当前我国既处于发展的重要战略机遇期,又处于社会矛盾凸显期,以现实社会结构为基础,通过数字化形式展示出来的虚拟社会,在为人们的生产生活带来便捷、浓缩社会空间、拉近人与人距离的同时,也带来诸多新问题.作为社会治安治理的主要行政机关,公安机关在对虚拟社会的管理中承担主要作用,扮演重要角色.如何加强对虚拟社会的引导和管理,是对构建以人为本的和谐社会的新考验.     

虚拟财产应纳入夫妻共同财产——兼论网络游戏中虚拟财产的归属

随着网络游戏的普及,网络游戏逐渐成为某些人的一种职业,在夫妻生活中夫（妻）一方或双方玩网游的也不在少数,关于网络游戏中的虚拟财产之争已频繁出现。无形财产在婚姻家庭领域顺应时代潮流被纳入夫妻共同财产已是大势所趋,在离婚时应当由专门的评估机构对网络游戏虚拟财产价值进行评估,将其作为夫妻共同财产进行分割。     

Cyberspace,simulation, artificial intelligence,affectionate machines and being human

Abstract

This article focuses on the question whether the technologically enabled advent of ‘virtual reality’ or ‘cyberspace’ has a significant impact on human experience of the world. Gilbert Germain's work on Virilio and Baudrillard gives greater insight in this regard, specifically regarding cyberspace as the new ‘frontier’, and focuses on the alienating effects of cyberspace regarding the human life-world. Turkle's recent work regarding robotics similarly points to a fundamental shift in human attitudes towards ‘embodied’ artificial intelligence, especially concerning its capacity for affectivity, which further marks a turning away from the complexity of human relationships in favour of supposedly uncomplicated ‘machine relationships’. Derrida enables one to better understand the changing relation between humans and machines in terms of the reconfiguration of human subjectivity. Together with Turkle's work in this domain, it points to a surprising ‘reconfiguration’ of conceptions regarding being human. Finally, Feenberg's retrospective on the fraught relations between humans and technology, as reflected in various fictional and theoretical works, as well as social developments, provides a suitable conclusion, given his affirmative remarks on the prospects of human autonomy in relation to the Internet.     

Bourgeois Myth versus Media Poetry in Prime-time: Re-visiting Mark Frost and David Lynch's Twin Peaks

This article explores IVIark Frost and David Lynch's television series Twin Peaks from the perspective of the two dominant world-views it dramatized. The world-view based in bourgeois myth can be described as employing significations that are always present in naturally and mythically transcendent terms. The other world-view is generated by media poetry, which is a virtual mode of signification that re-mediates linguistic/audio/visual phenomena with contingent capacities for meaning. That generative potential for signification is an aspect of all media use, but media poetry specifically highlights and exploits the capacity of new multi-media to enhance “poetic” possibilities for meaning-making. This may occur through either the actual use of virtual media, through a critical ambiguity with regard to official ideologies and formal/generic con-straints, or through thematic content that destabilizes fixed meanings/representations and entertains possibilities for alternative significations. The article makes the case that the adolescent characters in the show specifically embody the productive world-view inherent in media poetry, and the “poetic” challenges they present to adult, mythic society allow for the continual re-mediation of any and all bourgeois myths. Those adolescents, especially Laura Palmer, embody cultural meanings that refuse ideological codification; that is, that can still become. Twin Peaks, as the article demonstrates, is a striking example of media poetry since it was aired on prime-time network television; it still deserves attention for the stunning ways it remediated the mythic nature of American, middle-class society.     

Analyzing Forensic Evidence Based on Density with Magnetic Levitation

This paper describes a method for determining the density of contact trace objects with magnetic levitation (MagLev). MagLev measurements accurately determine the density (±0.0002 g/cm³) of a diamagnetic object and are compatible with objects that are nonuniform in shape and size. The MagLev device (composed of two permanent magnets with like poles facing) and the method described provide a means of accurately determining the density of trace objects. This method is inexpensive, rapid, and verifiable and provides numerical values—independent of the specific apparatus or analyst—that correspond to the absolute density of the sample that may be entered into a searchable database. We discuss the feasibility of MagLev as a possible means of characterizing forensic‐related evidence and demonstrate the ability of MagLev to (i) determine the density of samples of glitter and gunpowder, (ii) separate glitter particles of different densities, and (iii) determine the density of a glitter sample that was removed from a complex sample matrix.

关于油田基层班组成本核算的探讨

企业班组是生产经营管理的最小单元,企业生产经营如何搞好,班组成本管理是关键。班级成本核算作为企业实行成本核算的基础,只要不断完善基层班组核算制度,提高全员核算水平,把握住当前班组成本核算所面临的问题,通过建立科学合理的班组核算体系,逐步探索出一条适应企业基层核算的路子。     

盗窃虚拟财产研究——研究缘起、理论和现实意义及新路径

网络游戏产业已经成为互联网络经济中的一个重要组成部分,虚拟财产交易规模巨大,虚拟财产交易也被我国纳入税收征收对象范畴。盗窃网络游戏用户的虚拟财产案件频频发生,其社会危害性已达到甚至超出传统型盗窃犯罪之社会危害性,尽管我国法学理论界和实务界对于盗窃虚拟财产犯罪行为适用法律存在很多争论,但是笔者认为完全可以直接适用我国《刑法》盗窃罪予以规制。     

论网络虚拟财产的“财产”属性——以刑法规范为视角

随着信息技术的不断发展,“网络虚拟财产”已与现实的生活建立起越来越紧密的联系。如何保护网络虚拟财产在刑法上还是一个盲点。由此导致的社会问题也随之而来。网络虚拟财产具有财产属性和法律意义上的财产权性质,应当包括在刑法保护对象内。我国刑法应严格区分“财物罪”与“利益罪”。     

Child abuse: practical application of autopsy, radiological, and microscopic studies

A 17-month-old male infant died at home. The infant's right arm was immobilized because of a humeral fracture 1 month earlier. The circumstances of death appeared unclear to the police investigators and a medicolegal autopsy was carried out. External examination revealed diffuse ecchymoses of varying color. Postmortem imaging was performed prior to autopsy (X-rays, multislice computed tomography [MSCT], and focused brain magnetic resonance imaging [MRI]). These investigations revealed four rib fractures of varying ages, one of which was posterior. Cerebral and pericerebral traumatic lesions were also diagnosed: bilateral subdural hematomas, intraventricular, meningeal, and interpedoncular hemorrhages. In the abdomen, fresh blood was visible within the anterior abdominal wall and the mesenteric root. Autopsy and microscopic study confirmed these lesions. This case report illustrates the valuable assistance rendered by MSCT and MRI to diagnose abuse when a child has died in unclear circumstances.
