在风险社会和信息社会的复杂需求下,行政机关需要多元化处罚种类,但这一直受制于我国《行政处罚法》第8条的保守立场。应当明确,试图以该法第8条限制处罚种类既不现实,也没有必要,只会创造更多的“法外行为”并限制地方政府的执法创新。立法机关应秉承更为开放的观念,通过修法实现行政处罚种类的多元化。首先,应考虑在该条添加行政处罚的概念条款,以“行政制裁”、“违法行为”、“基于威慑目的”三项要素澄清行政处罚的本质,明确行政处罚的概念族群,剔除长期以来的争议行为;其次,在概念条款的指引下,着手修订现行列举性条款,设计更为开放的分类条款和兜底条款,授权规章在处罚种类上的创设权,提供可供法律解释的文本依据,扩大我国《行政处罚法》的规范容量,丰富处罚种类;最后,基于控权需要,应运用层级保留技术对我国《行政处罚法》第12条第2款、第13条第2款做配套修订,将分类条款和兜底条款限定在可控范围之内,从而防止处罚种类的多元化异变为失序化。 相似文献

In recent years, neoliberalism has become an academic catchphrase. Yet, in contrast to other prominent social science concepts
such as democracy, the meaning and proper usage of neoliberalism curiously have elicited little scholarly debate. Based on a content analysis of 148 journal articles published from 1990
to 2004, we document three potentially problematic aspects of neoliberalism’s use: the term is often undefined; it is employed
unevenly across ideological divides; and it is used to characterize an excessively broad variety of phenomena. To explain
these characteristics, we trace the genesis and evolution of the term neoliberalism throughout several decades of political
economy debates. We show that neoliberalism has undergone a striking transformation, from a positive label coined by the German
Freiberg School to denote a moderate renovation of classical liberalism, to a normatively negative term associated with radical
economic reforms in Pinochet’s Chile. We then present an extension of W. B. Gallie’s framework for analyzing essentially contested
concepts to explain why the meaning of neoliberalism is so rarely debated, in contrast to other normatively and politically
charged social science terms. We conclude by proposing several ways that the term can regain substantive meaning as a “new
liberalism” and be transformed into a more useful analytic tool.

Abstract This article will analyse the challenges facing the Common Security and Defence Policy (CSDP) through an evaluation of the impact that differing member state strategic cultures have on the EU Battlegroup Concept, highlighted through the examples of Germany and Poland. The concept was initiated to give the EU an increased rapid reaction capacity. However, as emphasised through the cases of Germany and Poland, divergences in EU member states' strategic cultures remain, including when, where and how force is used. When this is combined with the cost of plugging military capabilities' gaps, the political willingness to deploy a Battlegroup can be affected. Whilst the article highlights that the role that member states want to play within CSDP as well as international expectations can override constraining factors, the Battlegroups rely on a rotation system. As some member states are more willing to deploy the Battlegroups than others, the concept risks becoming a declaratory policy thus undermining CSDP. 相似文献

目前民警在执法活动中主要存在四种消极作为现象:失职不作为,违规乱作为,茫然不知为,作为不到位。公安执法消极作为的原因既有作为人执法思想不端、执法素能不高的主观因素,也有执法监督不力、执法环境不佳的客观因素。公安机关要把党的方略、历史任务和先进理念体现在权力运行上,树立人民警察以人为本、执法为民的理念,进一步解决公安执法消极作为问题。 相似文献
