Juvenile Sexual Murderers: Examination and Classification of the Crime-Commission Process

This study aims to empirically explore the crime-commission process of juvenile sexual homicide offenders (SHOs). First, a comparison between the crime-commission process of juvenile and adult SHOs is undertaken, while as a second step, this study also provides an empirical classification specific to juvenile SHOs. The sample used in this study consists of 55 juvenile SHOs and 281 adult SHOs. A sequential binomial regression was used to compare at the multivariate level the two groups of offenders, while a latent class analysis was used to examine the relationships between each step of the crime-commission process of juvenile SHOs. Our findings suggest that the crime-commission process of juvenile SHOs present differences when compared with adult SHOs. Moreover, we identified four different patterns in juvenile sexual homicide: explosive opportunistic, sadistic, overcontrolled anger, and predator. Theoretical and practical implications in terms of criminal investigations as well as offenders’ management and treatment are discussed.

日本刑法学中有关构成要件理论的违法.有责行为类型说是由小野清一郎在二战前提出的,二战后经过团藤重光定型说的阐发而成为一段时期内日本刑法学中的通说观点。但是这个学说受到了行为类型说、违法行为类型说的挑战,在刑法学中的影响已是大不如前。现在有学者,认为不同的学说都是以不同的机能期待为前提,学说之间并无优劣、高低之分。     

Conspiracy Mongering in Venezuela: The Chavismo Period (1998–2018)

Hugo Chávez's rise to power in 1998 brought many changes to Venezuela's political culture. One transformation not frequently commented on is the constant formulation of conspiracy theories, both by chavismo supporters and by its opponents. This article discusses some of those conspiracy theories, relating to the deceased Venezuelan President's origins, his religious beliefs, the 2002 failed coup d'état, and Chávez's own death. It also addresses more recent conspiracy theories relating to Nicolás Maduro's birth, economic warfare, and drug smuggling operations. Venezuela is currently undergoing a major humanitarian crisis, and this article defends the view that, at least partially, conspiracy mongering has been a factor in Venezuela's collapse. As part of Venezuela's reconstruction, this article recommends that Venezuelan political forces need to reach a consensus and agree not to make ridiculous conspiratorial claims.

The Sexual Trafficking of Juveniles: A Theoretical Model

Research on the sexual trafficking of juveniles has increased. However, there has been no theoretical model developed incorporating variables into a systemic, interactive analysis of the issue. Utilizing Parsonian functionalism as its foundation, the authors developed such a model. The model is based on sociological, criminological, and psychological theories and concepts with a particular emphasis on the role of environmental design in trafficking. Unique to this study, the authors propose that a symbiotic relationship exists between the adolescent brain and trafficker as psychopath as contextualized in the Stockholm syndrome. We offer research and policy implications based on the model.

我国刑法理论中,关于严格责任有若干代表性的观点。英美刑法中的严格责任应该从实体和程序两方面来理解;虽然我国目前的司法实践中尚不存在真正的严格责任制度,但是结合我国刑法的具体背景,其实严格责任是能够为我国刑法所包容的。在我国刑法制度中,无论从可能性还是必要性看,其都应该有一席之地。其本质为一种推定过错责任,注意义务是其中的关键问题。

用灰色系统理论中的灰色预测方法对青少年犯罪进行趋势预测。根据某地区统计资料建立灰色动态数列预测模型,对该地区未来几年青少年犯罪进行预测研究,通过算例可知,预测结果是令人满意的。     

From apathy to obsession: the reactions of A. K. Chesterton and the British far right to imperial decline

ABSTRACT

Mulhall sets out to explain how, contrary to what one might expect, imperial decline was rarely a pressing issue for the British far right, usually falling below both the perceived threats of Communism and immigration on their list of priorities. By first explaining these unexpected findings and then placing them in an international comparative context, new evidence emerges that supports those imperial historians who subscribe to the ‘minimal impact’ orthodoxy regarding the effect of empire on the metropole. In addition, however, those aspects of the radical right that did concern themselves with imperial decline, namely A. K. Chesterton and the League of Empire Loyalists, are explored in depth, revealing a peculiarly British form of conspiratorial antisemitism that blamed imperial decline on secret Jewish power. This strand of conspiracy thinking, best articulated by Chesterton, is traced back to its origin so as to illuminate the continuity of ideas and ideologies between the interwar and post-war periods within the British far right. The result is an article that contributes to several existing historiographical debates and provides an exploration of a less well-known aspect of the work of A. K. Chesterton and conspiratorial antisemitism more generally.
