伪证罪的若干问题探讨

在我国刑法中,伪证罪侵犯的客体应该是国家司法机关刑事诉讼的正常活动。在客观方面,“虚假”是违反证人的记忆并且不符合客观事实的陈述。在伪证罪主体认定中,共同被告能否互为证人,应当以共同被告人之间是否存在实体上的共犯关系区别对待。另外,根据我国刑法规定,鉴定人不包括单位。

Framing,valuing, and assessing the environment: August Wilhelm Hupel’s perceptions of Baltic nature and settings for human activities

This article addresses early modern Baltic environmental history and historical geography by interpreting the public writings of August Wilhelm Hupel within the theoretical framework of framing, valuing, and assessing nature and the environment. Hupel’s broad series of publications, issued during the heyday of Baltic Enlightenment, not only contributed to the emergence of Baltic geographical studies but also played a pioneering role in placing the knowledge on Estonian and Livonian topography and nature to order. Although Hupel concerned physical geographical aspects in his writings to some extent, his primary interest definitely focused on human relations with and across space and place. The cameralist thoroughness and calculativeness within that geographical field of enquiry brought about an endeavor to catalogue the parts of nature by using their utility or harmfulness as the measure. However, in Hupel’s opinion the then-prevailing civilisation also contained certain responsibilities for and to nature, particularly regarding forests and their sustainable use (‘nachhaltende Nutzung’), which Hupel wished to promote in the Baltic provinces of Russia.     

虚假诉讼法律监督联动协作机制研究

由于工作机制不健全,目前虚假诉讼监督工作存在不少薄弱环节。为了更好地监督和惩治虚假诉讼,检察机关宜多管齐下、内外兼修,建立健全虚假诉讼监督联动协作机制。在政法领域,检察机关应当积极争取党委支持,强化与其他司法机关的沟通联系,统一认识、紧密配合,形成打击合力,以会签文件的方式建立联动协作工作机制。在检察系统内部,应当完善相关工作机制,实行上下级一体化办案、各部门横向协作、检察长靠前指挥,加大虚假诉讼监督工作力度。     

我国行政法存在的问题浅析

我国证券市场虚假陈述行为的相关法律在不断进步和完善之中,但在虚假陈述行为的民事责任认定、损害赔偿范围及标准、赔偿司法程序等方面的实施效果并不令人满意,给投资者权益造成了损害,因此在这些方面有进行适当修正的必要。     

When Children are the Least Vulnerable to False Memories: A True Report or a Case of Autosuggestion?

In this case report, a legal case revolving around the reliability of statements given by a 6‐year‐old girl is described. She claimed to have witnessed her mother being murdered by her father. Two psychological experts provided diametrically opposed opinions about the reliability of her statements. One expert, a clinician, opined that the girl's statements were based on autosuggestion whereas the other expert, a memory researcher, stated that autosuggestion was unlikely to have played a role. This case and the analysis of the experts' opinions illustrate what may happen when experts in court are unaware of the recent literature on (false) memory. That is, recent studies show that autosuggestion is less likely to occur in young children than in older children and adults. The current case stresses the importance and implications of relying on memory experts in cases concerning the reliability of eyewitness statements.     

Individual values and delinquency: on considering universals in the content and structure of values

The systematic relation between delinquency and the overall spectrum of individual values has not been a particular topic of psychological research in the past. To fill this gap, we refer to Schwartz’s [(1992). Universals in the content and structure of values: Theoretical advances and empirical tests in 20 countries. Advances in Experimental Social Psychology, 25, 1–65] theory of universals in the content and structure of values (TUV) and re-interpret the results of Hermann’s [(2003). Werte und Kriminalität. Wiesbaden: Springer] criminological research on individual reflexive values, norm acceptance, and self-reported delinquency against this background: We verify to what extent the Individual Reflexive Value Scale (IRVS) covers the overall spectrum of values defined by TUV. We validate this match by content analysis and multidimensional scaling (MDS) and compute IRVS-based basic and higher-order value scores. Confirmatory and spherical MDS with these scores yield the circular value structure postulated by TUV. Structural equation modelling (SEM) reveals systematic relations between basic values, norm acceptance and self-reported delinquency in accord with the ‘sinusoid curve hypothesis’. Moving around the value circle yields the highest negative correlations of self-reported delinquency with tradition and conformity and the highest positive correlations with hedonism and stimulation. These values are indicators of the higher-order value dimension ‘conservation’ versus ‘openness to change’. The significant impact of this value dimension on norm acceptance and delinquency is documented by means of SEM.
