The concept of security has shifted from territorial integrity to human security and, after 9/11, to pre-emptive security. Based on the massive implementation of surveillance-oriented security technologies (SOSTs), pre-emptive security emphasizes anticipation of threats and risk management. While liberty and security get framed as standing in a trade-off, SOSTs are massively deployed to increase security. Due to the mutually constitutive relationship between SOSTs and pre-emptive security, security gets framed as a function of surveillance, forcing increasingly monitored citizens to exchange liberty for security. In contrast, a systemic approach to security may enable security policies pursuing liberty and security.  相似文献

在引入三阶层体系的背景之下,学界对我国《刑法》第14条中犯罪故意的体系性地位产生了诸多争议。在犯罪论体系的发展过程中,随着不法的主观化和罪责的客观化、规范化,心理性故意确立了作为主观构成要件的地位,而罪责故意与违法性认识(不法意识)则留在罪责层面,成为罪责的核心要素。无论是以不法论的基础还是从我国实定法的角度来看,心理性故意均应归属于构成要件而非罪责;在承认故意的双重地位的前提下,对容许性构成要件错误采取"法律效果转用的罪责理论"是迄今为止最为妥当的见解;关于故意与违法性认识(不法意识)的关系,我国《刑法》采取的是罪责理论而非故意理论。在三阶层体系之下,我国《刑法》第14条的犯罪故意应当区分心理性故意、罪责故意与违法性认识(不法意识),其中,心理性故意应当归属于构成要件,而罪责故意与违法性认识(不法意识)则归属于罪责。  相似文献

For more than 30 years, significant research in the United States has found that racial and ethnic minorities suffer disproportionately from nearness to environmental disamenities compared with white non-Hispanics and that these results persist even controlling for poverty and “which came first,” the minorities or the disamenities. The engrained discriminatory findings of this environmental justice (EJ) research have led some to argue that we observe “systemic racism,” built into our social systems in ways that may be difficult to perceive. Yet, within the history of the United States, racial and ethnic minorities are not the only groups that have been systematically discriminated against; various religious groups also have histories of discrimination. Here we consider whether, holding constant race and ethnicity, some religious groups may also suffer from “EJ syndrome.” Since the US Census does not collect data on religion, to measure the presence of some religious groups that may be discriminated against, we use an original dataset on the presence of Jewish, Muslim, Church of Jesus Christ of Latter-day Saints (LDS, aka Mormon), and Roman Catholic houses of worship within California's Census tracts. Our results indicate that even controlling for race/ethnicity and income, the presence of Jewish or Muslim houses of worship in a California Census tract increases the likelihood of environmental burden as measured by the CalEnviroScreen 3.0 index of pollution and community vulnerability.  相似文献

由于劳动法律制度存在适用范围偏窄、劳动权益保护之规定过于简单、用人单位法律责任不明确等缺陷,致使农民工的劳动权益得不到有力保障.为更好地保护农民工的劳动权益,就必须扩大劳动法主体,将事实劳动关系、劳务关系、雇佣关系纳入劳动法调整范畴;明确劳动者权益保护的各项规定;明确用人主体法律责任,特别加大劳动权益的刑法保护力度;简化劳动争议处理程序,建立专业化劳动仲裁机构.  相似文献

In Singapore, families play an important role caring for mentally disordered offenders. They are particularly important in cases where courts oblige psychiatric assessment, because they provide corroborating information not otherwise volunteered. However, their attendance is generally low. Our quality improvement project sought to increase caregiver attendance at outpatient visits. We followed WHO guidelines for quality improvement, determined the root cause of poor attendance, and devised three Plan–Do–Study–Act cycles over six weeks in late 2013. We followed their impact for 12 months. Case managers and medical social workers implemented three strategies to address issues of poor communication and awareness, which led to poor attendance. Prior to our project, caregivers attended 47% of outpatient visits. Following the implementation of our strategies, rates rose to 70%, sustained over the 12 following months. The entire case management department adopted our strategies. Simple changes to standard operating procedures improved the rate of caregiver attendance at follow-up appointments.  相似文献

目的 改进从中药藤黄中提取、分离新藤黄酸的工艺。方法 按正交试验法优选提取工艺,以乙醇为提取溶剂,并采用AB-8大孔树脂富集,硅胶柱湿法上样,流动相(石油醚∶乙醇=20∶1)洗脱,分离得到纯化的金黄色化合物。运用熔点测定、紫外光谱、红外光谱、质谱和核磁共振技术,通过与文献数据比较来确证化合物结构。结果 金黄色化合物的熔点、紫外光谱、红外光谱、质谱、1H 核磁共振谱(nuclear magnetic resonance, NMR)、13C-NMR数据与文献中新藤黄酸的相应数据一致。结论 运用改进的工艺从藤黄中提取分离新藤黄酸是可行的,更利于工业化生产。  相似文献
