举证时限制度的冷思考

在价值目标上,举证时限制度不仅偏离实体公正,而且不可能真正提高诉讼效率,同时也不能真正体现和实现程序正义.大陆法系国家几乎找不到类似中国举证时限的立法体例,英美法系国家有举证时限,但其是以陪审制和漫长、充分的证据开示为依托的,且设立举证时限、证据开示的真正目的不是在于提高效率,而是发现真实,破除"竞技论"的弊端.如果说我国的举证时限制度是属于外国制度的大胆引入,那么,忽视了其制度背景和功能实质的移植是难以达到立法目的的.

论丢失枪支不报罪之限制处罚范围要素

丢失枪支不报罪的危害行为是过失导致枪支丢失,而不是丢失枪支后不及时报告;不及时报告与严重后果之间并不具有刑法上的因果关系,它既不是危害行为也不是危害结果,而只是一种限制处罚范围之要素;判断是否“及时报告”应着眼于客观上是否在危害后果发生之前的合理时间内报告,而与行为人何时明知或应知枪支丢失没有关系。     

Prevention science,drug abuse prevention,and Life Skills Training: Comments on the state of the science

There has been tremendous growth in the field of prevention science over the past two decades. The defining features of contemporary prevention science are high quality empirical research using rigorous and well-established scientific methods, careful hyphothesis testing, and the systematic accumulation of knowledge. One area where substantial progress has been made is in our understanding of the etiology and prevention of tobacoo, alcohol, and illicit drug abuse. In this paper, we review the growth in prevention as a scientific enterprise, discuss advances in drug abuse prevention research, and review the effectiveness of one approach to the problem of adolescent drug abuse, the Life Skills Traning (LST) program, and the methodological strengths of the LST evaluation research. In addition, we provide a response to criticism regarding two types of data analysis in evaluation research, and show that these analyses can help address a number of important research questions with implications for theory and practice. First, the analysis of high fidelity subsamples can address research questions about the importance of program implementation fidelity; and second, composite measures of concurrent tobacco, alcohol, and marijuana use (i.e., polydrug use) are useful in testing research questions about program effects on more serious levels of drug involvement. With an increasing number of ramdomized controlled trials underway, the field of prevention science is contributing to a new generation of evidence-based approaches and policies that, if widely utilized, offer the potential of reducing the mortality and morbidity associated with a number of major health and social problems.     

空间形式:现代小说的叙事结构

长期以来,叙事学理论对时间问题关注较多,对空间问题着力甚少。在关于现代小说叙事结构“空间形式”的探讨中,其“空间”非指日常生活经验中具体的物件或场所,而是一种抽象空间、知觉空间、“虚幻空间”。只有在完全弄清楚了小说的时间线索,并对整部小说的结构有了整体的把握之后,这种“空间”才能在读者的意识中呈现出来。构成现代小说空间形式的要件是时间,或者说时间系列。小说的空间形式必须建立在时间逻辑的基础上,才能建立起叙事的秩序;只有“时间性”与“空间性”的创造性结合,才是创作伟大小说的条件,也是未来小说发展的趋势所在。     

对“韬光养晦”的哲学审视

摘要：本文简析了“韬光养晦”外交战略的历史与现实,并结合《孙子兵法》的相关论述,指出中国必须全面审视、理解和坚持“韬光养晦”策略,并要正确认识到“韬光养晦”相较于一种手段更是一种价值。该文认为,破除激进主义的简单思维,破除盛世的迷梦,冷静地正视,有效地反击,运用东方文明的智慧,从而最大限度地突破围堵,为国家的和平发展营造最佳的战略环境,才是当前中国外交战略的根本所在。     

中国法制史课程多元化教学方法探析——以《宋代法律制度》一章的教学为例

尽管中国法制史教育具有重要的现实意义,但从目前的教学实践来看,中国法制史课程未得到应有的重视。为改变这种状况,应采用多元化教学方法,即除了采用传统的讲授教学法外,还有必要引入案例教学法、比较教学法和多媒体教学法,从而增加课程的趣味性,激发学生的学习兴趣,培养学生独立的法律思维能力。本文以《宋代法律制度》一章的教学为例,探析多元化教学方法在中国法制史教学中的应用。     

Economic voting in a crisis: The Irish election of 2011

The paper explores a question raised by the 2011 Irish election, which saw an almost unprecedented decline in support for a major governing party after an economic collapse that necessitated an ECB/IMF ‘bailout’. This seems a classic case of ‘economic voting’ in which a government is punished for incompetent performance. How did the government lose this support: gradually, as successive economic indicators appeared negative, or dramatically, following major shocks? The evidence points to losses at two critical junctures. This is consistent with an interpretation of the link between economics and politics that allows for qualitative judgements by voters in assigning credit and blame for economic performance.     

犯罪均值频率——一种犯罪时间分布的测度指标

犯罪在时间分布方面有其特定规律,常规的犯罪总数或平均数等统计量存在不稳定性、偏差性和数据保密性等问题,不利于犯罪时间分布特征的客观对比分析。犯罪均值频率指标克服了传统时间分布统计量存在的问题,可以用来分析犯罪是否偏好发生于特定的时间内,满足了犯罪时间分布规律分析需求。运用该指标对某市5年内的入室盗窃犯罪在星期日别、月份上的时间分布规律进行了实证研究,结果表明,入室盗窃在该市3月份和9-12月份表现为高发期,而在周末则表现为犯罪低谷期。
