司法会计应为强化法律监督提供技术保障——暨谈对检察机关司法会计可持续发展

从科学发展观的角度审视,仅满足或停留于审计查账,是阻碍检察机关司法会计发展的主要瓶颈。我国司法会计的发展方向是以鉴定为主导,为诉讼提供有别于审计的涉案会计事实证明,我国诉讼证明制度发展的趋势是对涉案会计事实证明的要求日益严格。检察机关强化法律监督,必然要求涉案会计事实证明能够进一步体现严格的执法精神。检察机关司法会计全面协调可持续发展,更好地为强化法律监督提供技术保障,就必须遵循适应我国司法会计的发展方向、诉讼证明制度的发展趋势和强化法律监督要求等三项主要原则。为此,应当加快以鉴定为主的理论研究和业务规范,建立推进理论研究和业务规范及人才培养的机制。     

国际民商事交往中不当得利之债法律适用问题研究

由于世界各国关于不当得利的法律制度不尽相同,国际民商事交往中不当得利的法律冲突问题日益突出。为保证支配不当得利之债的准据法与当事人的意愿相一致或有最密切的联系,并最大限度地减小因识别或定性不同而带来的难题,不当得利准据法应依序设计为：不当得利起因于合同时,适用该合同的准据法;起因于其他法律关系时,适用调整该法律关系的法律;起因于不动产交易时,适用不动产所在地法;在其他情况下产生,则其准据法为利益发生地所在国的法律。     

社会系统理论视角下的合同制度

卢曼的社会系统论是对现代社会进行分析的理论产物,其理论根源是自然科学系统论。而作为卢曼社会系统理论核心的自我生产与自我参照概念,在合同制度中有着明显的体现。从系统的开放性与封闭性两个方面,以系统论的角度分析合同制度系统中的两个制度。     

Unpacking the politics of legislative debates

Legislative debates are a thriving field in comparative politics. They make representation work by offering legislators the opportunity to take the floor and represent their constituents. In this paper, we review the key theoretical concepts and empirical findings in a maturing field. We begin by addressing what legislative debates are and why we should study them to learn about inter- and intra-party politics. Next, we look at the contributions springing from Proksch and Slapin's ground-breaking model. In so doing, our review suggests that recent work extends the original model to include further dimensions of legislative debates. Third, we examine the role of legislative debates as mechanisms of representation, focusing on gender. Four, we examine the challenges of the comparative analysis of legislative debates. Finally, we map the road ahead by discussing four avenues of future research and some key questions that remain unanswered.     

宁夏农业发展中的金融支持问题研究

农业发展离不开金融的支持。从1993年至2003年10年间金融支持农业的基本情况可以看出,金融信贷与宁夏农业之间保持着高度的相关性。但是,金融机构提供的金融服务与农业对金融的需求相比还有很大差距。因此,应进一步加大金融支农的力度。     

The legislative consequences of Mexico’s mixed-member electoral system, 2000–2009

The emergence of mixed-member electoral systems across the globe has been an attempt to balance local representation through single-member districts (SMD) with programmatic representation through proportional representation lists (PR). However, there are several competing theoretical interpretations for the consequences of mixed systems on legislative bodies. Through a study of the Mexican Chamber of Deputies, I test several empirical implications of these competing theories by examining the impact of the electoral system on party discipline, participation, and legislative organization. I find little convincing evidence of differences between legislators elected through PR and those elected through SMD in their levels of party discipline, but I do find that PR legislators participate in a manner theoretically consistent with their mode of election. I also find that PR legislators have disproportionate control over key leadership positions. I suggest the primary reasons for these findings is due to differing methods of candidate selection and restricted use of dual candidacy.     

论中国民法典婚姻家庭编的立法理念与制度新规

《民法典》婚姻家庭编的编纂,根据加强国家对婚姻家庭的保护、倡导重视家庭文明建设、尊重婚姻家庭当事人的意思自治、注重夫妻婚姻家庭地位的平等、注重儿童最大利益原则的贯彻、注意保护婚姻家庭弱者的权益等立法理念,新增或修改补充了24项制度或规则,主要包括:在"一般规定"章中,新增婚姻家庭受国家保护原则,增设婚姻家庭文明建设的倡导性规定,确立最有利于被收养人原则,界定亲属的种类、近亲属和家庭成员的范围;在"结婚"章中,减少禁止结婚和无效婚姻的法定事由,修改补充可撤销婚姻制度,新增重大疾病的如实告知义务、婚姻无效或被撤销无过错方的损害赔偿请求权;在"家庭关系"章中,新增夫妻家事代理权及其限制规则、夫妻共同债务认定规则、婚内析产规则、亲子关系的确认与否认之诉规则;在"离婚"章中,新增离婚冷静期、婚姻关系解除的时间,补充诉讼离婚准予离婚的法定事由、离婚时处理子女抚养问题规则、离婚夫妻共同财产分割原则,修改离婚经济补偿、离婚经济帮助的适用条件,增加离婚损害赔偿法定事由的兜底条款;在"收养"章中,放宽被收养人的年龄和收养子女的人数限制,修改收养人的条件,增加收养评估规则等。     

闭路电视监控器与大型公共交通系统反恐问题研究

伦敦地铁爆炸事件、西班牙马德里火车站爆炸事件等一系列袭击公共交通系统的恐怖事件,使人们越来越关注大型公共交通系统的安全和防范问题。大型公共交通系统由于流量大,无法运用航空系统的安全检查模式。在大型公共交通系统安装闭路监控器,恰恰可以在不影响这些大流量公共交通工具运行速度和效率的情况下,有效地起到安全防范的作用。英国和美国在大型公共交通系统安装闭路电视监控器的经验和模式,可以为我国大型公共交通系统的安全防范提供借鉴和参考。     

Deliberative citizenship: a critical reappraisal

ABSTRACT

The study of citizenship as a political or moral ideal involves identifying core commitments and capabilities, the cultivation and exercise of which is often presented as a condition of being a ‘good’ citizen. Deliberative democracy was, at least until recently, associated with a conception of citizenship that endorses those qualities that equip us for a certain kind of respectful and reflective dialogue. This article reappraises this conception in light of the so-called ‘systemic turn’ within deliberative theory. It shows how systems thinking has displaced the traditional conception of deliberative citizenship, but that theorists have so far not elaborated a satisfactory replacement. A pluralist model is thus proposed, which casts light on the diverse qualities that a range of actors in a deliberative system might require. The resulting argument is not merely of interest to deliberative theorists, but to all who are concerned with the ethics of citizenship. The main reason is that it displaces the entrenched notion of a ‘good citizen’, in favour of the more heterogenous ideal of a ‘good citizenry’.     

Spiritual Support： Media＇s Responsibility in an Aging Society Case Study of＂News Decoded＂

After decades of rapid economic growth, China has been increasingly confronted with the aging society issue. The unique one-child policy and unbalanced development between the urban and the rural have brought drastic changes in elder care. The lack of elder care professionals and the deceased-single-child families have attracted public attention through media reports. Increasing concerns of elderly emotional care are considered as a good sign for Chinese society. To treat elders well is the new goal to achieve of high quality life. Nevertheless, the improvement of qualification of media reports has been limited by many factors, such as the incapability to resolve complex issues, the lack of applicability of recommendations, and the short of professional reporters. Governments and media need to work together to turn the slogan of respecting elders into actions. Journalists should learn experience from their foreign peers and deliver the new approaches and ideas of respecting elders to the entire society, to enhance the quality of lives of elders, and to create a better public opinion environment. High-quality news coverage will play an important role in the improvement of quality of elders＇ lives.
