论船舶不当滞留在港口国的救济程序

由于各国标准的参差不齐及港口国官员的个人偏见,在港口国监控程序中难免出现船舶的不当滞留。通过对美国、加拿大、澳大利亚三国港口国救济程序案例的分析,指出现有港口国的救济程序中的缺陷,并讨论在船舶不当滞留时,船方如何通过港口国国内途径申诉,有哪些法律问题需要注意,如何更好地实现权利救济。     

国有控股公司:监狱集团企业体制改革的方向性模式

监狱集团企业在承担和不断强化相关法律和社会职能的前提下,如何有效摆脱若干体制障碍和功能束缚,以完全企业的组织形式和运行方式来适应社会主义市场经济体制,促进监狱可持续经济发展,是监狱管理体制改革的一个重点也是难点问题。从国有资产管理体制创新的角度分析,国有控股公司理应成为未来监狱集团企业管理体制的一种主流模式,同时,未来监狱集团企业将由国有独资模式逐步向投资主体多元化方向发展。对此,本文提出了监狱集团企业改制的现实路径和实施方案。     

Acting small in a large state's world: Russia and the Baltic states

The interest in small states ebbs and flows as important international affairs include small states. Russia's actions and policies vis-à-vis Ukraine, and the resultant intensified apprehension among Russia's smaller neighbours, aim the proverbial microscope at the size and power discrepancies between states. Russia, by most metrics, is a large state and the Baltic states, by those same metrics, are small states. Small-state scholars expect large and small states to act differently. However, the case of Russia and the Baltic states indicates that large and small states do not, in fact, act all that different. This being the case, this article calls into question many of the assumptions made by small-state scholars about the difference between large- and small-state action and argues for changes within small-state studies as a subdiscipline of the larger international relations discipline.     

习惯如何成为习惯法及其方法论意蕴——两种认可说的比较分析

习惯如何成为习惯法的问题必须从界定"习惯"、"习惯法"这对概念入手,而不同的定义将在很大程度上决定人们对该问题的态度或立场。社会认可说与国家认可说是人们在回答上述问题上的两种立场或学说,它们背后各自隐藏着一幅研究者据以解释经验事实的理想图景。其中国家认可说与文化研究中的"大传统"模式、制度研究中的"现代化"范式相互支持,极大地阻碍了习惯法研究。上述讨论启示我们,在习惯法研究中必须确立正确的方法论立场,才能比较客观地还原习惯法的本质和拓展习惯法研究的深度。     

No exceptions: authoritarian statism. Agamben,Poulantzas and homeland security

This article outlines and compares two different ways of making sense of counterterrorism and the configuration of political power in its context. Against the backdrop of US homeland security, it first outlines Agamben’s thesis on the permanent state of exception. Despite its resonance with key aspects of homeland security, this thesis is found to be analytically limited and theoretically brittle. To overcome its shortcomings and provide a better understanding of contemporary organisation of political power, a strategic-relational approach is suggested, derived from Poulantzas’s state theory.     

宅基地管理与物权法的适用限度

对土地管理制度的既有讨论,通常是从宪法第10条出发,没有考虑宪法第6条对"生产资料的社会主义公有制"的规定,将"国家所有"与"集体所有"片面理解为民法所有权而忽视其所有制内涵。物权制度是所有制关系的法律反映,"生产资料的社会主义公有制"是超越新中国历部宪法和其它具体法律的基本宪法原则,运用物权规则完善宅基地管理制度,需以公有制为大前提。忽视公有制前提的物权化改革建议,陷入"私法‘宪法中立",的认识误区,加上对宅基地经济社会属性的误会,所提出的改革方案缺乏法理与现实依据。现有制度在实现社会财富公平分配、公共资源有效管理和农民权利保护等方面基本有效,下一步改革只需做局部调整而无需全盘重建。     

Child protection as surveillance of African American families

The over-representation of black children in US out of home care results from racial bias in placement decisions and a political choice to address startling rates of child poverty by investigating parents instead of tackling poverty's societal roots. The impact of state disruption and supervision of African American families is intensified when it is concentrated in inner-city neighbourhoods – the system's ‘racial geography.’ A small case study of a black neighbourhood in Chicago with high rates of out of home placement found profound effects on both family and community social relationships, as well as reliance on child protective services for financial assistance, linking surveillance of black families to the neoliberal shrinking of public programmes. The surveillance of African American women by the child welfare system is also intensified by these women's disproportionate involvement in the prison system. Acknowledging racial bias in child welfare reveals the need to radically transform the system from one that relies too much on punitive disruption of families to one that generously supports them.

文章通过对黔东南州市场监管中非国家法诸因素进行调研,使用法社会学的理论框架分析,展示要素、结构和性能各层面的冲突和相互影响,为民族地区国家法的执行研究提供了一定的现实素材,并尝试性提出了解决民族地区国家法的执行需要在民族区域自治法框架内,充分考虑新时代民族地区诸因素作用,方能有效解决民族地区法律秩序以及社会治理问题。
