§ 234 ZPO gilt nicht für das Exekutionsverfahren. Steht einem betreibenden Gl?ubiger einer R?umungsexekution der titulierte materiellrechtliche Anspruch wegen Ver?u?erung der Liegenschaft nicht mehr zu, so kann Oppositionsklage in analoger Anwendung des § 35 EO erhoben werden, wenn etwa der Gl?ubigerwechsel (noch) nicht nach § 9 oder § 10 EO geltend gemacht worden ist und ein Parteiwechsel im Exekutionsverfahren deshalb noch nicht stattgefunden hat. Nicht bei jeder R?umungsexekution ist ein Verm?gensnachteil iSd § 44 EO offenkundig. Zur Einseitigkeit des Rechtsmittelverfahrens nach der EO.

Die grundbücherliche Berichtigung nach § 136 GBG setzt eine nachtr?gliche Rechts?nderung (hier: WE-Begründung auf Grund einer Widmungs?nderung des WE-Objekts) voraus. Ein baubeh?rdlicher (= ?ffentlich-rechtlicher) Bescheid vermag den privatrechtlich erforderlichen Widmungsakt des WE-Objekts durch die Mit- und Wohnungseigentümer nicht zu ersetzen.     

Improved method for DFO development of latent fingerprints

A new formulation has been developed for DFO stock solution. The working DFO solution, based on the new stock solution, appears to be more stable, has a longer shelf life, and has little effect on inks (and therefore does not cause inks to run). Photoluminescence spectra of latent fingerprints developed with DFO reagent have been measured and the choice of filters for excitation and emission (barrier) have been derived from these measurements. Comparisons of latent fingerprints developed with ninhydrin and DFO have been made using various papers and at various intensities. These comparisons show the much greater sensitivity of DFO developed latent fingerprints. Although enhanced ninhydrin and DFO develop latent fingerprints with similar sensitivity, the DFO process is much simpler.     

QSZ92式9mm手枪射击弹壳击针痕迹次种类特征的研究

目的研究QSZ92式9mm手枪击针在生产加工过程中潜在的次种类特征,以区别于个体特征。方法用超景深体式显微镜对特定工序连续生产加工的10件QSZ92式9mm手枪击针的射击痕迹进行观察比对。结果不同击针形成的击针痕迹痕底特征具有特定性,而痕壁特征中的同心圆状或圆弧状加工痕迹具有相似性,属于次种类特征。结论同一认定过程中不能将击针痕迹中的同心圆状或圆弧状加工痕迹作为个体特征使用。     

Mais Médicos: Cuba's Medical Internationalism Programme in Brazil

In 2014, at the request of the Brazilian government and under the sponsorship of PAHO, the Cuban government sent 11,400 doctors to work in underserved areas. This article examines the origins and development of this programme, Mais Médicos. The significance of this programme is explored, as well as what it illustrates about south‐south cooperation as a whole.     

EgM家族蛋白诱导犬免疫应答动态ELISA检测方法的建立

为建立用重组GST融合EgM家族(EgM9和EgM123)蛋白和GST蛋白免疫的犬血清中由靶蛋白(EgM家族)产生的特异性抗体的检测方法,用GST融合EgM9和EgM123蛋白及GST蛋白为抗原,辅以弗氏佐剂分别免疫试验犬3次,100μg/只,并设GST蛋白组和PBS组为对照。三免后第2周,用羊源原头蚴进行口服感染,25 000枚/只,每周采血直至感染后第45天,以GST融合EgM9和EgM123蛋白包板,用中和反应处理血清中由GST蛋白和大肠杆菌产生的抗体,之后用间接ELISA和Western-blot方法检测血清中IgG、IgM和IgA的水平。结果显示,预处理的犬血清能去除GST蛋白和大肠杆菌诱导的抗体。二免后IgG和IgM水平达到峰值,IgG应答水平随免疫和感染仍能保持高应答水平。三免后IgG应答水平未提高。第三次免疫后IgM应答水平逐渐下降。IgA产生低的免疫应答,随免疫刺激和感染没有显著的变化。结果表明,EgM9和EgM123靶蛋白免疫犬能产生高水平的免疫应答,说明用吸收非特异性抗体监测特异性抗体的方法是可行的。     

False Positives Observed on the Seratec® PSA SemiQuant Cassette Test with Condom Lubricants

Abstract: In the course of the validation of a new component of the prostate‐specific antigen (PSA) SemiQuant Cassette Test marketed by Seratec^®, a false‐positive reaction was observed when testing samples collected from the surface of unused, lubricated condoms. A variety of personal lubricants and condoms were tested to determine the frequency of the false positive, as well as its potential source. Samples were extracted in both water and the manufacturer‐provided buffer, and the test was performed according to the manufacturer’s suggested protocol. The false positive was observed intermittently, but occurred consistently with samples containing nonoxynol‐9, a strong detergent utilized as a spermicide. The reaction may be attributable to the combination of latex and nonoxynol‐9. Because of the unreliability of the test to confirm the presence of PSA in samples collected from condoms, the PSA cassette is an unsuitable method for confirming the presence of seminal fluid in condoms.     

大鼠脑外伤后脑组织MMP-9的表达与损伤时间相关性

目的观察大鼠脑外伤后脑组织MMP-9的表达规律,探讨其在损伤时间推断中的应用价值。方法健康SD大鼠75只,随机分为损伤组、假损伤组和正常对照组。损伤组采用自由落体方法建立脑损伤模型;致脑损伤后分10个时间点,采用HE染色观察损伤区的变化,采用免疫组化方法检测各时间点阳性细胞的种类和比值,并与假损伤组和对照组进行统计分析比较。结果免疫组化染色显示损伤组伤后1h可见中性粒细胞阳性着色,6h后可见神经细胞阳性染色并逐渐增强,伤后5d阳性细胞数达到峰值,而后开始减弱,14d基本消失。假损伤组和正常对照组未见阳性表达。将实验组中2h～7d阳性细胞比值与其它各时间点相比,差异有统计学意义(P<0.05);实验组各时间点与假损伤组和对照组相比,差异均有统计学意义(P<0.05)。统计分析结果见表1。结论损伤后MMP-9阳性表达的规律性,有望成为脑损伤时间判定的参考指标。     

Ripening Within? Strategies Used by Rebel Negotiators to End Ethnic War

This article explores what strategies rebels use to prepare their ethnic community for negotiated peace. Proposed strategies are distilled from relevant theory and systematically investigated in case analyses of peace negotiations in Sri Lanka, Indonesian Aceh, and Senegal. The empirical findings indicate that although a coercive military capacity underpinned claims to ethnic representation, coercion did not dominate during the prenegotiation phase. During negotiations, noncoercive persuasion, as well as collective and selective incentives, clearly dominated. Moreover, the most important measures were internal to the negotiating rebel group. The successful rebel negotiator appeared to “mobilize in reverse” by initially targeting the core of military leaders followed by competitor groups and constituents. The article systematically examines across cases what measures rebel negotiators have used to “ripen” their own community, how these measures have been sequenced, and against whom they have been directed. The findings have important implications for the concepts of ripeness and prenegotiation and their requirements. The study underscores in particular the relevance of rebels9; nonviolent commitment signals, something that has been largely overlooked in the research on nonstate armed actors. The policy implications suggest the possible benefits of third‐party assistance to efforts to promote communication, public outreach, and procedural transparency on the nonstate side in connection with peace talks.
