刑法中定量因素的故意规制研究——“客观超过要素”理论的再诠释

我国刑法“立法定性、定量”的．立法特点对于我国刑法中“主客观相统一原则”的“相统一”基准以及犯罪故意概念内在结构的理解都有其实质性影响，从行为无价值与结果无价值机能二元论的视角重新审视“客观超过要素”理论就会发现“客观超过要素”概念的存在有其充实的理论基础与合理性。

Pursuing the allure of combat: an ethnography of violence amongst Iraqi Shi’I combatants fighting ISIS

The social sciences speak of violence through its meaning, performances, manifestations and representations; however, the inner workings of violence are less explored. In order to suggest a different mode of seeing violence, I explore the inner workings of violence through the pleasures of and fun among Shi’i volunteer combatants. I apply Walter Benjamin’s motion of pure means to explain how violence becomes self-referential and non-representational via combat-zone ethnography amongst Iraqi Shi’i militants who fought against ISIS in Iraq. I address the fine line between pleasure and fun in order to highlight the inner workings of violence during combat and to encourage a fresh bottom-up anthropological perspective in assessing the parameters of the persistence and resilience of volunteer combatants. My approach advocates moving beyond recruitment and ideological interpolation by questioning the allure of combat through an ontological framework that includes combatants’ perspectives and narratives.

刑法教义学研究的中国主体性

刑法教义学既包括教义学方法,也包括教义学知识;教义学方法是无国界的,但教义学知识是对一国现行有效的法律所作的解释,因而是有国界的。德日刑法关于共同犯罪的规定表明,共犯的定罪与量刑均取决于正犯,因而决定了其共犯理论必须采取实质客观说以区分正犯与共犯;而中国刑法关于共同犯罪的规定表明,共同犯罪的定罪与量刑是截然可分的不同层次,因而在正犯与共犯的区分上采取形式客观说就足以解决问题。中国刑法和德日刑法对侵占罪规定的成立要件并不相同,"拒不退还"、"拒不交出"在中国的侵占罪中是一种客观处罚条件,是独立的行为要件,因而不能将其融入"非法占为已有"的含义之中。中国的刑法教义学研究必须清醒地认识到,要以中国刑法的规定为研究的逻辑起点并受其严格约束;要真正构建中国的刑法教义学,必须唤起研究者的主体意识。

Why Subjectivity Matters: Critical Theory and the Philosophy of the Subject

Abstract

In this paper it is argued that Habermas' critique of German Idealism is misguided and that his rejection of the philosophy of the subject is unjustified. Critical Theory needs to recognise the importance of subjectivity for all social philosophy if its theoretical aims are to be achieved. In order to demonstrate the relevance of subjectivity to Critical Theory the essay draws on analytic philosophy of mind and on the work of Manfred Frank and Dieter Henrich.

Voela and Tamboukou use Slavoj ?i?ek’s notion of the symptom as a lens through which to look at representations of female figures in Greek literary texts of the early twentieth century by Gregorios Xenopoulos. In mapping the construction of the figure of the modern woman in the matrix of discourses, fantasies and power relations of fin-de-siècle Greece, they draw on psychoanalytic insights, interrupted by Foucauldian interventions. Following Judith Butler’s move of making trouble they attempt to open up a dialogic space between psychoanalytic and Foucauldian approaches to the female subject, contextualized in a specific social, historical and cultural milieu. It is in this context that they discuss, first, how feminine and masculine subjectivities are represented in man’s speech; second, how unintended excesses and interruptions occur in the problematic representation of women; and, third, how madness and ultimately death come to play a significant role in the power relations between the sexes.     

Female Subjectivity in Mao＇s Era： From Women by Wei Junyi

本文从社会性别视角和后结构主义主体理论出发,以对女作家韦君宜20世纪50年代创作的小说《女人》的细读为例,探讨国家意识形态与国家主流性别话语对妇女主体性形成的多种可能性,以此作为对笼统否定中国＂自上而下＂的社会主义妇女解放运动的态度的一种回应。本文认为毛泽东时代有关性别平等、社会性别中性和同志关系的社会性别话语参与到了当时女性主体的话语构建过程中,它们承接五四启蒙运动中淡化性别差异的独立人格、两性平等的话语,为一种脱离本质主义的,反对性别二分对立性别主体的建立创造了条件,为女性摆脱客体化的他者地位,发展自身的能动性提供了可能性。
