论新时期我国政府主要职能的新定位

构建社会主义和谐社会,客观上要求我国政府必须尽快由事务型向服务型转变。为了顺利实现这一转变,需要切实强化政府的社会管理和公共服务职能,对我国政府职能进行重新定位:将现行的政府主要职能由“经济调节、市场监管、社会管理和公共服务”调整为“社会管理和公共服务”,或者调整为“社会管理、公共服务、市场监管和经济调节”。

完善民主生活会制度,充分发挥其在发展党内民主、加强党内监督中的作用,是以党内和谐促进社会和谐的迫切需要。民主生活会上不讲真话风气的蔓延,严重影响了民主生活会的质量。因此,坚持“讲真话”的要求不能放松,保护“讲真话”的措施亟待强化,督促“讲真话”的力度必须加大,回应“讲真话”的整改务必到位。

Managing commercial risks in open source software licensing

Legal context: The article reviews the commercial risk allocation clauses intypical open source licence terms and discusses their enforceabilityand implications. Key points: The enforceability of warranty disclaimers and limitation ofliability clauses in common open source licence terms is questionable,particularly in a cross-border context, and commercial licensorsshould take additional steps to protect themselves from down-streamrisks. Practical significance: Open source software presents a number of unusual commercialissues, because it is available free of charge and the providerstry to disclaim warranties and liabilities. End users and resellershave to adjust their own in- and out-licensing models to accommodatethis situation.     

拥挤理论在超市结算区人群管理中的应用

通过确定超市结算区人体平均投影面积,给出了结算区最大容许人数。利用拥挤理论,根据不同时段下的人群到达率,得出了收款台最低开放台数,并据此对结算区内人群聚集风险进行了分析。在综合考虑结算区的最大容许人数、人群可忍受的平均等候时间及机器利用率的基础上,确定了各时段的收款台最佳开放数。从超市的自身效益、购物环境和聚集人群安全性出发,针对超市结算区的人群聚集风险提出了可行的减缓措施。     

知识产权公权化理论的解读和反思

知识产权的权利属性是知识产权研究的基本理论问题.因传统的视知识产权为私权的观点在面对知识产权相较于其他私权的特殊性及其领域内层出不穷的新问题时常常遭遇无法解释的困境,所以,有些学者提出了"知识产权公权化"理论,即在承认知识产权私权本质属性的前提下,指出知识产权是公权化的私权,试图以此来寻到新的"突破口".但事实上,该理论因其立论依据本身就存在疑问,是经不起推敲的,它是在社会思潮运动影响下对知识产权权利客体特殊性的一种误读.知识产权作为私权的根本属性不应该因为知识产权所呈现出的某些独特性而被改变,在当前承认并且强调知识产权的私权属性具有重大意义.     

国际海运立法中分化与协调的百年变奏——以海上货物运输承运人责任制度为视角

承运人责任制度是国际海上货物运输法律制度的核心,其发生、发展与变革无不取决于国际贸易、航海技术、运输方式等因素.基于此,我们认为:在未来的一个相当长的时期内,过失责任制应该得到维系,在过失责任制下,免责事项将逐渐醇化,举证责任将根据航运实践的特点予以合理分配,承运人的赔偿责任亦将继续得到适当的限制,从而使过失责任制得到彻底的贯彻.     

A SHORT COMMENTARY ON TIMOTHY M. TIPPINS AND JEFFREY P. WITTMANN'S "EMPIRICAL AND ETHICAL PROBLEMS WITH CUSTODY RECOMMENDATIONS

In this commentary, the call for clinical humility and judicial vigilance in custody recommendations is confirmed as valid and the Australian experience, where the child custody report writer has for some years been permitted to express an opinion on the ultimate issue, is considered. The inherent risks are briefly discussed, and the question of who of the judge and the social scientist might be better placed to decide the exquisitely difficult children's issues after family breakdown is touched upon. It suggests that a combination of the expert's opinion and judicial fact finding probably produces a result that is as good as it gets. But a greater danger is highlighted. It is the impact of the adversary system, and whether it is suitable in any event to these sensitive court decisions.     

A New Use for Practitioners in Teaching Negotiation

This article examines the role that practitioners as guest lecturers have traditionally played in the teaching of negotiation. The authors argue that, as seen from the perspective of student learning, this traditional role has not utilized the practitioner's expertise and experience to an optimal degree. Because of this, they have redesigned the role of the practitioner as guest lecturer in their negotiation course. They describe this new role in some detail. Their goal is to encourage students to understand how and why integrative negotiation techniques can work beyond the classroom in what students call the "real world."     

IDENTIFYING THE PSYCHOLOGICAL FACTORS THAT MEDIATE THE ASSOCIATION BETWEEN PARENTING PRACTICES AND DELINQUENCY*

Past research has largely ignored the developmental changes within the child that account for the association between parenting and risk for delinquency. We used structural equation modeling and data from a longitudinal study of several hundred African‐American families to test the contentions of various theories regarding the sociocognitive and emotional factors that mediate the impact of parental behavior on a youth's risk for delinquency. Our findings largely supported the theories. The impact of monitoring/discipline was indirect through low self‐control and acceptance of deviant norms, whereas the effect of hostility/ rejection was indirect through low self‐control, hostile view of relationships, and acceptance of deviant norms. These two dimensions of parenting were no longer related either to affiliation with deviant peers or to conduct problems once the effects of these psychological characteristics were taken into account; the impact of these parenting practices was completely mediated by these four cognitive/affective variables. Contrary to expectation, however, these psychological factors did not mediate any of the relationship between caretaker involvement in antisocial behavior and child conduct problems.
