is utilized to simulate the marking process as the projection of the tip's geometry in the direction of tool travel. The edge of this projection becomes a virtual tool mark that is compared to cross‐sections of the marked plate geometry using the statistical likelihood algorithm introduced by Chumbley et al. In a study with both sides of six screwdriver tips and 34 corresponding marks, the method distinguished known matches from known nonmatches with zero false‐positive matches and two false‐negative matches. For matches, it could predict the correct marking angle within ±5–10°. Individual comparisons could be made in seconds on a desktop computer, suggesting that the method could save time for examiners. 相似文献

Recent challenges have brought the discipline of firearms and tool mark identification to the forefront in recent court cases. This article reviews those challenges and offers substantial support for the scientific foundations of the firearms and tool mark identification discipline. A careful review of the available literature has revealed that firearms and tool mark identification is rooted in firm scientific foundations, critically studied according to the precepts of the scientific method culminating in the Association of Firearms and Toolmark Examiners' Theory of Identification. Firearms and tool mark identification has been validated in a manner appropriate for evidence of the kind to be expected in firearms and tool mark examinations. Proficiency tests and error rates have been studied and can provide consumers of the disciple with a useful guide as to the frequency with which misidentifications are reported in the community using appropriate methodologies and controls. As a result, the primary issues in recent challenges do not invalidate the firearms and tool mark discipline as a science nor should it detract it from its admissibility in a court of law. 相似文献

Stamps and stamp impressions examinations are based on matching defects and design details on the questioned and control samples. These examinations are routinely carried out by document examiners around the world. International proficiency tests for questioned documents examination have been available for decades while similar programs specifically focusing on stamp impressions examination are rare. This study reported a recent proficiency testing program on stamp impressions examination organized by an accredited provider in accordance with ISO/IEC 17043 requirements. Twenty‐four forensic laboratories registered for the program. Apart from giving details on the design and operation of the program, this study also aimed to provide the limitations and difficulties encountered in sample preparations, homogeneity, and stability tests of the testing materials. Various comments and feedbacks received from the participants, particularly in respect of examination approaches, challenges faced by the participants in forming conclusions and their suggestions for further improvement would be evaluated. 相似文献
