We know relatively little about the economic effects of “insignificant” rules because they are not typically analyzed. Yet, these rules could be cumulatively important. We provide an economic analysis of one proposed rule to control hazardous air pollutants, which is not considered to be economically significant. This rule is of particular interest because it is one of the first in a long series of rules that Environmental Protection Agency (EPA) will consider for limiting hazardous air pollutant emissions. Our analysis suggests that the proposed controls that EPA has considered are not likely to pass a benefit–cost test. We recommend that an agency base its decision to allocate additional resources to benefit–cost analysis on the expected value of the improved information. In addition, agencies should consider applying a rule of thumb that would specify a threshold level of risk reduction that needs to be achieved before some kinds of regulation are considered.  相似文献

Despite widespread adoption of Porter's Industrial Cluster Theory as a policy development framework by federal and state governments over the past decade, Australia remains significantly below the OECD average in terms of its industries' economic contributions to real wealth creation ( Brown 2000 ; OECD 1998 ). The major cause cited for this relatively poor performance has been inability of key government officials to implement effective industry policy that simultaneously avoids de facto protectionism and distortion of competition. This article provides an insight into the key policy decisions undertaken by the Tasmanian state government that coincided with development of an internationally successful shipbuilding industry in that state. As such, this article provides a reflection on policy initiatives that may be valuable for government officials elsewhere.  相似文献

This article presents a conceptual framework for analysing the governance of natural resource use, as governance is often the primary issue when natural resources are overexploited and degraded. It addresses both spontaneous and active governance, including institutional change induced by development co‐operation. Drawing on existing frameworks of institutional analysis, fundamental modifications are presented to adapt the concept to the context of international co‐operation, and to include dynamic aspects of institutional change as well as multiple actor interactions. Tested in several case studies, the framework was found suitable and relevant for use in project planning and evaluation, as well as for comparing governance issues across cases in a conceptually rigorous way. Public reporting is a requirement for public affairs practitioners in public administration because of the democratic context in which government operates. By reporting to the public‐at‐large on agency activities, government agencies contributed to an informed citizenry, the essential foundation of a democracy. For public affairs in business administration and non‐profit administration, public reporting is desirable rather than mandatory. Public reporting was traditionally accomplished indirectly, through news media coverage of government. However, recent research suggests a diminution of interest by the media in fulfilling its role as an instrument of democracy. This means that the public reporting obligation of public affairs professionals in public administration needs to shift to direct reporting, through such products as annual reports, newsletters, TV programmes, Internet websites etc. Copyright © 2002 Henry Stewart Publications.  相似文献

This article proposes that feminist legal critics need to be able to explain how some rape cases succeed in securing convictions. The means by which rape cases are routinely disqualified in the criminal justice system have received widespread attention. It is well established in feminist legal critique that female complainants are discredited if they fail to conform to an archaic stereotype of the genuine or ‘real’ rape victim. This victim is not only morally and sexually virtuous she is also cautious, unprovocative, and consistent. Defence tactics for discrediting rape testimony involve exposing the complainant's alleged failure to comply with the sexual and behavioural standards of the normative victim. This understanding of how rape complain(an)ts are disqualified is not predictive, however, of the complainants whose cases succeed in securing convictions. This article reviews some successful Australian rape cases and considers the ways in which they disturb feminist understandings of how rape complaints are discredited in the criminal justice system. It proposes that recent research analysing the discourse of rape trials provides a way of explaining the apparent discrepancies between the ‘ideal’ rape victim and successful complainants. This paper examines the linkage between crack market activity and gunhomicide suggested by Blumstein (1995), who argues that the arrival ofcrack stimulated an increased availability of guns among juveniles. Thisgreater availability of guns, the argument continues, is responsible for thesharp upswing in juvenile homicide experienced in the United States in themid-1980s. Using city-level data on crack arrests and gun-related juvenilehomicide, we fit a change-point version of the Bass (1969) model ofinnovation diffusion. We find that, in most large American cities, thediffusion process for crack cocaine experienced an onset of dramatic growththat was followed by a similar, slightly slower growth in gun homicidescommitted by juveniles. We further use cluster analysis to find that thespatial patterning of the two processes is similar, starting on the East andWest Coasts and working their way toward other regions of the nation. Gunuse in homicide among slightly older offenders (ages 18–24) alsoexperienced a change at roughly the same time as the juveniles, but the rateof diffusion was considerably milder than for the younger group; offendersages 25 or older generally show no growth in gun-related homicide whatsoever. In addition, there is no detectable surge in juvenile nongun homicide activity. Based on these findings, we conclude that the crack cocaine markets–gun availability linkage is highly plausible, and we suggest directions for future research in clarifying the dynamics of the late-1980s surge in juvenile homicide.  相似文献

This article addresses the termination of employment because of the conduct of the employee in her leisure time, in the light of the right to private life. It explores the impact on the retention of employment of activities taking place outside the workplace and outside working hours, and argues that the approach of UK courts and tribunals, which is based on a primarily spatial conceptualisation of privacy, is flawed. A fresh approach to privacy, resting on the idea of domination, is proposed, which is sensitive to the particularities of the employment relationship. Considering the fairness enquiry in dismissal, it argues that off‐duty conduct may lead to lawful termination of employment only if there is a clear and present impact or a high likelihood of such impact on business interests; a speculative and marginal danger does not suffice. It further proposes that a particularly meticulous test is appropriate when certain suspect categories, such as the employees' sexual preferences, are at stake.  相似文献
