加快发展非公有制经济,必须建立职代会制度,建立完善的法律法规,探索实践职代会的内容和形式,在社会上着力营造出良好的大环境,使职代会在协调非公有制企业劳动关系中,在发挥、调动和保护职工积极性和主动性,促进非公有制企业发展中充分发挥作用。     

General Election 2015 in Singapore: What Social Media Did and Did not Do

Abstract

The online buzz leading up to the 2015 Singapore general election (GE2015) favoured opposition parties and personalities, encouraging perceptions that the opposition would garner more votes than in 2011. Instead, the ruling People’s Action Party won and saw an increase in their vote share from 60.1% in 2011 to 69.9%. What role, then, did social media play in this election? This study shows that, against prevailing assumptions, GE2015 was not a social media election. Through an online survey of 2,000 respondents conducted after polling day, it was found that mainstream media and their online counterparts were used most frequently and were trusted more as sources of information about the election. Online and offline political participation was also low. However, social media users were more interested in election issues, were more likely to discuss politics with others and participated more in offline political activities than non-users.     

Adapting to Prison Life: A Qualitative Examination of the Coping Process among Incarcerated Offenders

Research on general strain theory has demonstrated the impact of strain on decisions to engage in crime and delinquency. However, people differ in their responses to strain and only some resort to crime or delinquency. There remain gaps in our knowledge of when, and under what conditions, individuals will react to strain with offending behavior. We rely on interviews with 40 incarcerated men to understand how they cope with specific prison strains, and why they make such coping choices. We find considerable variation in inmates’ coping responses. They use a variety of coping strategies—behavioral, cognitive, and emotional—and only some of these strategies involve offending. Our findings indicate that responses to prison strain are partly a function of past experience with strains, including prior experimentation with coping techniques. Results highlight the unfolding nature of the coping process and expose factors that deserve further attention in tests of GST.     

民族民间文化的分类及普查原则

甘肃省的民族民间文化遗产丰富且民族性、地域性突出。本文根据民间文化的多样性和国际上通用的分类法,结合我国对民间文化习惯的表达方式和甘肃省的特点,将省内的民间文化遗产划分为四大类别,并从中加以细分。同时,就民间文化遗产的普查原则提出自己的看法。     

论我国正当防卫制度

我国正当防卫制度是一般防卫与特别防卫制度的结合。特别防卫制度是在法律规定的在针对正在进行的特定重大不法人身侵害等案件中的防卫人才有权实施的不受防卫限度、手段等限制的不承担防卫过当责任的一种特别防卫行为。我国防卫制度以一般防卫制度为基础,防卫过当的行为依然受一般防卫制度的调整。     

劳动担保合同存废论——兼论确立劳动人事一般保证制度

对于劳动担保合同,言废者有之,言存者有之。从现实来看,一方面,《劳动合同法》关于不得要求劳动者提供担保的规定未能消除大量存在的劳动担保合同;另一方面,劳动担保合同领域存在的乱象亦亟需疏导规制。因此,劳动担保合同既不可简单废除,也不能轻言存续。正确的选择是既要从严控制劳动担保合同的订立和适用,也要在立法上留有余地,确立特定行业岗位的劳动人事一般保证制度,不实行连带保证制度。     

Stature Estimation Formulae for Nigerians

Abstract:  In stature estimation, long limbs and the stature formula of Trotter and Gleser easily come to mind. In the recent past, a lot of workers have established formulae specific to their populations using whole length of limbs, fragmented bones, circumference of long bones, and even length of the vertebrae. We have in this work used tibia length, height of subjects, and the regression models to establish formulae specific to Nigerians. We measured height and tibia length of 200 (96 male and 104 female) adult Nigerians. The tibia length was measured from upper limit of the medial condoyle to the tip of medial malleolus using a measuring tape calibrated in meters while the height of individuals were also measured using meter scales. All measurements were made by one person, to avoid interobserver error, and repeatedly until a constant value is obtained. We obtained general formulae for males and females which compares favorably with that of Duyar and Pelin, and can be relied upon.     

我国民事诉讼法的理念转换与总则的制度重构

民事诉讼制度的完善是构建社会主义和谐社会的一个重要方面。民事诉讼法的修改为回应社会发展的需要,必须首先在诉讼理念上实现根本转变,同时,通过系统且细致的制度建构保障这些新理念的实现。
