Research on child‐related risk factors for filicide is scant. We investigated whether prior healthcare use for injury (including poisoning) influences filicide risk. Victims (0–14 years; n = 71) were identified in a national autopsy database for the years 1994–2012 and compared to matched, general population controls (n = 355). Healthcare use data were retrieved from a national patient registry. Risks were estimated using odds ratios (ORs) and 95% confidence intervals (CIs). For females, prior inpatient care for injury conferred a statistically significant sevenfold risk (OR = 6.67 [95% CI: 1.49–29.79]), and any prior injury‐related healthcare use conferred a statistically significant fourfold risk (OR = 3.57 [95% CI: 1.13–11.25]), of filicide victimization. No statistically significant risks were found for males. Healthcare personnel should be aware that children treated for injuries, especially females, may be at an elevated risk of filicide victimization. Nevertheless, the filicide base rate remains low, and parents may be stigmatized by unfounded alerts; thus, prudent reflection should precede reports to the authorities.  相似文献

President Duterte of the Philippines implemented an open “war” on drugs based upon claims of an over-proliferation of illegal drugs in the country. Despite summary killings of suspected users and dealers, Duterte enjoys popular support among Filipinos. This paper assesses reasons behind the support using citizens’ perceptions of the severity of the drugs/crime problem, their punitiveness, and authoritarian attitudes as explanations. A sample of 114 Filipinos across Luzon, Visayas and Mindanao responded to an electronic survey about socio-legal issues. Results show that drugs/crime are perceived as serious problems nationally yet only minor problems locally. This perceived national seriousness is significantly related to support for Duterte. Trust in the law and enforcement agents, an authoritarian attitude, and region are also strongly related to support for Duterte. This paper concludes with reflections on information manipulation as means to advance political ends and the importance of context in furthering theories of authoritarian submission.  相似文献

The use of digital technologies, functioning thanks to data processing, has been conquering many sectors of the world economy and it is possible that, in the near future, only a few markets will still be excluded from this industrial revolution. Therefore, even if one chose unreasonably to disregard the many innovations that the digital economy has brought about, its development seems quite inexorable, although it is true that this new stage in human progress raises some concerns. In particular, many worry about the millions of passive and powerless digital consumers who, facing a few huge and influential companies without any education or awareness, could succumb and find themselves poorer, victimized, and manipulated. The paper proposes to react to this state of affairs without further fueling the fear of the digital revolution and without the thought that regulation can be used only as a shield to protect fragile digital consumers. Rather, by taking inspiration from some regulatory actions undertaken by the European Union, the paper bears in mind that regulation can be used as a sword in the hands of consumers to finally assign them a lead role in digital markets. New rules to empower consumers and to make them take autonomous and independent decisions as to the management of their personal data as well as to the merits of digital firms can be envisaged. After all, one of the cultural roots of Western societies is that every individual should be enabled to be faber ipsius fortunae.  相似文献

Abolitionism is an important, but often overlooked, theoretical and political alternative to the failings and injustices of the penal system and other forms of social control. While many have documented different approaches to abolitionist strategy, few have explored the work that is done sensitizing individuals to abolitionism, including in university settings. Through an analysis of student journal entries, this study discusses how students enrolled in a mandatory abolition course engaged with the viability of, and barriers to, a world without prisons, punishment and other forms of control. By looking at abolition as a threshold concept, we consider how students negotiate the concept of abolition as a radical justice alternative. As the journal entries showed, while students were able to understand the basic tenets of abolition, many remained in a liminal state between the existing system and the unknown landscape of abolition, and could not see its viability or possibility as a radical alternative. We conclude that other learning strategies may have been helpful in moving student through such a ‘dangerous’ concept. Further research on sensitising individuals to abolition is needed given the current proliferation and intensification of penal and carceral institutions today.  相似文献

在中国行政执法过程中,政府面临着普遍的“两难困境”,在立法过程中政府立场与民间态度缺乏有诚意的、有效的和充分的沟通,导致政府立场与民间态度的紧张;在执法过程中政府奉行一种“问题化策略”和“运动式执法”,过分迷信强制和制裁的力量而忽视了执法过程中所有参与者制度性的相互学习,故加剧了规则表达和规则实践之间的背反。走出执法困境要求在规则制定过程中,政府立场与民间态度通过制度化机制进行有效的、富有意义的交涉,在执法过程中应采取务实的态度,注重博弈过程中的学习、反思和策略调整。  相似文献

社会保护机能与人权保障机能的统一是刑法的整体价值目标,而不是刑法某一个构成要素的价值目标。认为相对罪刑法定原则具有人权保障和社会保护双重机能的观点,实际上是混淆了刑法的机能与罪刑法定原则的机能,错把刑法的整体机能当成了其构成要素的机能。罪刑法定原则虽然应当服务于刑法的整体价值目标,但是,它却不应该、也不可能直接承载社会保护的价值内容。我国《刑法》第3条从正反两个方面规定罪刑法定原则,将社会保护的内容附加给罪刑法定原则,在一定程度上消解了这一原则的社会法律意义,不利于现代刑法观念的培植。  相似文献
