村官职务犯罪的预防和控制

村官职务犯罪是指村官利用其职务的便利从事的渎职犯罪行为。村官职务犯罪在新农村建设中越来越多,涉及的金额越来越大,采用的手法日趋多样化。村官职务犯罪有诸多原因,为预防和控制村官职务犯罪,应强化法制教育,坚持村务公开制度,规范村财务制度,建立有效的监督制约机制,完善相应的法律条文内容。     

The End of Innocence: Open Justice,Free Speech and Privacy in the Modern Constitution – Khuja (formerly PNM) v Times Newspapers Limited

This case note explores the issue of open justice considered by Khuja (formerly PNM) v Times Newspapers Limited in the Supreme Court and argues that the current law is confused and incoherent. Far from settling the debate, it is suggested that the decision further undermines some of the key assumptions underpinning the current approach, especially in the light of the compelling and humane minority judgment. This leaves the area ripe for reconsideration in general terms. This note challenges many of the formulaic slogans and rhetoric in previous case law as well as suggesting that the meaning of open justice has been lost in current discourse. After summarising the facts, this note sets out the majority and minority judgments, before analysing some of the conceptual difficulties raised – particularly those of open justice, privacy, presumption of innocence and freedom of speech.

提高认识 加强对上海外来流动人口的管理

人口流动是市场经济发展和社会进步的必然趋势。外来流动人口对上海的建设和繁荣作出了贡献,但也对社会治安秩序带来了负面影响。上海应根据城市建设发展需要加强对外来流动人口的管理工作,正确处理好敞开城门与设置门槛的关系,搞好流入地和流出地的管理合作,在加强部门管理的同时发挥综合管理优势,使日常管理与集中整治、属地管理与自我管理相结合,做到既依法严格管理,又热情服务,努力提高上海对外来流动人口的管理水平。     

开放经济视角下的地区差异与经济增长—基于长三角的经验数据

长三角内部在实际利用FDI和经济发展水平上存在明显差异,上海、苏州遥遥领先于其他14个地区,内部统筹协调发展有待进一步加强;除上海、苏州之外,以实际FDI为标准划分的不同板块之间在经济发展水平上的差异并非想象中那么明显,其中利用外资规模较小的地区正呈现出民资替代外资的态势,经济发展的自主性和内生性趋势明显;浙江杭州湾地区和江苏中部地区有可能在未来成为长三角新的增长极和集聚中心,同已有的龙头共同支撑长三角经济的可持续发展。     

Presidential coattails, incumbency advantage, and open seats: A district-level analysis of the 1976–2000 U.S. House elections

This study extends the analysis of presidential coattails to the most recent U.S. House elections. Building upon previous research on this subject, it draws a clear distinction between open and incumbent-held seats and presents evidence about several measures of presidential coattails. In particular, the analysis attempts to estimate, controlling for incumbency, the strength of presidential coattails (the proportion of the vote received by a congressional candidate that is due to the presence of the presidential nominee on the ballot) and the effectiveness of a president's coattails (the number of districts gained or retained by a party because of the net influence of presidential candidates). The results show that, contrary to earlier findings and trends, the unique impact of presidential coattails in open seat races did not decline. The results also suggest that several representatives who played a very prominent role in crafting the Republican strategy to win back control of the House in 1994 were the beneficiaries of the coattail effect.     

Open parliament policy applied to the Brazilian Chamber of Deputies

ABSTRACT

This article will analyse the implementation of an open parliament policy that is taking place at the Chamber of Deputies, in accordance with the guidelines of the Open Government Partnership international programme (OGP), regarding the action plan of the Opening Parliament Work Group in particular, one of the subgroups of OGP. The authors will evaluate two blocks of initiatives for open parliaments executed by the Chamber in the last few years, that is, digital participation in the legislative process and Transparency 2.0, in order to observe their impasses and results obtained until now. In the first part the authors will study the e-Democracy portal and in the second part the authors will focus on open data, collaborative activities to use those data (hackathons) and the creation of the Hacker Lab, a permanent space dedicated to open parliament practices. The analysis considers the initiatives that the authors evaluated as part of the transformative and arena profiles of the Brazilian Parliament, according to Polsby's classification, with exclusive characteristics.     

Let's Make a Brand New Start of it in Old New York: Using Mediation to Resolve Open Adoption Disputes

There is no general consensus of how to handle disputes arising from open adoption agreements. Some states have statutes mandating mediation, but New York does not. This Note proposes that New York enact a statute that mandates adoptive and birth parents use mediation for disputes arising from open adoption agreements. The proposed statute provides a comprehensive approach to mediation by setting forth when mediation is appropriate and when it is not. The statute will also provide when the child's preference can be taken into consideration, and who will pay for mediation.
