“爰(■、辕)田”新解

所谓“爰田” ,并非“易田” ,更非赋税 ,而是先秦发展着的分户授田的制度。井田制下的“田易居” ,即农村公社时的分户授田制。春秋时的晋“作爰田” ,开创了由国家来实施大规模分户授田之先河。战国时商鞅“制辕田” ,亦为国家在打破家长制大家庭后施行更大规模的分户授田。古老的“村社”分户授田制 ,最终为国家授田制所取代     

英国民事司法改革及其对我国的启示

20世纪末英国民事司法改革撼动了英国传统的诉讼文化,并受到世界各国的关注,其成功经验与相关理论对于正在开展民事司法改革的中国有着重要的借鉴意义。文章在介绍和评述英国民事司法改革的背景、目标及内容的基础上,探讨了英国民事司法改革对我国有益的启示与借鉴,并提出应在明确我国民事司法改革特点的基础上将域外经验与本土资源相结合。     

滇国法制初探

滇国为春秋至汉代我国西南古代民族建立的古王国,由于文献资料的阙如,滇国的法制状况鲜为人知,但从不断发现的丰富考古资料来对应文献记载研究,仍可以从阶级结构、民族关系、行政建置、刑事、民事、习惯法等方面对滇国的法制状况进行探讨,大致勾勒出滇国法制的概貌和其特点。     

《三国演义》在朝鲜半岛的传播

由于地理环境的关系,几千年来,中国文化对朝鲜半岛的影响是非常深远的。明清之际,中国古典小说大量传入朝鲜,恰逢此时朝鲜爆发了两场战争,人们开始崇拜关羽,这样关羽和三国的故事开始在朝鲜各阶层广泛传播。随着《三国演义》的广泛流传,其思想和写作方法逐渐被朝鲜人民所接纳继承,朝鲜文人士子模仿《三国演义》的故事情节、人物塑造,根据本国的历史人物创作了《壬辰录》等历史战争小说。     

从严别男女政策看太平天国妇女的社会地位

严别男女政策是太平天国起义之初为适应流动作战需要而实行的一种男女隔离政策,在一定程度上起到了妇女保护作用,但它本身不合情理,再加上执行过程中的激进、极端,对广大妇女所起的保护作用比起她们实际受到的伤害显得微乎其微。这说明太平天国领导人本身并未具有将广大妇女从被压迫的境况中解放出来的伟大志向,他们实行的看似具有妇女解放色彩的政策大多也只是军事政策的副产品。太平天国妇女的社会地位并未得到真正提高。     

Research Note: Randomized field experiments published in the British Journal of Criminology, 1960–2004

Randomized controlled trials have become an important component of evidence-based policy in criminal justice. Because searches of electronic bibliographic databases often miss relevant trials, handsearch – or the visual inspection of the contents of an article – is recommended as an additional search strategy. In this paper, we conducted an electronic handsearch of every available issue of the British Journal of Criminology (1960–2004) to determine how many randomized field experiments were published. We compare these results to earlier manual handsearch efforts to augment the Campbell Collaboration Social, Psychological, Educational and Criminological Trials Register (C2-SPECTR). We find only nine trials (although two used quasi-random allocation such as alternation), and just one published in the past 20 years. We discuss some possible reasons for this, and conclude with a modest agenda for improving the reporting of evidence in the age of evidence-based policy.     

The United Kingdom’s Economic Relations with New Zealand and Australia after Brexit

This article examines the current state of economic relations that the United Kingdom has with New Zealand and Australia, in light of the former’s decision to leave the European Union. Although there are prospects for future trade between these countries post-Brexit based on the three countries’ current comparative advantages, perhaps the greatest scope is for greater trade in services along with greater investment flows. Trade in food produce would be affected by changes in trade policy post-Brexit but other goods such as forestry, mineral and manufacturing products would be more affected by changes in general economic conditions and the relative competiveness of the industries in international markets. Already these aspects of trade are important and are expected to grow and develop over time. Much of the future negotiations between the three countries will take up a range of issues associated with investment and the trade in services and much of the future prospects for growth in trade might depend on the success of these negotiations.     

CHOGM 2018: A Right Royal Affair

The 2018 Commonwealth Heads of Government Meeting (CHOGM) was eventful and significant for the Commonwealth and for the host country, the UK. It witnessed an unprecedented rolling out of royalty and royal residences and secured the succession of Prince Charles as the next head of the Commonwealth. It provided the UK with an opportunity to consolidate a traditional old constituency at a time when Brexit is looming large and creating serious uncertainty. A number of significant decisions were taken across the policy agenda and a High Level Review Group on the governance of the Commonwealth Secretariat, set up at the previous CHOGM but unable to complete its work in time, was re-energised and given an expanded mandate. This article notes that the reforms will be important, but questions whether they will be enough to keep the Commonwealth relevant and effective in the face of new global challenges.
