In this article the author revisits the question of how feminist theory/theories could address questions regarding universalism, sameness, difference, and the quest for justice. She reconsiders the quest for justice and equality for women and the (im) possibilities of a feminist perspective on justice and a feminist `community'. The three feminist theorists that she discusses are Martha Nussbaum, Drucilla Cornell, and Iris Marion Young. Nussbaum is closer to a liberal defense of universal values – Cornell and Young stand critical of liberalism and focus on sublimity, dignity, and asymmetrical reciprocity. The author supports the perspective of the latter two theorists and applies these perspectives to aspects of South African equality jurisprudence. She also considers critically the extent to which the Draft Protocol to the African Charter on Human and People's Rights on the Rights of Women in Africa breaks with liberal universalism and sameness. To the end she supports a notion of` slowing down' in order to protect women's freedom and dignity, to approach each other with wonder and respect. Some explanations of crime among four ethnic groups in the Netherlands   总被引:1,自引:0,他引:1  
Since 1950 there has been large-scale immigration to Western Europe, mainly from Muslim countries. This paper focuses on the degree of involvement in crime of ethnic minority boys as compared to indigenous boys and on the possible causes of these crime involvements. A random sample from three ethnic minority boys (Moroccans, Turks, Surinamese) was taken. A control group consisted of indigenous boys with a comparable socioeconomic background as the minority respondents. Data were gathered about self-report and recorded delinquency, family and school life, leisure time, traditionalism, migration problems, and socioeconomic status. It appears that the arrest rates among the minority youths are substantially higher than among the comparable Dutch boys. A number of explanations are considered: strain, lack of social control, cultural dissonance, and migration problems. Results show that only social control factors explain criminality within the groups, indicating that the causes of criminality among ethnic minority boys may essentially be the same as those among the indigenous boys.  相似文献

Abstract

This paper aims to reconsider Polanyi's approach to money. His best-known writing on money uses is deeply original and presents strong insights that dissociate money from the concept of the market. Polanyi also developed an interesting non-dichotomous understanding of money in his The great transformation. However, taken together, these two contributions lead to some unresolved questions: his critique of the orthodox approach to money is ambivalent; his argument to separate payment from account is weak; and, most important, he ultimately makes an incomplete break with the classical real/monetary dichotomy. This paper proposes a distinction between money as a set of instruments and practices and money as a concept, through the integration of John Commons's concept of debt into Polanyi's framework. This reformulation allows us to resolve Polanyi's unresolved questions while preserving his major contributions, and leads to a more complex understanding of money.  相似文献

Social sustainability, in theory, should result in responsiveness to change, a durable sense of community trust and interdependent institutional structures. However, recent studies indicate that current sustainability efforts of regional local government are not yielding anticipated outcomes. Drawing on two social theories of Henri Lefebvre, this paper offers an empirical analysis of the ability of the government–governance nexus to deliver on social sustainability promises in Moranbah in regional Australia. Study findings revealed that the Moranbah government–governance nexus suffers from adversarial relationships between key actors that result in a distrust of politics and power, the absence of a defined governance system, community alienation, and State Government dominance and intervention. These experiences of the government–governance nexus have rendered social sustainability a distant hope for Moranbah’s residents. This paper suggests a reform in sustainability policies to improve the current situation in the case region, and theoretical propositions for future research.  相似文献

ABSTRACT

This article addresses challenges arising from the guarantee in South Africa's Constitution (1996) of continued use of indigenous law. This law has been handed down in oral form, but increasingly, written sources are needed when cases relating to indigenous law are heard in South Africa's higher courts. Although access to this kind of information is vital to empowerment and justice in Africa, wider access is hampered by different literacy levels and language differences. This article examines accountable translation into English of legal anthropological texts, referring to a case study on law practised among the Nkuna of Ritavi to demonstrate some of the complexities. The article considers the Anglo-American translation tradition's preference for idiomatic translation (paraphrasis) rather than word-for-word faithfulness (metaphrasis). It advocates focusing on the Skopos (purpose) of texts negotiated with the author. It also proposes foregrounding the hermeneutic engagement of translators as readers. For the text in the case study, it suggests two translations, for two audiences: one into an academic register (for academics, legal experts, and educated members of the Nkuna community), and one into Plain English (mainly for members of the Nkuna community for whom English is a second language). To address political dimensions of responsible translation, metatextual strategies espoused by feminist translators to increase translators’ visibility and accountability can be used, and postcolonial translation theory should be considered.  相似文献

Abstract

Assessing the implicit attitudes and beliefs of offenders has proved difficult over decades of work and research with offender samples. The purpose of this paper is to outline the research related to the use of the emotional Stroop task and to encourage researchers and practitioners to use it as a measure to assess the implicit attitudes of offenders within their assessments. We consider the factors that may influence Stroop results along with the research considerations that need to be taken into account when using an emotional Stroop paradigm. Currently, a significant limitation of the emotional Stroop task is a lack of standard word stimulus sets that are able to distinguish between offender types. This limitation could seriously impede further development of this tool. Suggestions for future research are proposed.  相似文献

This paper is situated in the context of feminist debates around nature, culture, the body and essentialism, and focuses specifically on matter and materiality. In part, it is a response to recent developments in the natural sciences which suggest that strictly social constructionist and/or epistemological approaches to matter may be inadequate to the task of analysis and critique. It begins by considering some of the specific conditions under which the sex/gender model emerged, and its implications, before addressing the work of three contemporary theorists who are engaged with differing conceptions of matter, ontology and substance. I suggest that, while not necessarily providing ‘solutions’, these projects raise the kinds of questions that promise torevivify the flesh and blood of feminist critique.  相似文献
