贝卡里亚在社会契约论基础上第一次提出了无罪推定原则,其主旨在于反对封建刑事诉讼制度中对被告人的刑讯———这一合法暴行。随着人类社会民主、法治进程的发展,无罪推定的内涵在不断拓展。无罪推定原则为我们提供了研究刑事诉讼制度的宝贵路径,即应如何把握刑事诉讼中国家权力与公民权利的结构性关系。现代刑事诉讼中国家权力应遵循的“哲学”是:国家权力的谦抑性、以权力制约权力、以权利制约权力及国家机关对权利主体的诉讼关照。无罪推定的宪法化与国际化趋势,进一步说明了这一原则在现代刑事诉讼中不可动摇的核心地位。 相似文献

The Mexican Constitution, in the Poder Legislativo, grants state legislatures the authority to introduce legislation (iniciativas de ley) in the federal congress. In this paper the authors examine this powerful mechanism through which the Mexican state legislatures can directly influence policymaking at the federal level. Using a new data set of state-led initiatives, this work: describes the frequency with which iniciativas are introduced; describes the substance, timing, and final disposition of these state-led initiatives; and explains which factors affect the probability of presenting a state-led initiative. The authors find that party competition and partisan divisions at the state and federal levels play a significant role in the use of iniciativas de los congresos estatales. The authors’ study of this peculiar authority granted to the Mexican states contributes to the rich discussion of the changing role of the states in the era of Mexico’s nuevo federalismo. 相似文献

Research on autocracies has gained new momentum in the last decade. One element of this research is the observation that some autocracies are characterised by structural conditions that are normally conducive for democracy. These ‘anomalous autocracies’ have high levels of socioeconomic development and democratic neighbour countries. The study of these cases might expose factors that are decisive for autocratic stability and studying them might give us a better understanding of barriers towards democratisation. This paper contributes to the growing literature on autocracies by mapping anomalous autocracies during the third wave of democratisation, thereby paving the way for systematic case selection in future studies. A large-N analysis of 159 cases (1975–2008) identifies Belarus, Chile, China, Cuba, Morocco, North Korea, Peru, Singapore, Swaziland, Togo and Zimbabwe. In a second step, the paper lays out a theoretical framework that centres on actors and institutions. Rulers must establish elite–elite and elite–mass interaction, and this papers argues that they can do so through quasi-compliance of elites and the masses based on traditional institutions woven into a dominant party. The paper uses the framework to tentatively examine the resilience of authoritarian rule in Swaziland and Morocco, two most-different anomalous cases. In both cases, an elaborate traditional institution has co-opted government, business and rural elites and coordinated interaction within elite circles and with the masses, in turn enabling the remarkable regime resilience. 相似文献

叶利钦执政早期,国务委员会充分发挥了协调整合行政权力的功能,使俄国家权力结构避免了宪制改革后的严重混乱失衡.1993年《俄罗斯联邦宪法》颁布后,俄罗斯的国家权力结构趋于多元化,国务委员会既无法解决中央层面的总统与立法机关的结构矛盾,又无法解决源自地方分裂主义的"央地"权力结构松散,因而归于沉寂.2000年普京开始执政后重设国务委员会.尤其在2004年"别斯兰事件"发生后,俄罗斯的国家权力结构再度集中,系统性压力激增,国务委员会的作用不断被强化,国务委员会的事务性工作人员得到扩充,工作机制和议事规则得到进一步规范.2008—2012年,国务委员会成为紧密联系"央地"的关键纽带,在一定程度上,维系了国家政治局势的稳定发展.2012年,在普京第三任期,其成功地协调了因"统一俄罗斯"党崛起而引起的联邦中央权力结构张力,缓解了央地行政层面的权力结构矛盾.2020年修宪后,国务委员会的作用向协助总统整合"全联邦"国家权力的方向转变.同时,"国务委员会"获得宪法地位,成为宪法性权力机关. 相似文献

The United States is experiencing growing impacts of climate change but currently receives a limited policy response from its national leadership. Within this policy void, many state governments are stepping up and taking action on adaptation planning. Yet we know little about why some states adopt State Adaptation Plans (SAPs), while others do not. This article investigates factors that predict the emergence of SAPs, both in terms of policy adoption and policy intensity (goal ambitiousness). Applying the diffusion of innovation theory, I consider the relative influence of internal state characteristics, regional pressures, and test for conditional effects between government ideologies and severity of the problem. The results show interesting differences between predictors that influence policy adoption and ambitiousness. States are more motivated to adopt a policy when faced with greater climate vulnerability, have more liberal citizenry, and where governments have crossed policy hurdles by previously passing mitigation plans. The intensity of policies and goal setting, moreover, is more likely to be driven by interest group politics and diffuse through policy learning or sharing information among neighboring states in Environmental Protection Agency regions. These findings support an emerging scholarship that uses more complex dependent variables in policy analysis. These variables have the potential to differentiate symbolic from substantive policies and capture finer information about predictors of importance. 相似文献

In this article, I examine some of the interactions between the crisis in Darfur and Chad through its increasingly complicated ethnic threads and explain how Chad slid back into authoritarianism in 2004. Factionalism broke down the mesh of ethnic politics into personalised rule and allegiances. The international response to the crisis in Darfur allowed the Chadian leadership to reinforce its position in the country. Ever since, a precarious equilibrium set in. Déby has become the longest-serving president in the history of modern Chad. Previously weakened by interfactional agreements and oil wealth expectations and then by the crisis in Darfur, the regime re-established internal and external means for preserving the status quo. The huge quantitative literature on postwar social spending almost entirely neglected war as a possible explanatory factor of social spending dynamics. Given the mass carnage and the enormous social needs caused by the Second World War, this is quite astonishing. This article examines for the first time, whether, and in what ways, the Second World War affected cross‐national differences in public social spending of 18 Western welfare states over the course of the Golden Age. Using panel regressions, it is found that the war strongly affected social spending until the late 1960s. The evidence demonstrates that the Second World War is not simply a temporal watershed structuring different phases of welfare state development, but rather a crucial factor for understanding cross‐national differences in welfare efforts and social expenditure dynamics in the postwar period. 相似文献

Legitimacy is essential to state-building after conflict. Yet, the prescribed path to gaining legitimacy is often a narrow one that borrows heavily from the experiences of Western states. Elections are prescribed as an essential first step on the logic that this means gaining process legitimacy can rebuild a social contract between citizens and the state, a social contract that is rooted in democratic norms and values. This article proposes an alternative path, one that emphasises the critical role of performance legitimacy and its non-exclusive nature. Performance legitimacy is granted when citizens perceive that some or all of their basic needs are being met. The article offers a new analytical framework for understanding a state’s potential source of performance legitimacy, how non-state actors may vie with the state to seize this form of legitimacy, and what consequences this has for processes of state institution-building after conflict. In this respect, this article seeks to reorient theory and practice to a broader view of legitimacy and its critical role in post-conflict state-building. 相似文献
