浙江省温岭市在非公企业领域开展的职工医疗互助保障活动，有效地缓解了农民工“看病难、看病贵”的问题，得到政府、企业和农民工的认可，为建立农民工医疗保障制度提供了可借鉴的思路。     

关于乌鲁木齐“7·5”事件的若干思考

“7·5”事件给人民群众生命财产造成了严重损失，对新疆的经济发展政治稳定产生了巨大影响。为了使悲剧不再重演，我们必须反思，要进一步采取措施打牢民族团结的基础。要强调国家整体利益和公民意识，要把法律手段作为处理民族问题、民族关系、民族矛盾的重要手段。     

论“国家工作人员”的界定与完善

现行刑法关于“国家工作人员”的规定仍不完善，主要体现在不能清晰地界定国家工作人员的范围，执法中引发诸多争议。尽管全国人大常委会和高检、高法颁布了很多立法、司法解释，仍不能解决立法上存在的问题。究其原因，现行刑法对“国家工作人员”立法标准上的不统一，导致了执法中产生分歧。笔者建议，国家工作人员的范围应以“职责论”重新界定。     

国际投资协定中非歧视待遇的适用阶段与例外——兼议中国之对策

非歧视待遇包括国民待遇和最惠国待遇,是许多国际投资协定和与投资有关的协定明确规定的最重要的外国直接投资待遇标准,也是国际投资自由化的关键因素。各协定对其适用的时间范围存在较大分歧,焦点在于非歧视待遇是否适用于投资准入前阶段以及允许缔约国保留哪些例外。

加强党在民族工作方面的执政能力建设是提高党的执政能力的重要方面,也是党在新世纪解决好民族问题的现实要求。按照新时期党的建设的战略部署,党在民族工作方面的执政能力建设也需要从五个方面来不断提高和完善。     

National parliamentary control and voting in the Council of the European Union

This article explores the different ways governments express dissent in the Council of the European Union (EU) through ‘No’ votes, abstentions and recorded negative statements. A game-theoretical model is presented that studies voting behaviour and analyses how the national parliaments’ levels of control over their governments’ EU policies affect it. It is concluded that governments that are strongly controlled by their parliaments are not more likely to express dissent. However, when they do express dissent, they vote ‘No’ more often. Parliamentary control depends on the presence of formal oversight institutions as well as the motivation of parliamentarians to hold their governments accountable. Empirical support is found in an analysis of votes on 1,387 legislative proposals that represent more than a decade of Council decision making in the period 2004–2014. This article contributes to the discussion on the involvement of national parliaments in EU affairs, and clearly distinguishes the different forms of dissent in Council decision making.     

Venue Preference and Earthquake Mitigation Policy: Expanding the Micro‐Model of Policy Choice

Seismologists have reported that a majority of recent earthquakes in Oklahoma have been triggered by the activities of oil and gas companies. Despite this fact, there is evidence of strong opposition toward earthquake mitigation policy. In this article, we argue that how individuals define issues affect their policy choice. Furthermore, we incorporate the concept of venue shopping from the literature on macro theories of the policy process to investigate the effect of problem definition in shaping individual venue preference for policy choice. Using unique survey data, we find that problem definition, particularly issue causality and issue image, is strongly related to individual support for earthquake mitigation policy. However, a more nuanced relationship between individual problem definition and venue preference is observed. Our findings contribute to scholarly endeavors to understand the politics of problem definition at an individual level, which may be the precursor of understanding policy choices at the institutional level.     

论ICSID仲裁庭对公平公正待遇标准的发展——兼评AES Summit、AES-Tisza诉Hungary案

近年来,国际投资争端中的公平公正待遇标准在ICSID仲裁庭的实践中有了一定的发展。文章首先按时间顺序分阶段梳理该仲裁庭对公平公正待遇标准的界定,随后结合最新的裁决实践,评价公平公正待遇标准要素的发展现状。在此基础上,试图寻找仲裁庭对公平公正待遇标准要素的发展特征。在把握公平公正待遇标准内涵发展趋势的前提下,我们应积极思考并研究我国及投资者的相应对策。     

民族自治地方变通立法与经济特区变通立法比较研究

立法变通权是我国法律赋予民族自治地方和经济特区特有的权力。民族自治地方变通立法是基于国家基本政治制度之一的民族区域自治制度的职权立法。经济特区变通立法是为了改革和发展需要,由全国人大授权经济特区的授权立法。二者在客观依据、法律性质、立法主体、权限、范围和程序等方面都存在着显著差别。
