The ideas of the new generation of religious intellectuals in Iran have been the main engine for the call for reform. These intellectuals have attempted to locate their views about the way women are and should be treated in Islamic societies in their much broader—and to them more significant—attempt to offer a modernist religious understanding and a more democratic reading of the role of religion in modern polity. Iranian feminists, on the other hand, have begun to insist that the particular situation of women in Iran is in need of more attention. Religious intellectuals have responded by engaging in reluctant analysis of the way the woman question poses itself in the Iranian context. So far, their analyses fail to take into account the gender implications of the struggle against absolutism and traditional authority. However, the dynamic interaction of the reform project with demands and aspirations of various sectors of Iranian public life will not allow the issue to rest here. Religious intellectuals, in their attempt to recreate essential religious truth in the form of new intellectual concepts and systems, will increasingly have to deal with systemic gender inequalities in a more systematic manner.  相似文献

This note examines the judgement of the House of Lords in the cases of Islam andShah, particularly with regard to their conclusion that women in Pakistan who were victims of domestic violence and not protected by their state could qualify as members of a particular social group under the Geneva Convention, and therefore attain refugee status. The note considers the Refugee Women's Legal Group's Gender Guidelines for the Determination of Asylum Claims in the U.K. and discusses the problems faced by women who claim refugee status. Finally, the conceptualisation of domestic violence as a political issue and therefore a matter falling within the scope of the Convention issue is analysed. The paper presents a study conducted among 173 Turkish medical students, which examined their beliefs about wife beating through a self-administered questionnaire. An integrative conceptual framework was tested as the basis for explaining the students’ beliefs. The results revealed that between 4.5 and 38.7% of the participants justified wife beating, between 3.5 and 5.3% of them tended to believe that battered women benefit from beating, and between 4.7 and 28.5% of them tended to believe that battered women are responsible for their beating. In addition, between 68.4 and 90.6% of the students expressed willingness to help battered women, and although nearly half of them perceived the violent husbands as responsible for their behavior, only about one-quarter of them supported punishing violent husbands. The results also indicate that significant amounts of the variance in students’ beliefs about wife beating can be attributed to their patriarchal ideology toward family life and to their exposure to family violence during childhood and adolescence. The paper concludes with a discussion of the implications of the results for future research, theory development, and training of medical students. Both authors contributed equally to this paper. Trafficked women are used and consumed in different ways and by different users in Australia. They are used by the traffickers and by the consumer of the destination country. They are used as prosecutorial tools by the national criminal justice agents. They are used by the national politicians to pursue border control policy objectives and to be seen as abiding by international protocols. In all these uses, the identity of the trafficked woman is formed and shaped to fit the users’ need. However, these women’s otherness and abjection is constantly maintained and reinforced. They are used as a commodity. Meanwhile, the discussion on the demand side, and the consequent responsibility of the destination country, is virtually omitted. This paper will raise the question of how the socio-legal analysis and discourse would evolve if a literal interpretation of trafficking women as a commodity was taken into account, exploring an international trade approach. The social construction of trafficked women as a commodity has been identified and criticised by academic scholars, NGOs’ and UN’s rapporteurs. By pursuing this line of approach, the destination country is forced to take more responsibility for how the woman is demanded within its territory. As a consequence of this international trade approach, the State should deliver equality and non-discrimination. Rather than being a cynical application of a trade framework to trafficked women, this approach aims to highlight the paradox of such a situation in legal terms. It is highlighted that approaching trafficked women from this legal and jurisprudential way may offer more possibilities to expand their claims against the State. Currently, in Australia, when a trafficked woman is located by the State, she would attract limited and temporal rights, her being the ‘other’ as well as an abject entity remains, notwithstanding the fact the she was imported because there is a demand within the territory.  相似文献
