《香港基本法》解释的权限和程序问题探析

《香港基本法》是全国的宪法性法律,是香港特区的根本法。为了落实"一国两制"的精神,《香港基本法》的规定其解释权属于全国人大常委会,同时《香港基本法》规定全国人大常委会可以授予香港各级法院附条件的《香港基本法》解释权,由于二者的立场、视角、法律传统和利益存在着一定的分歧,因而在立法解释模式和司法解释模式之间存在一定的冲突与碰撞。《香港基本法》在解释主体、权限和程序设定方面存在一些问题,在实践中也引发了宪法危机,因此,应该针对存在的问题,逐步加以完善。     

香港族裔经济中的印尼华侨与华人

20世纪七八十年代,有不下20万的印度尼西亚华侨自中国内地迁居香港;而近30多年来,印尼家务工人亦接踵而至,其在香港的人数现已超过13万人。这两群看似毫不相干的移民,在21世纪全球化以及区域移民的大语境下相遇,共同构建了香港经济活动中奇特的族裔景观,具体包括印尼食品店、服装店、手机店、家具店等等。基于文化背景、语言条件以及香港公民身份等因素,第一代印尼归侨以及千禧年前后开始定居香港的印尼华人或自己充当雇主,或在族裔经济中担任雇员,自然而然成为在港印尼族裔经济的先驱者与主要获利者。本文根据2013年到2016年初的田野调查和深度访谈,梳理在港印尼华侨华人的移民背景以及类别,探讨印尼华侨华人如何在印尼家务工人移民潮的推动之下,启动他们的族裔资源,使之成为具有商业用途的资本,从而促进了过去十多年来香港印尼族裔经济的蓬勃发展。     

Cognitive mobilization and electoral support for the Democratic Party in Hong Kong

The bases of electoral choice vary. Citizens differ in their ability to reason and make up their minds in different ways. Hong Kong appears to be the most likely case for the idea of cognitive mobilization, because of the the absence of socio-economic mobilization, the paucity of political mobilization, the novelty of partisanship, the high level of education, and the prosperous and easily accessible mass media. Findings on the legislative election in 1998, however, show that partisan attachment remains a powerful factor in electoral choice. Still, political information is more important as it broadens the basis of electoral choice. Specifically, the less-informed voters voted for the Democratic Party (DP) solely on the basis of partisan attachment. In comparison, the vote of the better-informed voters was broadly based, with evaluative factors overtaking partisanship in importance. This paper provides a contribution to the understanding of constrained elections in a partial democracy.     

内地与香港特区司法协助问题研究

内地与香港的司法协助是一个主权国家之内的区域性司法协助 ,是一个主权国家内部的司法联系。内地各省、市、自治区是与香港进行司法协助的主体 ;司法协助应当坚持“一国两制 ,着重现实 ,促进发展”的总原则 ;司法协助的地域范围包括香港与内地省、市、自治区及香港与澳门、台湾之间 ;司法协助的机关应是司法机关 ,协助协议应规范化     

美国并吞菲律宾过程中在香港之部署——以美国领事活动为中心

香港沦为殖民地后,美国在港活动愈趋频繁。时至美西战争前夕,美国驻香港总领事的委任及其活动为美国军事行动提供了重要支援;在港英当局奥援下,美国方面对菲律宾香港委员会开展舆论、情报及司法等斗争,并思考战后如何利用华人开发菲岛;为策应香港部署,广州、上海、新加坡与马尼拉等地美国领事与香港展开合作,加速并吞菲律宾。上述行动构成美国在东南亚扩张的重要环节,香港成为美国在远东扩张之战略要点,是菲岛以外不见硝烟的"战场"。     

The first and last signs of Main Street: semiosis and modality in California and Hong Kong Disneylands

Main Street is an indelible image in the American consciousness made hyperreal at Disneyland California in 1955. For subsequent parks in Tokyo and Paris, Disney recontextualized Main Street, but Hong Kong Disneyland’s version was formed as a copy of the California original. This copy demonstrates that transference of a structural form to a new cultural context is not a guarantee of the concomitant transmission of the originating culture’s sensory modality. The arising dissonant tension between the form (signifier) and substance (signified) of Hong Kong’s Main Street has led to its ongoing semiosis due to local cultural and corporate pressures. This paper presents a framework to analyze this dissonance and semiosis through comparison of external and internal photographs of the same eight landmarks at both parks. The problem of transferring meaning into a new cultural context for an international sign suggests Hong Kong’s Main Street could be the last that Disney constructs.     

Fatal pulmonary embolism:: A comparative study of autopsy incidence in Hong Kong and Cardiff, Wales

All autopsy reports from 1990–1994 inclusive of the Department of Pathology, University of Hong Kong and the Wales Institute of Forensic Medicine were examined and cases of death due to massive pulmonary embolism were noted. The incidence of this condition was calculated and found to be insignificantly lower in the Hong Kong series than the Welsh series by statistical analysis, both in the crude incidence in all autopsies and when correcting for different case mixes in the two locations. The majority of cases in both locations were in the over-60 age group. The study helps refute the longstanding belief among Hong Kong physicians that fatal massive pulmonary embolism is rare in Hong Kong (with approximately 98% Chinese population) in comparison with a predominantly Caucasian population.     

雪苑社与复社关系考辨

雪苑社是明末清初有着重要影响的著名文人集团,在它是否参加复社这一重大问题上,学术界存在着较大的分歧.雪苑社参加了复社的金陵大会及复社在北京组织的江北应社,其时间皆可考,因而雪苑社为复社分社可得到确证.雪苑社成员还参加了复社南京<留都防乱公揭>事件等重要活动,与复社重要成员亦有频繁的交往.在复社的系统格局方面,今人多恪守十六分社之说,此与实际情况并不符合,实有进一步研究之必要.     

试论我国内地、港、澳三地合同的法律冲突及其解决

我国内地、香港、澳门三地的合同法律制度有较大的差异,主要表现在合同的订立、合同的形式、合同当事人的能力等方面均有所不同,法律冲突在所难免。解决三地合同的法律适用问题的首要原则是意思自治原则,最密切联系原则应作为意思自治原则的补充,有些合同有其特殊性,可做例外处理,直接指出其应适用的法律。     

Prevalence of spouse aggression in Hong Kong

The present study explored the extent of spouse aggression in Chinese families in Hong Kong. Subjects were 246 female and 136 male undergraduate students who reported on the various forms of interparental aggression and violence. About 75% of the subjects reported interparental verbal or symbolic aggression and 14% indicated the use of physical violence between parents. In general, compared to mothers, fathers engaged in more verbal aggression against their spouses. Mothers were as likely as fathers to use actual physical force toward their spouses. Interparental responses to family conflicts did not vary with children's gender except that female subjects observed that fathers reasoned less but engaged in more insulting, throwing, smashing, hitting, or kicking things than mothers.
