Security governance in a comparative regional perspective

This article aims to explore the relationship between domestic economic and political conditions and the performance of 14 regional organizations over a range of security provisions. It argues that the willingness of member states to increase the range of security provisions of a regional organization is influenced by the combination of high levels of economic and political development and low levels of dispersion among the members of a regional organization. In order to evaluate this assumption, two aspects of regional organizations are explored. The first is to examine the development of security governance provisions of 14 regional organizations as well as the levels of empowerment or autonomy of those organizations. The second is to analyze how six economic and political variables influence the range of security provisions and the degree of empowerment of regional organizations. The final part of the article examines how regional organizations play a significant role in stimulating and reproducing regional governance orders.     

社会组织支撑政府职能转变的对策研究

社会组织作为市场失灵和政府失灵的补充,在承接政府职能和公共服务转移中发挥着重要作用。在推进国家治理体系和治理能力现代化的总目标下,作为职能转移主体的政府和作为承接政府职能转移主体的社会组织都存在自身体制性的障碍。要加快实现政府职能的转变,应锚定"善治"的目标取向,通过为社会组织提供足够的发展空间和法律环境、建立政府购买的财力和政策保障体系、完善社会组织法人治理结构、增加公共产品供给等措施,全面深化我国政府行政体制改革和社会治理体制的创新。     

Barriers to Cross-Systems Collaboration in Child Welfare,Education, and the Courts: Supporting Educational Well-being of Youth in Care Through Systems Change

Cross-systems collaboration between child welfare, education, and the courts benefits when challenges and priorities are identified early. We measured perceptions of educational stability in foster youth with a statewide survey of 1,603 professionals in education, child welfare, and the courts. Results reveal commonalities among perceived challenges to collaboration across systems (e.g., multiple foster care placements; school changes) and differences in perceived importance or significance of a given issue by professional group. Results guided collaborative work in Kansas and may assist other states seeking strategies that inform cross-systems collaboration to improve educational well-being for youth in foster care.     

昆明“3·01”事件后城市反恐的着力点

昆明"3·01"事件有恐怖犯罪实施、国际恐怖势力、恐怖活动的组织活动等三个环节,这三个环节是恐怖势力在城市进行恐怖活动的三层"附着力"。北京"10·28"、昆明"3·01"和乌鲁木齐"4·30"恐怖事件后中国面临的恐怖威胁进入一个新阶段,城市恐怖威胁越来越突出,恐怖袭击在内地城市可能呈现泛化现象,城市反恐成为国家安全的重要议题。城市反恐斗争的着力点就是打击恐怖势力在城市的"附着力"。     

Temporary migration projects and voting rights

Theorists have recently argued that in order to protect migrants from vulnerability and domination, host countries should grant voting rights to all residents, including those who are present on the territory on a temporary visa. Although we endorse the inclusive and egalitarian rationale of this approach, we argue that it is based on the presumption that all migrants aim at permanent inclusion and is therefore inadequate in the case of those who are engaged in ‘temporary migration projects’. We suggest that in order to provide these migrants with a form of political voice that fits their life plans, we need to look at different institutional tools than conventional voting rights, and we point to trade unions and migrant organizations as promising alternatives. We also show that, contrary to what may be thought of other forms of temporary mobility, temporary migration projects and the institutional solutions we propose in order to address the needs of the migrants involved are not disruptive of liberal-democratic institutions.     

西北边境地区面临的恐怖威胁及对策研究

中国西北边境地区面临着＂东突＂恐怖势力、极端个人和团体恐怖犯罪、国际恐怖势力及邪教恐怖势力等严重威胁。公安边防部门作为边境地区一支重要的反恐力量,在现实的边境反恐斗争中存在着反恐立法不够完善、工作认识不足、缺乏针对性训练、情报保障能力弱、配合协作机制不完善等薄弱环节。应加强反恐理论学习和宣传教育,加强反恐信息和机动力量建设,加强边防管理和反恐立法等,以有效防范和打击恐怖活动,保卫边境安全、维护社会稳定。     

20世纪上半叶国际性难民组织与难民保护考察

1950年的联合国难民署、1951年的《难民公约》及1967年修订的《难民地位公约议定书》从制度与法律上对难民进行保护,是当今国际难民保护机制的核心角色。它是在两次世界大战前后成立的国际性难民组织的难民保护实践基础上建立和发展起来的。实际上,当今国际难民保护机制与早期难民组织提供难民保护面临的困境大体相似。本文通过考察20世纪上半叶成立的4个国际性的难民组织在难民保护上所起到的作用,并试图分析其局限性,以期为我们考察当今国际难民保护机制的持久性与它延续的可能性提供历史的与国际关系的分析视角。     

论基层党组织领导村民自治的法思维

农村基层党组织对村民自治的领导地位实质上表现为法律和政策的监督权,并不是行政化的直接领导。《党的基层组织工作条例》和《村民委员会组织法》应当具体规定农村基层党组织行使职能的法律方式和路径,进一步将这种特殊意义的领导程序化和权利化。树立崇尚法律和依法治村的观念,遵循权利平等和村民自治原则,按照法律的逻辑和思维设定领导职能、转变领导方式以及选择争议解决路径具有重要意义。     

单位犯罪与自然人犯罪的界分

由于单位犯罪的复杂性,立法放弃了对单位犯罪的定义权,从而将认定单位犯罪的任务留给了理论和实务界。犯罪是行为,行为表现意志。反过来说,意志支配行为,意志具有根本的判定作用。所以,单位意志是判定单位犯罪的最终指标,所谓以单位名义、违法所得归单位所有、为了单位利益、单位的业务范围、由单位决策机关或者负责人决定,都是单位意志的外在表现形式,是判断单位意志的辅助标志和参考因素,与单位意志之间是现象与本质、局部与整体的关系。而判定单位意志的标准,在于单位成员的行为是否符合单位长期的业务政策、规定、操作习惯,或者具有为单位谋利的动机并经过单位决策机关或者负责人决定。

农村基层党组织跨省联合共建是农村经济现代化中发挥党组织和党员作用的需要,有利于促进相邻省区村与村之间的广泛合作与共同发展,加强和改进新时期农村基层党组织的建设。文章通过对广西百色市农村党组织跨省区联合共建的主要做法及其特点的分析总结,提出搞好农村党组织跨省联合共建工作的对策建议。
