中华全国总工会创建前后简述——兼评一、二、三次劳大历史地位与功绩

在广州召开的一、二、三次劳大,是中国工人运动史的新起点、奠基石和里程碑。它们为中国工运的各时期的发展,制订了行之有效的方针与策略。     

在线纠纷解决机制的困境和对策

ODR机制作为一种新生的纠纷解决方式，其在解决小额的、当事人间物理距离遥远的网络民事纠纷方面具有特别优势。而ODR机制存在着受理案件的有限性、提供救济方式的有限性、技术工具的双刃性等价值定位缺陷；存在着信任性不足、接近性难等实务利用缺陷；存在着程序被滥用、实践标准混乱等制度设计缺陷。ODR机制价值定位存在的缺陷是ODR本身所固有的，无法克服；实务利用缺陷和制度设计缺陷则可以通过相应的对策予以消减甚至消除。     

Conflict reduction by mutual disengagement

This study attempts to discover what variables, if any, will induce opponents to cooperate. The author isolated 12 independent variables and grouped the first five together in his refined model as variable 6. The remaining variables are: worthlessness, supervision, conspicuousness, previous neutralization, absence of internal segmentation, military potential, and tradition as a neutral. Analysis was limited to bivariate relationships between the independent and dependent variables (i.e., possible outcomes). Cases tested included examples from the outbreak of World War I to the present. The author discovered that disengagement would most likely succeed in a geographically and ideologically distinct Country, one previously neutralized, that had little military value, a politically organized population, and some military capacity. The most unpromising candidate would lack clearcut ethnic borders, internal homogeneity, and political unity. Disengagement, while no panacea, offers the advantage of many opening moves in a conflict reduction situation.

物业管理是一项服务性很强的工作.物业工会组织可以将工会工作与物业管理高度契合,通过扩大工会工作范畴、拓展功能、延伸服务,在服务职工的同时,服务于企业发展、服务于社会和谐建设.     

谨防诉讼调解过度化

鉴于诉讼调解在彻底解决纠纷、实现案结事了方面确实具有判决难以比拟的优势,诉讼调解在司法政策上得到支持,在司法实践中受到欢迎,具有足够的正当性与合理性。但是,我国原有制度已经为法官优先选择调解提供了充分的激励,在此基础上再大力强调调解,采取多种措施激励法官调解,有可能会造成诉讼调解过度化乃至强制化的局面。这种局面不但会损害当事人的合法权益,影响司法权威,阻碍我国的法制建设,也不利于审判效率的提高。因此,必须谨防诉讼调解过度化现象的产生。     

“两个普遍”要求乡镇（街道）工会建设新突破

当前,乡镇(街道)工会已成为工会组织体系中承上启下的重要环节,加强乡镇(街道)工会建设,落实"组织起来、切实维权"工作方针,亟待解决"有人干事"和"有钱办事"等问题,按照工会规范化建设要求,明确乡镇(街道)总工会法律地位,增强基层工会活力,确保依法推动企业普遍建立工会组织,依法推动企业普遍开展工资集体协商,即"两个普遍"工作目标的实现。     

Cut Loose in the Caribbean: Neoliberalism and the Demise of the Commonwealth Sugar Trade

This article focuses on the way the Anglophone Caribbean succumbed to the overhaul of the European Union sugar trade and how these countries have attempted to restructure their economies in its wake. We show how the protagonists of reform gave a sense of inevitability to the demise of the Commonwealth trade system and conveyed (unrealistic) strategies for how this should be managed for the benefit of the Caribbean. In this way we detail the hegemony of neoliberalism in contemporary trade politics and the need for alternative strategies for rural development in the Caribbean region.     

中日贸易的新发展、新变化及问题

新世纪以来,中日贸易规模进一步扩大,贸易商品结构也发生了新的变化。由于中国经济崛起而日本经济低迷,中国在日本对外贸易中的地位迅速提高,而日本在中国对外贸易中的地位却明显下降。中日贸易发展对中日两国经济都产生了积极的作用和影响,也存在一些不可忽视的问题,必须认真对待,尽快解决。     

以科学发展观为统领不断推进工会工作创新发展

中关村科技园区海淀园是中国第一个高新技术产业开发区，汇聚了15000多家高新技术企业。目前园区基层工会组织多是小而分散，工会会员呈高学历、高素质、高收入群体特点。工会工作按照传统的组织体系和工作方式难以有效运作。因此，园区各级工会必须适应形势，在基层建设和工作领域方面走向社会化、网络化和开放化，从实际出发，建立健全工会组织体系，以科学发展观为统领，以维权为重点，围绕园区的稳定和发展，发挥工会组织的积极作用。
