转型时期大学生弱势群体成因研究

该文指出,大学生弱势群体是随着中国社会转型和高等教育环境变化而出现的一个特殊群体,近年来大学生弱势群体问题日益凸显,成为影响社会稳定和高等教育事业健康发展的一个潜在的不利因素,引起了社会的广泛关注。从理论上研究其形成原因,有利于提出具有操作性的解决方案,对促进新时期大学生的全面发展具有十分重要的现实意义。

目前,我国新农村环境保护法制建设中存在干群环境法律意识淡薄,环境管理体制不完善等严重问题。完善新农村生态环境法律体系的途径有：一要树立环境法治理念,推动公民环境权入法规;二要构建农村环境法律体系;三要加强农村环境执法工作。     

Greening Constitutions with Environmental Rights: Testing the Isomorphism Thesis

Why do some countries have constitutional environmental rights while others do not? In this paper, I conduct statistical analyses to respond to this inquiry. Through studying the impact of intraregional constitutional design, I aim to understand why states adopt environmental rights. I argue that regional isomorphism—i.e., the tendency among states within a region to converge on certain policies—may explain the trend toward constitutionalization of environmental rights. In this paper I (1) define and provide historical background on environmental rights, (2) describe theories which support regional isomorphism as a means of explaining the adoption of constitutional environmental rights, and (3) conduct statistical tests to determine the validity of the regional isomorphism thesis. I find that the enactment of constitutional environmental rights within a region does not increase the likelihood that another state within the same region will include environmental rights within its constitution.     

Cyber pornography in India and its implication on cyber café operators

Cyber pornography plays an accessory role in negative social issues such as child abuse, violence against women, rape, inequality, relationship and family breakdown, youth crime, promiscuity and sexually transmitted diseases. Cyberspace and the pornographic matter transmitted through it have created challenges for India’s antiquated laws. The lack of jurisdictional boundaries and the sheer volume of traffic that the Internet can handle, as well as the potential for anonymity have resulted in a complete lack of control over what appears on the Web at the click of a mouse button. Before there was no liability of a cyber café owner but with the introduction of the Information Technology Amendment Act, 2008, the responsibilities of Cyber Café owners have only increased. This paper deals with the Cyber pornography, its legal implications and the liability of cyber café owner under the Information Technology Amendment Act, 2008.

当代新信息技术的发展创造了一个全新的复杂信息环境。在信息环境中,人既是信息主体,又是信息客体,人与信息环境之间的关系是互动的,人创造、改造信息环境的同时也被改变、被塑造,因而产生一些心理、思维和行为新问题。如何应对复杂信息环境对我们心理、思维和行为的影响,这是一个值得深入研究的问题。     

中日海洋环境陆源污染治理的政策执行比较及启示

陆源污染是海洋环境污染的主要来源,陆源污染治理是中国现阶段海洋污染防治的重要课题。本文从政策执行的主体、手段、监督三个方面对中国与日本的海洋环境陆源污染治理的政策执行进行比较分析。研究发现,日本治理陆源污染的政策执行主体多元、手段多样、监督高效,为中国陆源污染治理政策执行主体结构的优化、执行手段的增强、执行监督的强化提供了一些有益的经验和启示。     

提升公安机关驾驭动态社会治安能力的几点思考

影响公安机关驾驭动态社会治安能力的不利因素是多方面的。既有来自社会、科技发展方面的,也有法制不完备、舆论导向不规范、警力保障不足等方面的。公安机关应努力克服不利因素的困扰,从健全、完善法律制度;改善警察公共关系;强化民警的业务培训;从优待警;信息化建设;构建虚拟社会整体防控体系建设;深入推进社区警务战略等为切入点,不断提高驾驭动态社会治安的控制能力。     

法治化进程中律师权利的保障和救济

较旧律师法而言,新律师法在律师的执业权利方面有诸多突破,在一定程度上改善了律师的执业环境,但仍然存在如何保障法律所赋予的权利以优化律师执业环境等诸多问题。应从大处着眼,不断完善中国的律师制度,以加强对律师权利的保障和救济。
