Most international lawyers approved of the 1999 bombing of Serbia by the members of the North Atlantic alliance. But most of them also felt that it was not compatible with a strict reading of the UN Charter. The article describes the argumentative techniques through which international lawyers tried to accommodate their moral intuitions with their professional competence. The urge to achieve this, the article argues, arose from a general turn to ethics in the profession that has been evident since the end of the Cold War. This has often involved a shallow and dangerous moralisation which, if generalised, transforms international law into an uncritical instrument for the foreign policy choices of those whom power and privilege has put into decision-making positions.  相似文献

Neo-liberalism often reduces pluralism to a social fact based on the collapse of the big ideals that once claimed to stand in for the ideal of humanity. Tolerance of inevitable value diversity is all that can be offered by the rationalized modern western state. This understanding of pluralism is completely inadequate in the post colony. Ernst Cassirer offers a philosophical understanding of symbolic plurality that allows us to respect divergent symbolic forms, including myth and religion. This understanding of pluralism opens the space for respect for the customary law and the great indigenous ideals such as uBuntu which has often been denigrated as mythical and thus outdated or, worse yet, not law at all. This denigration is inseparable from colonial violence, and demands a process of transculturation as integral to this struggle to transform the new South Africa into a society that lives up to the Constitution’s call for the respect of all of its citizens. This respect can only be done if there are serious economic reforms and a challenge to the hegemonic neo-liberal capitalism.

全国首例非法证据排除案反映出非法证据排除规则在实践操作中需注意概念、效力、标准、程序四个重要的技术问题。非法证据是以严重侵犯人权的非法方法收集的证据,实践中要注意区分非法证据与瑕疵证据,切勿将非法证据误判作瑕疵证据。就效力而言,非法证据排除规则的"射程"应当及于侦查前程序。就判断标准来讲,除典型的刑讯逼供行为之外,疲劳审讯也应当纳入"等"字所指范畴予以禁止,而突破社会基本道德底限的威胁、引诱、欺骗性取证也应作为非法证据予以排除。在程序上审查非法证据,应当坚持举证责任倒置的原则,由控方承担证明证据取得具有合法性的举证责任,被告方仅承担"争点形成责任",同时控方应当举证证明至"排除合理怀疑"的程度。  相似文献

Abstract

Is R2P the most effective tool the international community has to prevent genocide, or the newest neo-imperial norm perpetuated by the most powerful states? In a dramatic performance of the key debates within R2P, each of these views is presented before Aristotlean and Tocquevillean insights are drawn upon to find a middle ground rooted in citizen resistance against mass atrocity crimes. R2P can both become a more effective tool of prevention and gain needed political legitimacy by drawing on the rich historical tradition of citizen resistance to empower local actors defying regimes engaged in mass atrocity crimes.  相似文献

从20世纪80年代至今,西方学者对公共治理理论的研究取得重大进步。理论研究涉及公共治理的研究背景、概念界定、核心理论、研究困境以及与传统公共行政、新公共管理理论的比较分析。国家空洞化的现实背景成为公共治理的研究起点,公共治理的内涵界定并不明晰,至今仍未形成一致的概念,网络管理理论则成为公共治理的核心观点。公共治理同时面临治理失效、民主责任的研究困境,与传统公共行政、新公共管理有着明显的区分,公共价值管理也成为公共治理研究的新视角。  相似文献

This article explores and compares the positions of two major powers in East Asia—China and Japan—towards the ‘Responsibility to Protect’ (R2P) norm. R2P calls for collective international responsibility in the event that states are unwilling or unable to protect their people. Evaluating the mainstream argument in the literature that China and Japan have recently been welcoming the R2P norm, we ask the following questions: To what extent have China and Japan aligned themselves with R2P? How do international and national factors play out to influence their R2P stance? To summarize our findings up front: unlike what much of the current literature says, China and Japan's acceptance and practice of the R2P norm are largely pro forma. We argue that they both appear active in participating in the debates but only in order to remain inactive. In other words, they are active participants in the debates and discussions on R2P, but their aim is not to further its usage but to contain its effects. Their current stance on R2P is characterized by what we will call ‘Active in Not Being Active’ (AINBA). The article discusses the key sources and rationale for their AINBA policy with regard to R2P.  相似文献

Models of coalition governance suggest that political parties pursue the interests of their electorate through the ministerial control of policy in their portfolios. Yet, little is known whether voters reward or punish coalition parties for policy performance in their portfolios. This study investigates voters’ evaluations of the policy priorities of coalition parties and their responsibility attribution in twenty policy areas using survey data from Germany. Specifically, we investigate whether voters attribute policy responsibility equally across coalition parties, along the jurisdictional lines of ministerial portfolios, or to the dominant party in the coalition. Our findings suggest that party size, prime minister status, and ministerial portfolios are decisive for responsibility attribution.  相似文献
