Self-control Depletion and the General Theory of Crime

Criminological research on self-control focuses mainly on self-control failure. Such research has not, however, investigated the consequences of exercising self-control for the individual doing so. The present study investigates this issue within the framework of both criminological self-control theory and research on self-control depletion from social psychology, which depicts self-control as akin to a “muscle” that is “depletable” by prior use [Muraven and Baumeister (2000) Psycholog Bull 126:247–259]. Results are presented from a laboratory experiment in which students have the opportunity to cheat. Both “trait self-control,” as measured by the Grasmick et al. [(1993) J Res Crime Delinq 30:5–29] self-control inventory, and “self-control depletion” independently predicted cheating. The implications of these findings are explored for criminological perspectives on self-control and offender decision-making.

对《刑法》第277条有关问题的认识

新《刑法》第277条的规定及该条规定在适用过程中存在以下问题:1郾两高司法解释对该条确定的罪名不当,应确定为四个罪名,即阻碍国家工作人员执行职务罪,阻碍人大代表执行职务罪、阻碍红十字会工作人员履行职责罪和阻碍执行国家安全工作任务罪;2郾该条第4款在刑法理论及逻辑上存在矛盾,应将阻碍安全工作任务罪与拒绝履行国家安全义务罪分列。另外,新《刑法》第242条的规定纯属多余,应予删去。     

人道主义与性别意识对接后的尴尬--以《这里的黎明静悄悄……》为例谈人道主义的不彻底性

本文从小说《这里的黎明静悄悄……》入手,借助对小说文本的剖析,一路追问抽象模拟的人道主义理论在文艺作品中遭遇具体化、个性化、集中化处理时,不得不直面的尴尬:创作主体由于无法超越的性别定位,使人道主义与性别意识的话语对接在艺术层面造成断裂的遗憾。在这种意义上的战争题材对于人道主义的表现,留下了深深的遗憾,即一半的人道主义。     

《红楼梦》双关语人名翻译中的归化与异化

双关语为文学作品中人物命名时较为常用的修辞手段。《红楼梦》双关语人名中双关语的构成,从归化与异化视角等方面对人名中双关语翻译策略与方法进行分析与阐释,并就两个全译本在双关语人名翻译中的归化与异化进行分析与比较,在翻译过程中有深刻的文化意识,即意识到两种文化的异同。具体的翻译方法应视具体情况而定。归化与异化有相互对立的方面,但是最终的方向应该是互补的。     

论刑法中不作为之行为性

不作为具有自然的和法律上的不同内涵,对二者的正确辨析是解释其行为性的基础。然而当前各行为理论对不作为之行为性的阐释皆有缺失。跳出传统存在论的窠臼,从社会规范和法价值的角度评价,刑法中的不作为是具有社会意义的;违反法规范的行为,体现的是行为人的目的和主体人格。

婚内有奸：基于法学视角的思考——兼与张明楷教授商榷

宪法和婚姻法规定夫妻双方权利平等,意味着性权利平等,妻子享有性自由权。警从刑法典自身、立法解释、司法解释和我国法律体系的和谐来看,刑法236条没有排除妻子为强奸罪的犯罪对象。否认婚内有奸,不符合犯罪的认定标准、不符合立法的逻辑、不利于降低社会成本和代价、不利于保护少年的身心健康。“婚内有奸”并非是惩罚丈夫的工具,而是妻子合法权益的证明。     

Determination of triptolide and wilforlide A in biological samples by LC-MS/MSCSCD

Objective: To determinate triptolide and wilforlide A in biological samples by liquid chromatography-tandem mass spectrometry (LC-MS/MS) method and to verify the method. Methods: After 0.4 mL blood, urine or 0.4 g hepatic tissues with internal standard were extracted by ethyl acetate, they were separated on a Allure PFP Propyl (100 mm × 2.1 mm, 5 μm) with a mobile phase of methanol-20 mmol/L ammonium acetate using gradient elution. For mass spectrometric detection, electrospray ionization (ESP) in positive mode was elected and the data was collected using multiple-reaction monitoring (MRM). Results: The linearity was good (r>0.9950) and the limit of detection was 2 ng/mL or 2 ng/g for triptolide and wilforlide A. The recovery was 61.08%-102.98%. The intra-day and inter-day precision was less than 12.58% for each biological sample, and the accuracy was 90.61%-105.80%. Conclusion: This method is simple, convenient and good selective, and could be applied to analysis of triptolide and wilforlide A in different biological samples. And the method may provide technical support for forensic medicine identification, clinical diagnosis and treatment of tripterygium wilfordii Hook. f. poisoning. © 2015 by the Editorial Department of Journal of Forensic Medicine.     

BAT在非离子型造影剂过敏反应中的诊断价值

目的通过测定免疫正常人、β-内酰胺类药物过敏者以及非离子型造影剂过敏者血液中CD63、肥大细胞羧肽酶A3(MC-CPA3)、人末端补体复合物SC5b-9,探讨嗜碱性粒细胞活化试验(basophil activation test,BAT)在非离子型造影剂过敏反应中的诊断价值。方法采用流式细胞术测定全血中嗜碱性粒细胞CD63表达率。采用ELISA法测定血清中MC-CPA3、血浆中SC5b-9含量。结果非离子型造影剂和β-内酰胺类药物过敏者血液中嗜碱性粒细胞CD63表达率、MC-CPA3以及SC5b-9含量均较免疫正常人升高(P0.05)。结论非离子型造影剂过敏者血液中嗜碱性粒细胞和肥大细胞发生活化,补体系统的激活也参与了非离子型造影剂过敏反应的发生。流式细胞术分析BAT可作为非离子型造影剂过敏反应的诊断方法。
