Recently published works, such Elaine Scarry's On Beauty and Being Just, have suggested the natural confederacy of the sensory appreciation of beauty and the achievement of social justice. Scarry
(amongst others) has proposed that the opiated moment in which one is arrested by beauty's spell results in a ‘radical decentrification’,
where under they who behold beauty are awakened to alterity and, consequentially, encouraged to realize an ethical agenda
based upon just (sic) relations between people. The present article refutes the adequacy of the beauty - ethics - justice
triptych and, instead, proposes that the entire variegated aesthetic quantum operates as the medium through which recognition
of (in)justice reminds us of our responsibility to the other. As essentially inarticulate concepts, justice and responsibility
are capable of ‘speaking’ to us through the channel of the aesthetic. The aesthetic is the plane of dialogue on which our
felt appreciation of (in)justice prompts us to responsibility.

This paper investigates why the effectiveness of works councils varies across firms. Drawing on a large body of literature on justice in organizations, and on the basis of the premise of methodological individualism, we present the groundwork for a justice-based theory of workplace codetermination. The theory focuses on workers' attitudes toward justice in organizations, the structural reasons behind these attitudes, and their consequences for the effectiveness of codetermination. Results from a qualitative employee survey in four German firms provide first empirical support for the theory presented. 相似文献

The ombudsman institution, in both the public and private sectors, is increasingly identified with the ethos of consumerism and the protection of consumer rights. The current trend is exemplified and reinforced by the EU ADR Directive and by the government response to a recent inquiry into complaints conducted by the Public Administration Select Committee. This article argues that the dominant consumerist ethos diminishes the ability of the ombudsman institution to fulfil its potential. If the ombudsman institution, in particular as manifest in the office of the UK Parliamentary Ombudsman, is to serve the public interest, it must instead promote human rights principles and constitutional morality, adopt a process that is marked by public reasoning and participation and seek by a whole‐system approach to realise a vision that is integrated and truly democratic. 相似文献

I raise three objections to Philip Pettit's republican account of justice: (a) that it fails to account adequately for the role of certain values such as substantive fairness; (b) that it represents an uncomfortable hybrid of egalitarianism and sufficientarianism; and (c) that it fails Pettit’s own ‘eyeball test’. While restorative justice has been the topic of much research, a specific type of program included in restorative justice, Impact of Crime (IOC) on Victims programs, has not been widely studied or assessed for effectiveness. This study examines IOC on Victims Curriculum Development Programs. Offenders from programs in California, Ohio, Tennessee, and Virginia were participants in this research. A four-state evaluation methodology was developed in order to assess the effectiveness of these programs in educating offenders about victims’ right and victim facts, as well as increasing their sensitivity to victims’ difficulties. The findings in this evaluation lend support to previous studies, indicating efficacy for IOC programs. Suggestions for future research are briefly discussed. 相似文献
