党的群众路线的历史演进与现实意义

群众路线是党将马克思主义基本原理运用于中国革命实践的伟大创造,是党的理论、路线、方针和政策应有之义,体现了党的性质与宗旨,是党的根本工作路线、工作方法和宝贵经验总结。党根据不同时期的目标和任务,将群众路线创造性运用,赢得了民族的独立和人民的解放,走上了社会主义道路,取得了改革开放的伟大成就。在改革开放的新时期,只有坚持群众路线,才能永葆党的生机和活力,取得中国特色社会主义的伟大胜利。     

平台用工劳动权益保护的立法进路

我国互联网平台工人数量多达数千万,且增长迅速。平台工人面临身份不明确、工作时间长、收入不稳定、职业伤害保障缺失、算法运行不合理等突出问题。由于平台用工的特殊性,现有劳动法及其司法实践难以为平台工人提供有效保护。近年来,越来越多的国家,包括美国、法国、意大利等对平台工人进行了专门立法。我国有必要出台平台工人权益保护专门立法。平台工人权益保护立法的基本思路是确保符合"劳动者"标准的工人得到劳动法保护,并为一般平台工人提供基本劳动权益保障。立法应通过劳动关系举证责任转移规则,使平台工人身份得到正确归类。平台工人的基本权益内容应根据所有工人应享有的基本权益、平台用工的灵活性以及平台主要依靠算法运行的特点而设计,应赋予平台工人平等就业、职业安全卫生、工资、工时、加入工会和集体协商等方面的权利,以及与算法相关的权利。     

Understanding the links between perceived prison conditions and prison staff

In the Dutch prison system, motivational treatment is seen as one of the key contributors to a dignified and humane prison climate, stimulating inmates to assume personal responsibility and to change their lives. Staff are seen as the crucial factor to attaining this goal. The assumption is that the staff’s work situation has an impact on how inmates are treated. How inmates are treated in turn influences how they perceive prison conditions. In this study, we will examine the correlations between work situation, treatment styles and perceived prison conditions by means of a multilevel linear regression. The results show that a good work situation for prison staff is a precondition for practicing an active approach to inmates. In addition, inmates are more satisfied with the prison conditions if the various treatment styles are thoroughly applied. A balance between providing support and structure for inmates appears to be very important. Motivational treatment proves to be significantly correlated to the inmates’ satisfaction regarding prison conditions.     

科学理解军队政法工作的基本含义

政法工作是活跃在当代中国政治生活中的特殊实践活动。中国共产党、政权、司法是其核心词汇。军队政法工作的概念由此缘起,它是一个涉及法学的政治学和军事学术语,是一种综合性的实践活动,与政法机关工作、政法建设有联系也有区别。     

ALL CHILDREN ARE NOT CREATED EQUAL: PRWORA'S UNCONSTITUTIONAL RESTRICTION ON IMMIGRANT CHILDREN'S ACCESS TO FEDERAL HEALTH CARE PROGRAMS

The lack of health insurance for children is a serious problem in the United States, especially for those children in families that earn too little to get private health insurance and too much to qualify for Medicare. Even within this subclass of children, immigrant children are particularly vulnerable to the problems faced by lack of health care. Nevertheless, with the passage of the Personal Responsibility and Work Reconciliation Act (PRWORA) by Congress, equality interests of low‐income immigrant children are undermined when immigrant children are denied federal benefits for the first 5 years of residency in the United States. The first part of this Note examines the importance of child health care and the long‐term problems with uninsured children, especially with uninsured immigrant children and pregnant women. The next part introduces Medicaid as well as State Children's Health Insurance Program, a supplemental federal program designed to increase health care coverage to all children, while contrasting these programs in light of the restrictive anti‐immigrant PRWORA provisions. The third part explains the passage of PRWORA, its anti‐immigrant provisions, and how these provisions prevent needy immigrant children from receiving federally funded health care. Then, the fourth part uses both the Equal Protection Clause of the Fourteenth Amendment and the Due Process Clause of the Fifth Amendment to argue the unconstitutionality of the anti‐immigrant provisions. Finally, the last part lays out the recommendation to amend the Social Security Act so that the PRWORA barriers can be removed and recent immigrant children can receive federally funded health care.     

非警务活动现状梳理与探究

以1986-2005年共20份政府工作报告为研究素材,运用计量分析和语意分析方法,对政府工作报告中涉及“多边外交”的文字表述进行了定量和定性分析。我国多边外交政策的发展呈现出明显的阶段性特征。近年来我国政府对多边外交工作越来越重视,多边外交政策在实践中不断走向成熟,其深度和广度也在不断拓展。     

我国社会阶层的分化对统战工作的挑战及对策研究

改革开放以来,我国社会结构变化的一个重要体现就是社会阶层构成的变化,不仅原有的社会阶级内部出现了重大变动,而且出现了新的社会阶层。这种社会阶层构成的深刻变化必然给统战工作带来严重挑战。研究新情况,解决新问题,适应新形势的发展,采取积极的对应措施是当前统战工作的重要课题。     

按生产要素分配小注

党的十五大以后,我国理论界开始了关于按生产要素分配种种问题的讨论,有种观点认为,按劳分配本来就属于按生产要素分配,原来把生产要素分配和按劳分配对立起来的观点是理论上的误区。本文对此观点持有异议,认为按生产要素分配并不包括按劳分配,二者有着本质的区别。

云南地处祖国边陲,少数民族众多,风俗禁忌复杂,在公安工作中必须采取十分谨慎的态度,严格按照党的民族改革和法律办事,正确处理少数民族风俗禁忌问题,巩固和发展各民族团结和睦的局面,尊重少数民族的自治权利、语言文字和风俗习惯,为构建和谐社会、维护边疆稳定、推进云南现代化建设和对外开放提供坚实的保障。
