毒品案件侦查模拟实战教学研究

我们在《毒品案件侦查模拟、实战教学》的课题研究中 ,对学校实施的模拟教学、实战教学、案例教学、讨论、讲座等多种方式进行了跟踪调查 ,分别对毒品案件侦查中的“公开查辑、控制下交付、徒步跟踪、搜查、辨认”等实践性极强的内容作了深入研究和新的尝试。在我们的课题研究中 ,解决了一些问题 ,也发现了不少新问题。     

就两起侦审失败的案例谈刑侦工作的新思路

以现代高科技为手段 ,加强微量物证的收集 ,大力扩充刑事技术认定犯罪的范围 ;加大第一次讯问力度 ,运用多种方法固定口供 ,使作案人无翻供可能 ;提高侦审中的证据意识和庭审意识 ,建立确凿有力的证据链条 ,是克服侦审失败的有效做法     

侵权行为中的连带责任反思

共同侵权行为产生连带责任 ,其基础在于共同过错和共同行为的结合。有共同过错但无共同行为的情况不承担连带责任。连带责任和既无共同过错又无共同行为的垫付责任、补充责任、转承责任也不相同。在判决加害人承担连带责任时 ,在判决中确定各加害人的份额是合理而实际的做法     

抢夺案件的特点及讯问对策

日益增多的抢夺犯罪严重影响了人民群众的安全感,加强对抢夺案件犯罪嫌疑人的讯问,深挖犯罪,遏止抢夺犯罪的上升势头是公安机关的任务之一。讯问抢夺犯罪嫌疑人应当做到:精心准备,巧使证据,因人施教,情感感化,利用矛盾,分化瓦解等。

人们对侦查终结的认识存在偏颇,我们应对侦查终结和基本条件做科学界定,建议完善侦查终结立法。     

A review of the analysis of vegetable oil residues from fire debris samples: analytical scheme, interpretation of the results, and future needs

This paper reviews the literature on the analysis of vegetable (and animal) oil residues from fire debris samples. The examination sequence starts with the solvent extraction of the residues from the substrate. The extract is then prepared for instrumental analysis by derivatizing fatty acids (FAs) into fatty acid methyl esters. The analysis is then carried out by gas chromatography or gas chromatography-mass spectrometry. The interpretation of the results is a difficult operation seriously limited by a lack of research on the subject. The present data analysis scheme utilizes FA ratios to determine the presence of vegetable oils and their propensity to self-heat and possibly, to spontaneously ignite. Preliminary work has demonstrated that it is possible to detect chemical compounds specific to an oil that underwent spontaneous ignition. Guidelines to conduct future research in the analysis of vegetable oil residues from fire debris samples are also presented.

“仲裁员责任制度”的构建是现代仲裁制度发展过程中一个不可或缺的问题。本文将仲裁性质的基本理论作为确定仲裁员责任制度的出发点,通过对仲裁员责任的性质、豁免以及其与仲裁机构的责任分配的分析,试图在阐明其必要性的基础上,结合我国之现状,对仲裁员责任制度加以初步地剖析与框架的构建。     

"侦查讯问难"的成因与对策新探

"侦查讯问难"是长期困扰侦查人员的最大难题之一。形成讯问难的客现原因主要有:审查难;犯罪嫌疑人本人方面的原因;破案的证据基础不够扎实;犯罪嫌疑人不相信"坦白从宽、抗拒从严"的政策;与讨论中的保障人权立法相配套的法律规定缺失等。形成讯问难的主观原因有:观念落后;侦讯人员的整体素质和能力不适应;讯问策略、方法运用不当等。应当采取的对策有:转变观念;提高整体素质和攻坚能力;转变侦查模式,广泛收集证据;加强审查性讯问,排除无辜;扩大传统讯问突破口的范围;制定有效的讯问策略及方法;建立配套的法律和制度。     

计算机网络犯罪的侦查与防控探析

信息技术的广泛应用,推动着社会的发展,人类的进步。然而,利用计算机网络犯罪的现象也相伴而生。近年来,各类重特大案件中涉及到计算机网络也越来越多,如何遏制利用计算机网络犯罪,已是世界各国共同面临的新的突出问题。公安机关计算机网络犯罪侦查部门和相关领域的专家、学者也都在着力于研究网络犯罪的侦查措施和如何防控。     

A Retrospective Analysis of Repeated Incarceration Using a National Sample: What Makes Female Inmates Different From Male Inmates?

As a consequence of the War on Drugs, many women experience repeated incarceration. Extant research on habitual offending has mostly focused on male offenders. Drawing upon research on female and male offenders’ recidivism, traditional theories of female criminality and the premises of GST, social control, and differential association theories, we constructed an integrated model to examine risk factors for repeated incarcerations among male and female adult offenders. We used data from the Survey of Inmates in State Correctional Facilities. Our analysis revealed that, similarly to male offenders, female offenders’ repeated incarcerations were statistically associated with drug abuse, exposure to family members’ and friends’ drug addiction, parental incarceration, and unemployment.
