未成年人网络游戏引发暴力犯罪的控制路径

近年来,因网络游戏而诱发的未成年人犯罪案件呈日益上升趋势,如何有效地预防和控制未成年人暴力犯罪,已成为全社会关注的热点问题。从实证分析角度,考量域外国家防控机制,为了实现对未成年人网络游戏暴力犯罪的控制,应当建立未成年人涉网相关的专门法律规范,强化行政执法权,推行网络游戏相关规控制度,开展社会管控,对未成年人健康用网进行综合引导。     

First Steps Towards Hearts and Minds? USAID's Countering Violent Extremism Policies in Africa

The United States government has adopted new approaches to counter violent extremist organizations around the world. “Soft security” and development programs include focused educational training for groups vulnerable to terrorist recruitment, norm messaging through local radio programming, and job creation in rural communities. This article evaluates the effectiveness of one set of these multi-vectored, community-level programs through data from 200 respondents in two similar, neighboring towns in northern Mali, Africa. The data show that residents in Timbuktu who were exposed to the programming for up to five years displayed measurably altered civic behavior and listening patterns in comparison with their counterparts in the control town of Diré, which had no programming (controlling for potential covariates including age, ethnicity, and political and socioeconomic conditions). However, there was little measurable difference between the groups in terms of their cultural identities and attitudes towards the West. While this study is unable to definitively prove a causal connection between programming and behavioral outcomes, it nonetheless strongly suggests that the process of “winning hearts and minds” can be effective at certain levels but may require extended time and dedicated resources to generate higher-level results.

行为人在实施侵犯人身暴力犯罪后“捎带财物行为”的定性,应当具体分析暴力犯罪后“捎带财物行为”性质,即判断先前侵犯人身的暴力犯罪给被害人造成的状态,接着判断先前暴力行为是否形成新的“威胁”以及是否被“捎带财物行为”实施时所利用,最终作出合理的结论。

暴力犯罪在我国建国50年中,经历了由多到少和由少到多的过程,其变化主要受社会控制力强弱、青少年人口数量和比重、打击力度的大小等因素的影响.随着市场经济的逐步建立,这种犯罪的比重将有所下降,但图财性质的暴力犯罪在整个暴力犯罪中的比重会继续增加.对暴力犯罪的控制,尤其要贯彻打击与预防并重的方针.     

Voting rules in insolvency law: a simple-game theoretic approach

A chief characteristic of modern insolvency law in Canada, Germany, the UK, and the US is the provision for ‘workouts’ or ‘schemes of arrangement’ by which insolvent companies can attempt to rehabilitate the business. If reorganization is chosen, the debtor has to devise a plan of action which will be voted upon by claimants. The voting rules, however, differ in each jurisdiction to a greater or lesser extent and as yet have not been analyzed in any rigorous manner. This paper provides an approach based upon the theory of simple games to analyze the rules in terms of the ease which each of these regimes can pass (or hinder) plans and how these rules distribute value among claimants. We pay particular attention to the role of classification and the effect of coalition formation.

暴力犯比例的增大给监狱机关的监管改造工作埋下了不可忽视的隐患,其对监管安全构成的威胁自不待言。鉴于此,必须认真研究和分析暴力犯的基本情况,掌握其成分变化及特点,并有针对性地提出相应的监管改造对策。     

网络游戏对青少年犯罪的诱发作用及对策分析

现阶段,网络游戏对青少年犯罪具有较强的诱发作用,被称为“精神海洛因”。它混淆虚拟与现实,导致错误认知;过分侵犯虚拟角色,导致转化为现实行为;围绕“角色”物品和账号衍生出新形式的违法犯罪行为;对消极人性欲望的盅惑,成为严重暴力犯罪的潜在诱因。为减少网络游戏对青少年的消极影响,需要法律法规对其进行规范,对“玩家”行为进行引导,对虚拟财产加以技术保护,需要社会、家庭与学校对青少年加以引导。     

Using Video to Reduce Home Safety Hazards with Parents Reported for Child Abuse and Neglect

Safety hazards are frequent in the homes of families reported for child abuse and neglect. The effectiveness of a videotape intervention with two families involved with child abuse and neglect was examined, using a replicated multiple probe design across settings. Data were collected using the Home Accident Prevention Inventory — Revised, and the Checklist for the Video-Trained Parent's Behavior. Social validation and expert validation data are also presented.     

Construction of China’s Public Video Surveillance System

The development and application of video surveillance technology management bring great convenience to the society, but the flood and disorderly use of the monitored data have also caused the violation of the civil rights. The absence of data management control in the video monitoring process requires our serious consideration and exploration into relevant law construction. Public video monitoring in the construction of the rule of law is the most important problem and we need to coordinate the relationship between public interests and individual rights. It is necessary that in the construction of the rule of law we should pay attention to the improvement and updating of the legislation concept, standardize the executable program and build an effective supervision system.     

再论虚拟财产刑事保护的不当性——与王志祥博士商榷

王志祥博士发表在《北方法学》2010年第4期上的《论虚拟财产刑事保护的正当性——与侯国云教授商榷》一文,对笔者发表在《中国人民公安大学学报(社会科学版)》2008年第3期上的《论网络虚拟财产刑事保护的不当性——让虚拟财产永远待在虚拟世界》进行了系统的辩论和批评。为避免对读者产生误导,倡导游戏产业健康发展,此文再次阐述笔者对虚拟财产的基本观点:虚拟物品和虚拟财产的划分不科学,游戏商和玩家都是虚拟财产的主体。虚拟财产没有客观性和现实性,它在现实世界中不具有任何效用性。虚拟财产也不具有稀缺性,更不能在现实世界中流转。游戏只是娱乐,不是劳动,虚拟财产作为整个游戏软件的组成部分,不应该另行卖钱。用虚拟财产兑换现实货币违反价值规律和价值交换规则,虚拟交易属于干扰金融秩序的违法行为,保护虚拟财产将会给社会带来极大危害,应让虚拟财产永远待在虚拟世界。
