Rethinking calculation: the popularization of financial trading outside the global centres of finance

Abstract

The paper looks at the popularization of financial trading in Israel. It presents a qualitative analysis of the calculative models and techniques that are promoted by financial trading schools, service firms and books. Broadly, the popularization of trading in this field involves a focus on ‘technical analysis’ (TA) and relies upon a socio-psychological reading of financial charts. Incorporating explicitly non-economic ideas into traders’ calculative logic – including an emic notion of ‘performativity’ – popular TA constitutes an attempt to ‘reverse’ the making of markets: to calculatively trace price formations back to the minds, hearts and arrangement from which they had allegedly sprung as a means of foreseeing their future shape before it fully materializes. Tying the psyche and the market in a calculative loop, popular TA transcends existing social theories of financial calculation. The paper discusses this challenge and its implications for our understanding of the expansion of finance.     

Technical discourse in defense of public virtue: Ronald Reagan's explanation of the Iran/contra affair

Contemporary political communication is marked by an evolving dialectical tension between public and technical forms of discourse. Using Ronald Reagan's explanation of the Iran/Contra arms‐for‐hostages initiative as a case study, this article explores the rhetorical uses of technical rationality and the dangers these appeals pose for public deliberation. A close reading of Reagan's March 4, 1987, Iran/Contra defense speech demonstrates that Reagan employed the Tower Commission Report's technical judgments to separate the ethical realm of the public from the nonethical realm of the technical. As a result, he was able to define the Iran/Contra affair as an instrumental problem of bureaucratic organization rather than a betrayal of the public trust. This strategy of demarcating the moral realms of agent from agency is conceptualized as both a moral dodge and an instance of what Kenneth Burke calls ironic discourse. The article concludes by contrasting Reagan's strategy with other recent political crises in which public servants did not separate their public virtue from their administrative responsibility.

技术侦查措施在公安机关侦查破案中发挥了不可替代的作用,但是由于技术侦查措施具有可能侵犯公民隐私权、人格尊严等权利的特点,严格控制技术侦查措施的适用程序成为必然。我国长期以来一直没有法律系统的规定技术侦查措施,刑事诉讼法的再修改满足了控制犯罪和保护人权的双重需要,该修改具有很大的进步意义,但仍存在较多问题需要出台相应的配套制度并在实践中不断的完善。

经过长期的法学理论阐发与司法实践尝试和检验,逐步形成了一系列指引和规范文义解释司法运用的操作技术规则,主要包括语法规则、语义学规则、概括性法律用语规则.通过运用一系列以明晰的规则表达的文义解释操作技术,法律文本的意义模糊问题得以消解,有助于提高司法裁判质量,维护司法正义.文义解释规则化操作表征着,实体正义恰以形式正义为前提条件而获保障.     

法医毒物检验技术方法的质量要求

本文通过对73个法医毒物检验方法进行综合分析,从技术方法的质量特性上对方法的建立与确认提出质量要求.即从内部质量和外部质量的角度,针对法庭科学领域毒物检验技术方法,阐述其功能性、可靠性、易用性和有效性四个维度要求.     

技术侦查中的通讯截取:制度选择与程序规制——以英国法为分析对象

英国作为典型的英美法系国家却在通讯截收制度上丢弃了欧美普遍实行的司法令状主义,在秉承传统侦查秘密观念下实行"行政令状"制度。该制度在受到欧洲人权法院败诉后逐渐构建了相对完备的通讯截收监督制度体系。我国技术侦查的内控模式与英国的行政令状制度极为相似,尽管2012年修改的《刑事诉讼法》将其法定化,但因未合理、清晰地指明侦查机关行使决定权的程序及适用的种类而不具有完全的"法律样态"。在我国现有的司法体制下,完善技术侦查制度不仅需要吸收英国法的教训,还要借鉴有益经验进一步构建技术侦查"必要性和最后性"的动态监督制度、获取证据材料作为定案根据的辩护制度以及向人大报告制度,在制度约束和程序控制上体现规制的严格性。     

我国技术侦查措施存在的问题及完善建议

新修改的《刑事诉讼法》对技术侦查措施作了较多、较明确的规定,是我国证据法治、侦查法治建设取得的重大成就,推动了我国技术侦查制度的法治化进程,对于有力地打击犯罪,有效地保障人权具有重要的现实意义。但是,现行《刑事诉讼法》关于技术侦查措施的规定也存在很多问题,如概念模糊、种类不确定、适用范围不清、适用条件宽松、证据材料使用不科学等,在司法实务操作中易导致技术侦查权的滥用,无法保障公民的基本权利。因此,需要明确技术侦查措施的种类,规范技术侦查措施的审批程序,严格控制采用技术侦查手段的期限;规定技术侦查措施合理的适用范围,明确技术侦查措施的实施主体;并采取有效措施,在保密的同时保证辩方的知悉权、质询权,从而使我国的技术侦查措施予以完善。     

新刑事诉讼法与侦查、鉴定相关规定的理解与实施探讨

修改后刑事诉讼法对侦查、鉴定制度作出了许多新规定,正确理解和实施这些规定具有重要意义。但法律增加规定的技术侦查措施,与常规侦查技术手段并不等同,将鉴定结论改为鉴定意见,并不是降低科技证据的地位和鉴定要求;规定鉴定人有必要出庭作证,并不意味着此种情况下鉴定意见一定有错误,使用有专门知识的人同时代表鉴定人和专家辅助人两个不同主体,值得进一步研究。
