论国际犯罪刑事管辖权的演变

与国际社会体制的发展相适应,国际犯罪管辖权从“单一模式”向“复合模式”转变,形成了间接管辖权和直接管辖权并存的格局。间接管辖权即国家管辖权是国际犯罪管辖权的主要模式。一系列国际特设刑事法庭管辖权开创了国际犯罪直接管辖的理论和实践,国际刑事法院管辖权则是国际犯罪直接管辖权的最新发展。     

试论晚清时期外交思潮的演变

晚清时期,中国政府外交政策的特点主要表现为以“和戎”“自强”为主线,随机、应变、实用主义的色彩比较浓厚,受传统思想的影响非常深。同时,一些有识之士充分运用自身所具有的优势条件,通过细致深入的观察及对外交往中实践经验的总结,在外交思想上提出了许多建设性的意见,对日后中国现代外交意识、现代邦交思想的最后形成起到了启蒙和推动作用。     

Advances in the Study of Political Advertising

One of the biggest recent advances in the study of political advertising has been the availability of systematic sources of data on when and where ads air—and their content. In this piece, we review the various data sources that scholars have used to study political advertising, focusing on their strengths and weaknesses. We then discuss recent studies that have employed data on political advertising to examine the effects of ad exposure on citizens' attitudes and political behaviors, how the content of advertising varies, and how ads have been targeted in recent political campaigns. We follow that with our own empirical contribution—an analysis of trends in advertising content, including negativity and policy focus—over the past 16 years.     

证券市场的稳定发展需要加强有效的监管

我国证券市场经过十余年的发展,已经粗具规模。证券市场的发展,对于提高长期资金筹集、资本经营、优化资源配置等起到了重要作用。在我国加入WTO后,证券市场是机遇与挑战、“利多”和“利空”并存,证券市场的稳定意义重大。因此,发展我国证券市场必须从国情出发,对证券市场的监管应综合治理,各监管主体应相互配合,构建多主体的监管框架,以形成监管合力,维护证券市场的稳定与健康发展,切实保护投资者利益。     

CHILD SUPPORT GUIDELINES:

Since 1989, federal law requires states to have presumptive child support guidelines and review them using economic data on child-rearing costs at least once every 4 years. This article reviews the child support guidelines models adopted by states, how they relate to estimates of child-rearing expenditures, the extent that states are updating their guidelines, and some of the more controversial guidelines provisions (i.e., adjustments for shared-parenting time, additional dependent children, and low-income nonresidential parents). We find that many states are not updating their core formulas and schedules. As a result, several state guidelines produce support award amounts that are below the costs of raising children.

行政指导新论

作为一类非强制性的行政作用,行政指导不仅能够与传统的依法行政理念相契合,而且其存在本身即预示着传统行政模式的转型。我国当下应谨慎地实施行政指导,并以过程的公开化、内容的科学化以及救济的类型化为基点,逐步将行政指导纳入法治化的轨道。     

Gender at Janaka’s Court: Women in the Bṛhadāraṇyaka Upaniṣad Reconsidered

The female characters in the Bṛhadāraṇyaka Upaniṣad have generally been interpreted by scholars in two opposing fashions: as fictional characters whose historicity can be dismissed or as representative of actual women in ancient India. Both of these interpretations, however, overlook the literary elements of this text and the role that these female characters play within the larger philosophical debate. This paper is an analysis of the various women who appear in the Bṛhadāraṇyaka and their role in this text. Close attention is paid to their characterizations, their relationship to the doctrine discussed, and their functions in the larger narrative structure. The paper concludes with a discussion about the relationship of narrative to history and fundamental problems with the “woman question” based on this text.     

论我国经济贸易仲裁机构制度的改革与完善

在国际商事仲裁立法理论与实践上,仲裁机构不仅包括常设仲裁机构,而且也包括临时仲裁机构。我国现行仲裁法并未就临时仲裁作出规定,这是我国在立法制度上的缺憾。认为,随着经济全球化和国际服务贸易的发展,为了在对等原则上通过仲裁方式解决国际经济贸易合同争议,我国仲裁法应当承认临时仲裁在我国仲裁制度中的法律地位。
