我国《民法总则》规定了依然较短的3年普通诉讼时效期间,与《民法通则》相比只进行了微调,恐怕与如下三个认识不足或误区有关。第一,低估了普通诉讼时效期间过短对其他诉讼时效规则造成的严重困扰。第二,片面理解了所谓“诉讼时效短期化趋势”,过高估计了我们应对“诉讼时效短期化”的意愿和能力。第三,忽视了我国诉讼时效制度的道德性难题和“折扣执行”困境。我国普通诉讼时效期间的设定应坚持体系化思路,关注中国国情,立足长远,统筹规划。  相似文献

Abstract

This article examines labour organisation in Gibraltar and its hinterland from c.1914 to 1921. It demonstrates that the traditionally strong links which had existed between organisations in Gibraltar and neighbouring Spain, links based upon a shared belief in anarchist ideas and practices, had, by 1921, broken down due to the adoption of gradualist and constitutionalist politics and industrial relations by workers on the Rock. Two principle agents drove this change. First, in 1919, the British Workers’ Union established a branch in Gibraltar which successfully worked to establish itself as principle negotiator and representative of workers on the Rock. Second, a reforming governor in Gibraltar undertook to open up political spaces in Gibraltar which offered the potential to work with, rather than against, the state in the colony. By the end of the period, anarchism, and anarchist ideas, was not extinguished in Gibraltar, but they would never again serve as the inspiration for industrial and political campaigns on the Rock, much to the delight of both Gibraltarian employers and the British colonial authorities. This case-study invites further consideration of how British style trade union activity in the empire displaced indigenous forms of organising, a subject which has heretofore received scant attention.  相似文献

This paper explores the European Commission’s proposal for a new Regulation to update and reform data protection law in Europe. As regards the Regulation itself, without presenting an exhaustive analysis of all the provisions, this paper aims to highlight some significant changes proposed to the data protection regime by comparison between Directive 95/46 and the proposed Regulation. It takes particularly into account legislative innovation concerning data protection principles, data subjects’ rights, data controllers and data processors obligations, and the regulation of technologies. Before analyzing these innovations, it introduces some considerations about the Commission’s choice to use a Regulation instead of a Directive to harmonize national data protection regime.  相似文献

Over the past years since the signing of the Rome peace Accords, Mozambique has generally been regarded as an exemplary African post war success story. However, events in the last four years illuminate something different. This article will show that the low intensity but violent clashes between FRELIMO government forces and former rebel group RENAMO are not just a mere manifestation of Mozambican’s government inability to consolidate post war gains. These clashes could be framed and located within the broader context of complexities associated with transforming a peace Accord into a genuine and sustainable postwar peace dividend. It seems the success was largely registered in terms of reducing direct violence by creating negative peace. Even though negative peace was good, it was unfortunately not adequate. This article also argues that the success narrative lulled many including Mozambicans into ignoring fissures in the area of structural violence which effectively limited the country’s ability to progress towards positive peace. Despite all this, however, this article will concur with the belief that an outright full scale war is still highly improbable, but not impossible because RENAMO is still capable of spoiling and eroding the registered post war gains.  相似文献

Local government election results are used to estimate a national equivalent vote that provides the basis for a general election forecast. By-elections provide the means for calculating weighted quarterly averages of national support. These show trends similar to those obtained by national polls. By-election results in the three month period leading to the general election contribute towards the national vote share calculation and seat distributions are determined by uniform national swing. Additionally, results from the main council elections from 2011 onwards are aggregated to the parliamentary constituency level and used to estimate each party's relative performance in key target seats. This information is used to fine-tune the final seat forecast which suggests a hung parliament is the most likely outcome.  相似文献

《欧陆法律史概览:事件、渊源、人物及运动》是美国法学院协会"大陆法史系列丛书"中的第一卷。此书除第一编、第九编外,其他七编均以国别为经,又以各国法律发展中的主要时期为纬,描述各国法律发展中的几大要素,即事件、渊源、人物及运动。在很大程度上,它不仅是一部介绍欧陆各国(不包括斯拉夫法系、拜占庭法系及匈牙利法系)法制史概况的书籍,还是一部法学史作品。意大利法、瑞士法、斯堪的那维亚法及西班牙法等内容研究角度别致,内容新颖。本书的用功最勤之处,不在于它的理论建构,而在于其正本清源,旨在说明什么是真的法律史。法学译著应该注意主要遵循"名从主人"、"约定俗成"、"服从主科"和"尊重规范"等翻译原则。  相似文献
